Project Applicant:Marilyn Warren, representing The Pacific Telephone and Telegraph Company (dba AT&T). Proposed Project:The applicant proposes to construct a front yard fence and gate seven feet in height, exceeding the City’s maximum front yard fence height standard by three feet. The applicant is requesting approval of Minor Exception No. 2021­01 as conditioned to allow the increase in the height of the fence and gate from four feet to seven feet. Pursuant to Santa Ana Municipal Code (SAMC) Section 41-632(3)(i), minor exception applications for fences require consideration by the Zoning Administrator. Staff is recommending approval of the request because the project will have minimal impacts on the surrounding vicinity. The applicant is proposing to install approximately 300 feet of seven-foot high wrought iron fencing, one vehicular sliding gate, and two pedestrian egress gates within the front yard (along the east property line). In addition, the applicant will be adding wrought iron on top of the existing block wall at the southeast end of the property for a total height of seven feet, removing replacing existing concrete steps with a new planter, and infilling an obsolete building door opening with brick. The proposed fence is designed to secure the property, reduce alcoves, and reduce opportunities for trespassing. The wrought iron material will allow visibility into the property as required by the Police Department and Orange County Fire Authority. Site improvements are also proposed to include: revitalizing the existing front yard planters with landscaping and repainting the front of the building (Exhibit 3 to 5). Project Background The project site contains the central communications office building for AT&T, which was constructed in 1961. For the past several years, the project site has encountered graffiti on the buildings, transient encampments, and littering. The site has been the subject of 11 Code Enforcement cases over the past two years. To address the ongoing property and building concerns, the applicant has applied for the subject minor exception to allow the construction of a seven-foot tall fence in the front yard. Project Analysis Pursuant to SAMC 41-610.5(a), front yard fences on commercial and industrial properties are limited to four feet in height in areas that extend into the required front yard or any required landscaped area. The applicant has filed an application to construct a seven-foot high front yard fence at the subject property. Staff has reviewed the applicant’s request and is supportive of the minor exception. The existing site conditions along Bristol Street consist of planters, stairs, and alcoves that have been a target for loitering, encampments, and littering. In order to prevent trespassing and protect the site, the applicant is requesting to exceed the maximum fence height and install the fence at the front property line. A four-foot high fence as required by code, would not deter the ongoing activities of trespassing, littering and graffiti. Proposed site improvements will also enhance the visual appearance of the site’s frontage. Moreover, the project is supported by General Plan Policy 1.4 of the Urban Design Element, which states development design features that prevent loitering, vandalism, graffiti, and visual deprivation Minor Exception No. 2021-01 - The Pacific Telephone and Telegraph Company (dba AT&T) Front Yard Fence July 7, 2021 Page 3 1 8 6 9 are to be included in all projects. This proposed seven-foot high fence will ensure that the site is secure from continued nuisance activities. Staff is supportive of the applicant’s request for the proposed fencing improvements. Recommended conditions of approval include: painting the front of the building along Bristol Street, installing and maintaining new landscaping, and obtaining building permits for the proposed fence and replacing the building door. Public Notification and Community Outreach Project notifications were posted, published, and mailed in accordance with City and State regulations. Copies of the public notice, including a 500-foot notification radius map, and the site posting are provided in Exhibit 6. In addition to these measures, representatives of the Republic Homes Neighborhood Association were contacted to identify any areas of concern due to the proposed request. At the time this report was printed, no issues of concern were raised regarding the proposed minor exception. ENVIRONMENTAL IMPACT Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the project is exempt from further review pursuant to Section 15303 of the CEQA Guidelines (Class 3 – New Construction or Conversion of Small Structures) because the project involves construction of an accessory structure such as a fence. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. There are special circumstances applicable to the subject property where the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the zoning code. The site is approximately 2.9 acres and contains a building used as a telecommunication switching facility, which has unique façade and operational characteristics that are not typical of other commercial uses along Bristol Street. The site is adjacent to railroad tracks and no public access is provided to the facility. A four-foot high fence would not preclude trespassing. The purpose and intent of the fence code requirement is to prevent a “fortress-like” appearance along the street frontage in commercial and industrial areas; however, the size and scale of the proposed fence is compatible with the use and building on site and would allow for visibility into the site. Additionally, site improvements such as landscaping and rehabilitating the building façade will enhance the visual appearance of the site’s frontage. 2. That the granting of a minor exception is necessary for the preservation and enjoyment of one or more substantial property rights. Granting the minor exception is necessary for the preservation and enjoyment of substantial property rights as approval of this minor exception maintains the rights of the property owners to utilize their property without vandalism and vagrancy. Therefore, a seven-foot high fence at the property line is needed to provide adequate security. Further, the view of the building will not be obstructed as it has been designed to maintain visibility into the site as required by the Police Department and Orange County Fire Authority. 3. That the granting of a minor exception will not be materially detrimental to the public welfare or injurious to surrounding property. The granting of this minor exception will not be detrimental to the public or surrounding properties as the proposed front yard (wrought iron) fence will be built to complement the existing building, and will not be located on adjacent properties. In the past year, the subject site has had 11 Code Enforcement cases related to transient encampments, litter and graffiti. Granting the minor exception will secure the site from nuisance activities and improve public welfare and safety. 4. That the granting of a minor exception will not adversely affect the General Plan of the City. The project will not adversely affect the General Plan as the proposed minor exception is consistent with Goal 3.0 of the Urban Design Element, which is to create and maintain a pleasant travel experience and strong orientation to the community through coordinated on-site and streetscape design. In conjunction with the proposed fence, the building façade will be painted and new landscaping will be installed to meet the requirements of the M1 Light Industrial zoning district and enhance the street frontage. Policy 1.4 of the Urban Design Element states development and other design features that prevent loitering, vandalism, graffiti, and Resolution No. 2021-XXX Page 3 of 7 visual deprivation are to be included in all projects. The proposed seven-foot high fence and additional site improvements will ensure that the site is secure, and prevent graffiti and vagrancy. E. This project was reviewed in accordance with the Guidelines for the California Environmental Quality Act (CEQA). The project is exempt from further review pursuant to CEQA Guidelines Section 15303, which pertains to New Construction or Conversion of Small Structures. This Class 3 exemption applies to accessory (appurtenant) structures, including fences. Based on this criteria and staff analysis, Categorical Exemption Environmental Review No. 2021-69 will be filed for this project. Section 2. Within 60 days of the approval of Minor Exception No. 2021-01 the applicant shall apply for a building permit, as deemed necessary by the Building & Safety Division and the California Building Code requirements for the following improvements. In addition, the following improvements shall be installed or completed within 180 days of building permit issuance for: a. The proposed seven-foot high wrought iron fence along Bristol Street. b. Removal of the obsolete building door and replacement with brick. c. Remove and replace the existing chain link fence with slats between the north end of the building and the north property line and replace it with a new fence. d. Repaint the front of the building along Bristol Street including the six pane storefront window or remove and replace the storefront windows. 4. Prior to issuance of a Building Permit for the proposed fence, the applicant shall submit a landscape plan to the Planning Division for review and approval. Plans shall comply with the City’s Water Efficient Landscape Ordinance (WELO) and Guidelines, if applicable and M1 Light Industrial front yard landscape standards. The agreement will be subject to review and applicability by the Planning and Building Agency, the Community Development Agency, the Public Works Agency, and the City Attorney to ensure that the property and all improvements located thereupon are properly maintained, Applicant (and the owner of the property upon which the authorized use and/or authorized improvements are located if different from the Applicant) shall execute a Maintenance Agreement with the City of Santa Ana which shall be recorded against the property and which shall be in a form reasonably satisfactory to the City Attorney. The Maintenance Agreement shall contain covenants, conditions and restrictions relating to the following: (a) Compliance with operational conditions applicable during any period(s) of construction or major repair (e.g., proper screening and securing of the construction site; implementation of proper erosion control, dust control and noise mitigation measure; adherence to approved project phasing etc.); (b) Compliance with ongoing operational conditions, requirements and restrictions, as applicable (including but not limited to hours of operation, security requirements, the proper storage and disposal of trash and debris, enforcement of the parking management plan, and/or restrictions on certain uses); (c) Ongoing compliance with approved design and construction parameters, signage parameters and restrictions as well as landscape designs, as applicable; (d) Ongoing maintenance, repair and upkeep of the property and all improvements located thereupon (including but not limited to controls on the proliferation of trash and debris about the property; the proper and timely removal of graffiti; the timely maintenance, repair and upkeep of damaged, vandalized and/or weathered buildings, structures and/or improvements; the timely maintenance, repair and upkeep of exterior paint, parking striping, lighting and irrigation fixtures, walls and fencing, publicly accessible bathrooms and bathroom fixtures, landscaping and related landscape improvements and the like, as applicable); (e) If Applicant and the owner of the property are different (e.g., if the Applicant is a tenant or licensee of the property or any portion thereof), both the Applicant and the owner of the property shall be signatories to the Maintenance Agreement and both shall be jointly and severally liable for compliance with its terms. (g) The Maintenance Agreement shall contain provisions relating to the enforcement of its conditions by the City and shall also contain provisions authorizing the City to recover costs and expenses which the City may incur arising out of any enforcement and/or remediation efforts which the City may undertake in order to cure any deficiency in maintenance, repair or upkeep or to enforce any restrictions or conditions upon the use of the property. EXECUTIVE SUMMARY Michel Girgis, representing the Archangel Michael Coptic Orthodox Church, is requesting approval of Minor Exception No. 2021-03 to allow the construction of a seven-foot high front yard fence at 4405 West Edinger Avenue. Pursuant to Santa Ana Municipal Code (SAMC) Section 41-632(3)(i), minor exception applications for fences require review by the Zoning Administrator. Staff is recommending approval of the request due to recent burglary and vandalism incidents, the decorative design of the fence, and the landscaped yard that will remain in place. The applicant is proposing to install a seven-foot high decorative wrought iron fence within the front yard. The fence will be constructed in front of the church building adjacent to an existing on site walkway and will span approximately 115 feet in length. The wrought iron fence is designed to include arches with a circle and cross at the center of every 10-foot segment and will be painted beige. Approximately, eight (8) to 25 feet of front yard landscaping including palm trees, a row of shrubs, and grass turf will remain in place along Edinger Avenue in front of the fence (Exhibit 3 to 5). Project Background The Archangel Michael Coptic Orthodox Church was constructed in 1990 and Conditional Use Permit No. 88-11, governs the church use. In 2020, there were two burglary and two vandalism incidents, which were documented by the Santa Ana Police Department. These crime incidents and the physical site conditions were reviewed by Santa Ana Police Department, Orange County Sheriff’s, Department Orange County Intelligence Assessment Center, and United States Department of Homeland Security, all of which recommended the installation of a seven (7) foot high fence in the front yard to secure the church property (Exhibit 6). In addition, the church has received a federal security grant to fund the construction of the fence. As such, the applicant has applied for a minor exception. Project Analysis Pursuant to SAMC 41-610(a)(1), front yard fences on residentially zoned properties along arterial streets such as Edinger Avenue are limited to four feet in height. The applicant has filed an application to construct a seven-foot high (maximum height) front yard fence at the subject property. Staff has reviewed the applicant’s request and is supportive of the minor exception. The purpose of the proposed fence is to prevent trespassing, reduce vandalism and burglary incidents, and provide controlled access points by channeling individuals to authorized entry points. Due to the religious use on the site, the applicant may be at risk of targeted crime. In addition, the church has floor to ceiling windows along Edinger Avenue that if broken allow for direct access into the church. The two burglary incidents involved individuals stealing from offering boxes within the church and the vandalism incidents resulted in several broken Minor Exception No. 2021-03 – Archangel Michael Coptic Orthodox Church Front Yard Fence July 7, 2021 Page 3 1 8 7 1 windows and doors along Edinger Avenue. The church has incurred thousands of dollars in expenses to replace the broken windows and doors. Therefore, to provide a secure environment for church staff, volunteers, church members and visitors, the applicant is requesting to install a fence to secure the project site. Moreover, the project is consistent with the General Plan Goal 2.0 of the Urban Design Element, which states that new development should be proportionally and aesthetically related to its district setting. Additionally, Goal 2.7 of the Urban Design Element states that projects must exhibit a functional, comfortable scale in relation to the neighborhood. This proposed seven-foot tall fence is in scale with existing fencing and structures in the project site’s vicinity, including the immediately adjacent property to the west that has a concrete block wall over four-feet in height at the property line. Staff is supportive of the applicant’s request for the proposed fencing improvements. Public Notification and Community Outreach Project notifications were posted, published, and mailed in accordance with City and State regulations. Copies of the public notice, including a 500-foot notification radius map, and the site posting are provided in Exhibit 7. In addition to these measures, representatives of the Riverview West and Riverview Neighborhood Association were contacted to identify any areas of concern due to the proposed request. At the time this report was printed, no issues of concern were raised regarding the proposed minor exception. ENVIRONMENTAL IMPACT Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the project is exempt from further review pursuant to Section 15303 of the CEQA Guidelines (Class 3 – New Construction or Conversion of Small Structures) because the project involves construction of an accessory structure such as a fence. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. There are special circumstances applicable to the subject property related to the location and surroundings. The church is located along Edinger Avenue, a major arterial street. The front of the church building has several glass floor to ceiling window and doors which allow for direct access into the church, if broken. Vehicles are able to park along Edinger Avenue which provides easy access to and from the site. In a recent burglary incident, surveillance footage shows the suspect parking along the south side of Edinger Avenue, entering the building and fleeing from the building to their vehicle for a quick getaway. Additionally, in recently documented burglary and Resolution No. 2021-XXX Page 2 of 7 vandalism incidents suspects are seen standing on the property along Edinger Avenue and throwing rocks at the windows and doors. Furthermore, the intent of the fence height regulations is to reduce the fortress like appearance that walls and fences can create. However, there are several other properties along Edinger Avenue between Harbor Boulevard and Newhope Street, including the property directly to the west that have a fence over four feet in height on the property line. Landscaping will also be maintained in front of the proposed fence to soften the height in the front yard. Therefore, the fence will not be out of character or scale with the surrounding properties. 2. That the granting of a minor exception is necessary for the preservation and enjoyment of one or more substantial property rights. Granting the minor exception is necessary for the preservation and enjoyment of substantial property rights as approval of this minor exception maintains the rights of the property owner and church members to safely and freely utilize the property. Recently, the property has experienced burglary and vandalism incidents and the Santa Ana Police Department, Orange County Sheriff’s Department Orange County Intelligence Assessment Center, and United States Department of Homeland Security all recommended the installation of a seven-foot high fence in the front yard to secure the church property. The view of the church building will not be obstructed as the fence has been designed to maintain visibility into the site as required by the Police Department and Orange County Fire Authority. 3. That the granting of a minor exception will not be materially detrimental to the public welfare or injurious to surrounding property. The granting of this minor exception will not be detrimental to the public or surrounding properties. The church owns the two residential properties to the east and the residential properties to the west have a concrete masonry wall at the property line. In addition, the decorative design of the fence will complement the church building. 4. That the granting of a minor exception will not adversely affect the General Plan of the City. The project is consistent with the General Plan as the proposed minor exception is consistent with Goal 2.0 of the Urban Design Element, which states that new development should be proportionally and aesthetically related to its district setting. Specifically, Goal 2.7 of the Urban Design Element states that projects must exhibit a functional, comfortable scale in relation to the neighborhood. This proposed seven-foot high fence is in scale with existing fencing and Resolution No. 2021-XXX Page 3 of 7 structures in the project site’s vicinity. Landscaping will be maintained in front of the fence to soften the height and appearance in the front yard. E. This project was reviewed in accordance with the Guidelines for the California Environmental Quality Act (CEQA). The project is exempt from further review pursuant to CEQA Guidelines Section 15303, which pertains to New Construction or Conversion of Small Structures. This Class 3 exemption applies to accessory (appurtenant) structures, including fences. Based on this criteria and staff analysis, Categorical Exemption Environmental Review No. 2021-70 will be filed for this project. Section 2. The Applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this minor exception. The Applicant must remain in compliance with all conditions listed below throughout the life of the minor exception. Failure to comply with each and every condition may result in the revocation of the minor exception. A. Planning Division 1. All proposed site improvements must conform to the plan attached to this minor exception, except as modified in the conditions of approval. 2. Any amendment to this minor exception must be submitted to the Planning Division for review. At that time, staff will determine if administrative relief is available or if the minor exception must be amended. 3. The proposed fence shall be painted beige to match the existing wrought iron fence on the property. The fence shall be maintained in good condition. 4. The applicant shall obtain a building permit as necessary for the proposed seven-foot high fence. 5. Prior to the final inspection of the proposed fence the broken windows and doors along the south building elevations shall be repaired or replaced and all boards shall be removed from the property. 6. Should the existing shrubs be removed due to the installation of the proposed fence, replacement shrubs (i.e. Bougainvillea, succulents) shall be planted per Santa Ana Municipal Code requirements. 7. Prior to issuance of a building permit, a Property Maintenance Agreement must be recorded against the property. The agreement will be subject to review and applicability by the Planning and Building Agency, the Community Development Agency, the Public Works Agency, and the City Attorney to ensure that the property and all improvements located thereupon are properly maintained, Applicant (and the owner of the property upon which the authorized use and/or authorized improvements are located if different from the Applicant) shall execute a Maintenance Resolution No. 2021-XXX Page 6 of 7 Agreement with the City of Santa Ana which shall be recorded against the property and which shall be in a form reasonably satisfactory to the City Attorney. The Maintenance Agreement shall contain covenants, conditions and restrictions relating to the following: (a) Compliance with operational conditions applicable during any period(s) of construction or major repair (e.g., proper screening and securing of the construction site; implementation of proper erosion control, dust control and noise mitigation measure; adherence to approved project phasing etc.); (b) Compliance with ongoing operational conditions, requirements and restrictions, as applicable (including but not limited to hours of operation, security requirements, the proper storage and disposal of trash and debris, enforcement of the parking management plan, and/or restrictions on certain uses, (c) Ongoing compliance with approved design and construction parameters, signage parameters and restrictions as well as landscape designs, as applicable; (d) Ongoing maintenance, repair and upkeep of the property and all improvements located thereupon (including but not limited to controls on the proliferation of trash and debris about the property; the proper and timely removal of graffiti; the timely maintenance, repair and upkeep of damaged, vandalized and/or weathered buildings, structures and/or improvements; the timely maintenance, repair and upkeep of exterior paint, parking striping, lighting and irrigation fixtures, walls and fencing, publicly accessible bathrooms and bathroom fixtures, landscaping and related landscape improvements and the like, as applicable); (e) If Applicant and the owner of the property are different (e.g., if the Applicant is a tenant or licensee of the property or any portion thereof), both the Applicant and the owner of the property shall be signatories to the Maintenance Agreement and both shall be jointly and severally liable for compliance with its terms. (f) The Maintenance Agreement shall further provide that any party responsible for complying with its terms shall not assign its ownership interest in the property or any interest in any lease, sublease, license or sublicense, unless the prospective assignee agrees in writing to assume all of the duties, obligations and responsibilities set forth under the Maintenance Agreement. (g) The Maintenance Agreement shall contain provisions relating to the enforcement of its conditions by the City and shall also contain provisions authorizing the City to recover costs and expenses which the City may Resolution No. 2021-XXX Page 7 of 7 incur arising out of any enforcement and/or remediation efforts which the City may undertake in order to cure any deficiency in maintenance, repair or upkeep or to enforce any restrictions or conditions upon the use of the property. The maintenance agreement shall further provide that any unreimbursed costs and/or expenses incurred by the City to cure a deficiency in maintenance or to enforce use restrictions shall become a lien upon the property in an amount equivalent to the actual costs and/or expense incurred by the City.
