EXECUTIVE SUMMARY Mike Kuark with Sushi 21 Express Restaurant, on behalf of property owner D&S Investments, is requesting approval of Conditional Use Permit (CUP) No. 2020-23 to allow the sale of alcoholic beverages for on premise consumption at an existing restaurant located at 3701 South Harbor Boulevard, Unit E. Pursuant to Section 41-196 of the Santa Ana Municipal Code (SAMC), establishments wishing to sell alcoholic beverages for on-premises consumption require approval of a CUP. Staff is recommending approval of the applicant’s request because the project has demonstrated compliance with zoning requirements as discussed and analyzed in the sections below, because the site is located away from sensitive uses, and due to the property’s history of compliance with City codes and regulations. DISCUSSION Project Description Sushi 21 Express currently occupies a 1,616-square foot tenant space within a multi- tenant commercial building. The restaurant will accommodate up to 26 patrons within its dining area and will operate Monday through Saturday from 10:00 a.m. to 12:00 a.m. (midnight). With the approval of the Conditional Use Permit, the applicant intends to apply for a Type 41 (Beer & Wine) Alcohol Beverage Control (ABC) license ancillary to the food service on premise. All alcoholic beverages will be stored within the restaurant’s cooler, storage racks and service counter area, which will be less than 60 square feet in size combined. Both the storage and display areas will make up less than five percent of the total restaurant’s floor area as required by SAMC Section 41- 196(g)(25). No entertainment is being proposed at this time. Should the applicant seek to provide entertainment, approval of an entertainment permit will be required. Project Analysis CUP requests are governed by Section 41-638 of the SAMC. CUPs may be granted when it can be shown that the proposed project will not adversely impact the community. If these findings can be made, then it is appropriate to grant the CUP. Conversely, the inability to make these findings would result in a denial. Staff has reviewed the applicant’s request to sell beer and wine and has determined that the sale of beer and wine at the subject location will not be detrimental to the health, safety, and welfare of the community. The proposed sale of beer and wine for on site consumption will provide an ancillary service to the restaurant’s customers by allowing them the ability to purchase a variety of alcoholic beverages with their meal and will allow Sushi 21 Express to be economically viable and compete with nearby full-service restaurants that offer that same services. In addition, the operational standards applied to the ABC license will mitigate any potential impacts created by the use and will ensure that the use will not negatively affect the surrounding community. Furthermore, the subject site is not located within immediate proximity to parks, playgrounds, schools, or religious institutions. The nearest sensitive land use is Sofia University, which is approximately 700 feet to the south. As a result, the granting of the CUP will not negatively impact any sensitive land uses that may be nearby. Approval of the CUP will be consistent with several goals and policies of the General Plan. Policy 2.2 of the Land Use Element encourages land uses that accommodate the City’s needs for goods and services. Providing a variety of full-service restaurants that offer alcoholic beverages offer additional dining options for Santa Ana residents and visitors. Furthermore, Policy 2.9 of the Land Use Element supports developments that create a business environment that is safe and attractive. Operational standards for the restaurant applicable to the ABC license will ensure maintenance of a safe and attractive environment in the neighborhood. Finally, Policy 5.5 of the Land Use Element encourages development that is compatible with and supporting of surrounding land uses. Sushi 21 Express will be located within a commercial development and its operations will be compatible with the surrounding commercial businesses. Police Department Analysis The Police Department reviews CUP applications for the sale and service of alcoholic beverages in order to ensure that the potential crime and nuisance behaviors associated with alcohol consumption are mitigated to the greatest extent possible. For on-sale licenses, the Police Department analyzes the crime rate in the area using the standards and definitions contained in the Business and Professions Code Section 23948.4(c)(2), which are also utilized by the State Department of Alcoholic Beverage Control (ABC). This section defines “reported crimes” as criminal homicide, forcible rape, robbery, aggravated assault, burglary, larceny theft, and motor vehicle theft, combined with all arrests for other crimes, both felonies and misdemeanors, except traffic citations. The Police Department then compares the number of such crimes in the reporting district as compared to the number of crimes in other reporting districts. In keeping with the standard used by the State Department of Alcoholic Beverage Control and Business and Professions Code, should the Police Department determine that the reporting district has a 20 percent greater number of reported crimes than the average number found in all reporting districts, the Police Department will consider this information in making its recommendation. As part of the application process, this application was reviewed by the Police Department. Based on their review, the Police Department has no issues of concern regarding this application. Economic Development Benefits The operation of Sushi 21 Express restaurant is expected to generate $150,000 in annual sales with approved ABC license, resulting in approximately $15,385 in annual sales tax revenues for the City. Permit fees for the city and state license will be $7,580.88. Finally, this project will result in about three part time jobs and three full time permanent jobs. Public Notification and Community Outreach Project notifications were posted, published, and mailed in accordance with City and State regulations. A public notice was posted on the project site on January 28, 2021. Notification by mail was mailed to all property owners and occupants within 500 feet of the project site on January 27, 2021. Lastly, a newspaper posting was published in the Orange County Reporter on January 27, 2021. In addition, the site is not located within the boundaries of nor adjacent to the boundaries of an established Neighborhood Association. At the time this report was printed, no issues of concern were raised regarding the proposed CUP. The proposed sale of alcoholic beverages for on -premises consumption at this location will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity because the operational standards applicable to the alcoholic beverage control license and conditions of approval will address any potential negative or adverse impacts created by the use. The granting of the CUP will not negatively impact any sensitive land uses that may be nearby. 3. That the proposed use will not adversely affect the present economic stability or future economic development of properties surrounding the area. The proposed use will not adversely affect the economic stability of the area, but will instead allow the restaurant to compete with other nearby eating establishments that offer a full selection of alcoholic beverages for sale to their customers. Moreover, the offering of alcoholic beverages will allow the restaurant to be economically viable and compete with nearby full-service eating establishments in Santa Ana and will contribute to the overall success of the City. 4. That the proposed use will comply with the regulations and conditions specified in Chapter 41 for such use. The proposed conditional use permit will be in compliance with all applicable regulations and operational standards imposed on an eating establishment selling alcoholic beverages for on-premises consumption pursuant to Chapter 41 of the SAMC. The facility will be maintained as a full- service, bona-fide eating establishment, having suitable kitchen facilities and supplying an assortment of foods. Additionally, the restaurant will utilize less than five (5%) percent of the gross floor area for display and storage of alcoholic beverages, which is the maximum threshold established by the SAMC. In addition, operational standards will ensure the project remains in compliance with all applicable codes and regulations related to alcohol sales to ensure that the use does not impact neighboring properties or create an attractive nuisance jmf 1/26/21 Resolution No. 2021-XXX Page 3 of 7 5. That the proposed use will not adversely affect the General Plan of the city or any specific plan applicable to the area of the proposed use. The proposed sale of alcoholic beverages for on -premises consumption at this location will not adversely affect the General Plan or any specific plan. The granting of CUP No. 2020-23 supports several policies contained in the General Plan. Policy 2.2 of the Land Use Element encourages land uses that accommodate the City’s needs for goods and services. Providing a variety of full-service eating establishments that provide alcoholic beverages as part of their menu offers additional dining options for Santa Ana residents and visitors. Furthermore, Policy 2.9 of the Land Use Element supports developments that create a business environment that is safe and attractive. Operational standards for the proposed ABC license will maintain a safe and attractive environment in the neighborhood. Policy 5.5 of the Land Use Element encourages development that is compatible with and supporting of surrounding land uses. Sushi 21 Express is located within a multi-tenant commercial building and its operation is compatible with the surrounding commercial businesses. Section 2. In accordance with the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the project is categorically exempt from further review per Section 15301 (Class 1 – Existing Facilities). Class 1 exemption applies to the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The project proposes to allow the operation of an alcoholic beverage control license to sell alcoholic beverages at a bona-fide restaurant. Based on this analysis, a Notice of Exemption, Environmental Review No. 2021-11, will be filed for this project. Section 3. EXECUTIVE SUMMARY Rose Bacinski of Bacinski & Associates, representing property owner Brian Katz, is requesting approval of two conditional use permit (CUP) applications to facilitate construction of a Tacos Gavilan eating establishment at 2320 South Bristol Street. Specifically, the applicant is requesting two CUPs pursuant to Section 41-365.5 (e) and (f), as permitted by Section 41-377.5 (a) of the Santa Ana Municipal Code (SAMC), to allow a restaurant with drive-through window service and to allow the restaurant to operate after-hours until 2:00 a.m. on Saturday and Sunday. Staff is recommending approval of the entitlements to facilitate the construction of a new restaurant for Tacos Gavilan. The proposed project will redevelop an existing lot and provide additional services to residents, workers, and visitors in the area. The project will not negatively impact the surrounding community as the project has been designed to minimize impacts to the nearby sensitive land uses. DISCUSSION Project Description The applicant is proposing to demolish an existing 6,746-square foot building and its non-conforming pole sign and construct a new 2,765-square-foot eating establishment for Tacos Gavilan with drive-through operations and after-hours operations until 2:00 a.m. on Saturday and Sunday. The proposed eating establishment will include a dining area with seating for approximately 63 guests and an outdoor patio/hardscape area. Project Background and Chronology The subject site was developed with a commercial (bank) building in 1968. A fabrics company occupied the building between 1987 and 2016, when a Halloween briefly occupied the site. The site has remained vacant since then. The subject application was submitted to the City in March 2020. Since its initial submission, the project’s architecture and layout have been refined to comply with the City’s development standards and applicable design guidelines for commercial buildings and drive-through establishments. Project Analysis CUP requests are governed by Section 41-638 of the SAMC. CUPs may be granted when it can be shown that the proposed project will not adversely impact the community. If these findings can be made, then it is appropriate to grant the CUP. Conversely, the inability to make these findings would result in a denial. The drive-through lane meets the City’s stacking requirements and will allow for a minimum of eight cars to queue without disrupting Bristol Street, the site’s drive aisles, or on-site parking spaces. An analysis of the site access and site circulation determined that the proposed site plan provides adequate space for vehicles to maneuver through the project site and drive-through lane. In addition, vehicle queuing at the driveway to access both the parking area and the drive-through lane’s entrance is designed to minimize impacts to Bristol Street. The drive-through operation is also designed to generate minimal noise impacts as the speaker boards are located towards the car wash/commercial site to the south of the project site, and away from the residential uses to the west of the project site. Any potential noise generated from the idling of vehicles or the drive-through speakers is not anticipated to impact the closest residential uses as those residential uses are approximately 150 feet away to the west and are separated from the project site by an existing eight-foot tall block wall. Moreover, the drive-through lane is at the south end of the property, which produces minimal visual impact to Bristol Street as the new building will be the prominent view from the street. The site design proposes multiple 24-inch box trees and species, including Queen Palms, Crape Myrtle, Australian Willow, Southern Magnolia, and Desert Museum Palo Verde planted throughout the project site. Trumpet Ivy and Boston Ivy will be planted along perimeter walls to minimize graffiti and enhance the aesthetics of the site. Conditions of approval are proposed to ensure vines are planted along all perimeter walls, that any blank or missing wall segments be constructed and improved, and that a berm be constructed where feasible to screen the drive-through lane from view along Bristol Street. Pursuant to Section 41-365.5 (e) and 41-377.5 (a) of the SAMC, eating establishments with drive-through service require approval of a CUP. The applicant’s request for a CUP to allow drive-through service will provide an added amenity to the property, for the employees who work in the vicinity and for the residents who live in the general area. In addition, the proposed restaurant will generate new and permanent employment opportunities and support the economic growth and stability of the City, activate the street corner, and generate property and sales tax revenue. These impacts are further outlined in the Economic Development Benefits section of this report. Approval of this application would be consistent with the goals of the General Plan, specifically Goals 1 and 2 of the Land Use Element which promotes a balance of land uses to address basic community needs and encourages the location of commercial activities at arterial roadway intersections in commercial districts. In addition, drive- CUP Nos. 2020-24 and 2020-25 – Tacos Gavilan February 8, 2021 Page 5 3 2 6 through will contribute to the long-term viability of the lot in which eating establishment is proposed to be located. Conditional Use Permit for After-Hours Service Pursuant to Section 41-365.5 (f) and 41-377.5 (a) of the SAMC, eating establishments located within 150 feet of properties zoned or used for residential purposes that wish to operate between the hours of 12:00 a.m. and 5:00 a.m. require approval of a CUP. The purpose of regulating after-hours operations is to preserve the surrounding community characteristics and minimize any negative secondary impacts. Staff has reviewed the applicant’s request to operate the restaurant and drive-through window service until 2:00 a.m. on Saturdays and Sundays and has determined that the operations will not be detrimental to the community. The subject site abuts commercial uses to the north and south, Bristol Street and commercial uses to the east, and a multiple-family residential community to the west. This residential community’s nearest building is buffered from the new restaurant and its drive-through lane by almost 150 feet and is separated from the site by an existing eight-foot tall block wall. These factors will help buffer the residential uses from any light, noise, or traffic impacts that the eating establishment may have on the residents. Moreover, the applicant’s request for after-hours operations is limited to 2:00 a.m. on two evenings of the week (Friday/Saturday and Saturday/Sunday). Approval of this application would be consistent with the goals of the General Plan, specifically Goals 2 and 5 of the Land Use Element which promotes land uses that enhance the City’s economic fiscal viability and mitigate any potential impacts to the surrounding community. In addition, the after-hours operations will contribute to the viability of the site creating a business environment that is safe and attractive (Exhibit 2). Police Department Analysis The Police Department reviews conditional use permit applications for after-hours operations in order to ensure that potential crime or nuisance behaviors associated with such a use are mitigated to the greatest extent possible. For after-hours operations, the Police Department analyzes the crime rate in the area by matching the location of the subject site’s census tract to the corresponding Police Grid. The City of Santa Ana contains 102 police reporting grids. The Police Department generates an annual report, the Citywide Incident Ranking report, which ranks these reporting grids based on police activity. The Police Department then compares the number of such crimes in the reporting district as compared to the number of crimes in other reporting districts. In keeping with the standard used by the State Business and Professions Code, should the Police Department determine that the reporting district has a 20 percent greater CUP Nos. 2020-24 and 2020-25 – Tacos Gavilan February 8, 2021 Page 6 3 2 6 number of reported crimes than the average number found in all reporting districts, the Police Department would consider this information in making its recommendation. Police Department Recommendation The Police Department recommended operational standards for the proposed after-hours and drive-through activity to address any potential impacts to the surrounding community and does not oppose the granting of a CUP. The Police Department reviewed Police related activity for the location and the entire block on which the site is located for the last year and found that the subject site has received 24 calls for service, with one rising to the level of a non-criminal report. The majority of the calls for service in the area are attributed to the large commercial center located across Bristol Street to the east. While the activity is nearby, the Police Department does not believe that it should reflect negatively on the proposed restaurant or after-hours drive-through activity. Furthermore, the Police Department contends that the operational standards applicable to after-hours and drive-through activity will mitigate any potential impacts to the surrounding community and therefore does not oppose the granting of the CUPs. Economic Development Benefits The project will generate sales tax revenue, create temporary construction and permanent jobs and will provide additional dining options for the community. In addition, the construction of the project will require that approximately $7,500 in permit fees be paid to the City. Based sales estimates provided, the location will provide additional sales tax revenue of $370,000, including a portion to the City that is estimated to be approximately $10,000 annually. In addition, it is estimated that 200 temporary (construction) and 25 permanent new job opportunities will be created at this specific location. Public Notification and Community Outreach Project notifications were posted, published, and mailed in accordance with City and State regulations. A public notice was posted on the project site on January 28, 2021. Notification by mail was mailed to all property owners and occupants within 500 feet of the project site on January 27, 2021. Lastly, a newspaper posting was published in the Orange County Reporter on January 27, 2021. In addition, vehicle queuing at the driveway is not anticipated to exceed two vehicles, and vehicles queuing in the drive-through lane will have adequate space to queue within the project and will not enter onto Bristol Street. The drive-through operation is also designed to generate minimal noise impacts as the speaker boards are located towards the south of the site and are oriented towards the adjacent commercial use (car wash) and not towards the multiple-family residences to the west. Any potential noise generated from the idling of vehicles or the drive-through speakers is not anticipated to impact the closest residential uses as those residential uses’ nearest structures are approximately 150 feet away to the west and are separate from the subject site by an existing eight-foot tall block wall. This additional distance will further minimize any potential impacts from the restaurant’s drive-through and after-hours operations. Lastly, the drive-through lane is at the south of the property, which produces minimal visual impact to Bristol Street as the new building will be the prominent view from the street. The site design will include multiple 24-inch box trees and species, including Queen Palms, Crape Myrtle, Australian Willow, Southern Magnolia, and Desert Museum Palo Verde planted throughout the project site. In addition, the following conditions of approval shall be met: The Applicant must comply with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The Applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 1. All proposed site improvements must conform to the Site Plan Review (DP No. 2020- 07) and the staff report exhibits. 2. Any amendment to this conditional use permit must be submitted to the Planning Division for review. At that time, staff will determine if administrative relief is available or the conditional use permit must be amended. 3. Prior to the issuance of a Building Permit, the Applicant shall submit a landscape and irrigation plan for the entire site to the Planning Division for review and approval. The landscape and irrigation shall comply with the zoning district's landscape standards, the Water Efficient Landscape Ordinance (WELO), and the Citywide Design Guidelines. The landscape plan shall also include landscape planters along the east and west property line, block wall details, note the application of anti-graffiti coating, date palms instead of queen palms where feasible, and the installation of a berm where feasible to screen the drive-through lane from view from Bristol Street. 4. Prior to the issuance of a Certificate of Occupancy, the Applicant shall construct a minimum eight-foot decorative block wall along the southern property line to close the gap in the existing block walls on site. All walls (new and existing) shall be painted and coated with anti-graffiti coating. Vines must be planted at regular intervals along the base of all walls so as to improve the aesthetics of the wall, minimize blank surfaces, and assist with deterring graffiti. 5. Prior to issuance of a Certificate of Occupancy, the non-conforming pole sign on Bristol Street shall be fully removed, and any missing landscaping replanted in its location unless replaced by another freestanding sign in full accordance with applicable development standards. 6. Prior to the issuance of a Certificate of Occupancy, a Property Maintenance Agreement must be recorded against the property. Ongoing maintenance, repair and upkeep of the property and all improvements located thereupon (including but not limited to controls on the proliferation of trash and debris about and immediately adjacent to the property; the proper and timely removal of graffiti; the timely maintenance, repair and upkeep of damaged, vandalized and/or weathered buildings, structures and/or improvements; the timely maintenance, repair and upkeep of exterior paint, parking striping, lighting and irrigation fixtures, walls and fencing, publicly accessible bathrooms and bathroom fixtures, landscaping and related landscape improvements and the like, as applicable; e. If Developer/Applicant and the owner of the property are different (e.g., if the Applicant is a tenant or licensee of the property or any portion thereof), both the Applicant and the owner of the property shall be signatories to the Maintenance Agreement and both shall be jointly and severally liable for compliance with its terms; f. Moreover, the applicant’s request to only operate the restaurant and drive-through facility until 2:00 a.m. on two nights per week (Friday/Saturday and Saturday/Sunday) will result in minimizing any potential impacts from late-night operations. In addition, the Police Department has determined that although there has been police activity nearby within the last 365-days, it should not reflect negatively on the proposed restaurant or after-hours activity. The Police Department contends that the operational standards applicable to after-hours activity will mitigate any potential impacts to the surrounding community and therefore does not oppose the granting of the conditional use permit. 3. In addition, they shall meet the following conditions of approval: The Applicant must comply with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The Applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 1. All proposed site improvements must conform to the Site Plan Review (DP No. 2020- 07) and the staff report exhibits. 2. Any amendment to this conditional use permit must be submitted to the Planning Division for review. At that time, staff will determine if administrative relief is available or the conditional use permit must be amended. 3. Prior to the issuance of a Building Permit, the Applicant shall submit a landscape and irrigation plan for the entire site to the Planning Division for review and approval. The landscape and irrigation shall comply with the zoning district's landscape standards, the Water Efficient Landscape Ordinance (WELO), and the Citywide Design Guidelines. The landscape plan shall also include landscape planters along the east and west property line, block wall details, note the application of anti-graffiti coating, date palms instead of queen palms where feasible, and the installation of a berm where feasible to screen the drive-through lane from view from Bristol Street. 4. Prior to the issuance of a Certificate of Occupancy, the Applicant shall construct a minimum eight-foot decorative block wall along the southern property line to close the gap in the existing block walls on site. All walls (new and existing) shall be painted and coated with anti-graffiti coating. Vines must be planted at regular intervals along the base of all walls so as to improve the aesthetics of the wall, minimize blank surfaces, and assist with deterring graffiti. 5. Prior to issuance of a Certificate of Occupancy, the non-conforming pole sign on Bristol Street shall be fully removed, and any missing landscaping replanted in its location unless replaced by another freestanding sign in full accordance with applicable development standards. 6. Prior to the issuance of a Certificate of Occupancy, a Property Maintenance Agreement must be recorded against the property. The agreement will be subject to jmf 1/27/21 Resolution No. 2021-XXX Page 7 of 8 review and applicability by the Planning and Building Agency, the Community Development Agency, the Public Works Agency, and the City Attorney to ensure that the property and all improvements located thereupon are properly maintained, Developer/Applicant (and the owner of the property upon which the authorized use and/or authorized improvements are located if different from the Applicant) shall execute a Maintenance Agreement with the City of Santa Ana which shall be recorded against the property and which shall be in a form reasonably satisfactory to the City Attorney. The Maintenance Agreement shall contain covenants, conditions and restrictions relating to the following: a. Compliance with operational conditions applicable during any period(s) of construction or major repair (e.g., proper screening and securing of the construction site; implementation of proper erosion control, dust control and noise mitigation; adherence to approved project phasing etc.), if applicable; b. Compliance with ongoing operational conditions, requirements and restrictions, as applicable (including but not limited to hours of operation, security requirements, the proper storage and disposal of trash and debris, enforcement of the parking management plan, and/or restrictions on certain uses) if applicable; c. Ongoing compliance with approved design and construction parameters, signage parameters and restrictions as well as landscape designs, as applicable; d. Ongoing maintenance, repair and upkeep of the property and all improvements located thereupon (including but not limited to controls on the proliferation of trash and debris about and immediately adjacent to the property; the proper and timely removal of graffiti; the timely maintenance, repair and upkeep of damaged, vandalized and/or weathered buildings, structures and/or improvements; the timely maintenance, repair and upkeep of exterior paint, parking striping, lighting and irrigation fixtures, walls and fencing, publicly accessible bathrooms and bathroom fixtures, landscaping and related landscape improvements and the like, as applicable; e. If Developer/Applicant and the owner of the property are different (e.g., if the Applicant is a tenant or licensee of the property or any portion thereof), both the Applicant and the owner of the property shall be signatories to the Maintenance Agreement and both shall be jointly and severally liable for compliance with its terms; f. At any time that vehicle stacking extends beyond the entrance to the drive through facility, the restaurant shall provide field staff as reasonably required to expedite drive-through operations, assist with onsite parking, and prevent vehicles from blocking onsite parking spaces, drive aisles, the ingress and egress easement onto adjacent properties, and/or queuing onto Bristol Street. 8.
