Fergoso (now retired). Task 8, Project Management and Coordination is the only task modified for this submittal. This task now reflects an extended project schedule and an additional four conference calls (please see scope of,work for this task, and discussion under Schedule). The additional cost for this task is reflected in the updated cost table, There are no other changes to this proposal which describes our proposed approach, scope; cost estimate and preliminary timellne for preparation of a Recirculated PEIR for the Santa Ana General Plan Update (GPU). Forclarity, we have prepared this as a separate contractfrom ourservice agreement for the preparation of technical studies for the GPU and preparation/processing of the original GPU PEIR. Our last submittal to you dated November 12, 2020 details our request to transfer the contingency budget on that agreement which would allow us to close-out that effort. BACKGROUND PlaceWorks Iona full consultant tears to prepare technical studies to support the City's preparation of the GPU Update and to prepare and process the Programmatic EIR for the update. Following are the CEQA milestones reflecting the process to date: » Notice of Preparation —Circulated for 30 days, February 26, 2020 to September 16, 2020 » ScopingMeeting—March 5,2020 » Draft PEIR Circulation-45 days August 3, 2020 to September 16, 2020 » Extended public review Draft PEIR-20 days, to October 6, 2020 » Final EIR Preparation —August 3, 2020 to November6, 2020 » Public Hearings --------- • Planning Commission Study Sessions —August 24, 2020 and September 14, 2020 • Planning Commission Public Hearing— November 9, 20W Comments received in writing and during the public workshop and Planning Commission hearing focused on some key Issues. Opposition included comments on specific components of the GPU, primarily the scale and density of future development that would be accommodated and the lack of adequate park/recreatlon space. At the November 9, 2020, the Planning Commission extended their project review and recommendation to a date uncertain. City staff has decided to prepare and distribute a Recirculated PEIR for public review CONDITIONS TO RECIRCULATE PEIR State CEQA Guidelines section 15088.5 defines the circumstances under which a lead agency must recirculate an EIR. A lead agency is required to recirculate an EIR when significant new information is added to the EIR after public notice is given of the availability of the Draft EIR but before certification of the Final EIR. Such information can include changes In the project or environmental setting as well as additional data or other Information. New information added to an EIR Is not considered "significant" unless the EIR is changed In a way that deprives the public of a meaningful opportunity to comment upon a substantial adverse environmental effect of the project or a feasible way to mitigate or avoid such an effect (Including a feasible project alternative) that the project's proponents have declined to implement. As defined in. State CEQA Guidelines section 15088.5(a), significant new Information requiring recirculation is that which shows any of the following: •1. A new significant environmental Impact would result from the project or from a new mitigation measure proposed to be Implemented. 'L. A substantial increase in theseverity of an environmental impact would result unless mitigation measures are adopted that reduce the Impact to a level of insignificance. 3. A feasible project alternative or mitigation measure considerably different from others previously analyzed would clearly lessen the environmental imparts of the project, but the project's proponents decline to adopt it. 4. The draft EIR was so fundamentally and basically inadequate and conclusory in nature that meaningful public review and comment were precluded, OPTIONS FOR RECIRCULATION Pursuant to CEQA Guidelines Section 15088.5, if the required revision Is limited to a few chapters or portions of the EIR, the lead agency need only recirculate the chapters or portions that have been modified, A Recirculated EIR .requires the same noticing and consultation as the original Draft EIR (CEQA Guidelines Sections 15086 and 15087). CEQA allows two different ways to respond to comments on the Recirculated Draft EIR: 1) When an EIR Is substantially revised and the entire document is recirculated, the lead agency may require reviewers to submit new comments and, in such cases, need not respond to those comments received during the earlier circulation period, or; 2) When the EIR Is only revised part and the lead agency Is recirculated only the revised chapter or portions of the EIR, the lead agency may request that reviewers limit their comment to the revised chapters or portions of the recirculated EIR. the lead agency need only respond to (i) comments received during the Initial circulation period that relate to chapters or portions of the document that were not revised and recirculated, and (ii) comments received during the January 28, 20211 Page 2 recirculation period that relate to the chapter of the earlier EIT that were revised and recirculated. APPROACH The scope of work Included in this proposal assumes that the City will only recirculate limited chapters of the EIR that require updating. The advantage of only recirculating some chapters, Is that new comments are limited to only those chapters. We propose revising and recirculating the following EIR chapters: » Executive Summary » Project Description » Air Quality » Hazards » Recreation » Alternatives As we have discussed with the City, we anticipated that Recreation/Open Space would be determined to be a significant impact under the recirculated Draft PEIR. This new Impact will likely merit new mitigation measures and/or a new project alternative to focused on reducing impacts to recreation. This approach would not allow any new comments on the following chapters which would not be recirculated: rr Aesthetics » Biological Resources » Cultural Resources a Energy » Geotechnlcal » GI-IG » Hydrology/WaterQuality » Mineral » Noise » Public Services » utilities A complete, updated PEIR. would be prepared integrating the revisions detailed In Chapter 3, Revisions to the Draft PEIR of the original Final FIR, and also reflecting any updated General Plan Policies and Implementation Actions. The publicwould be clearly directed to only comment on the updated chapters as listed above. An updated Final EIR would include the responses In the original FEIR and responses to new comments received on the recirculated chapters. January 28, 20211 Page 3 SCOPE OF WORK TASK 1. CONSULTATION CONCERNING RECIRCULATED DRAFT PEIR In accordance with the CEQA Guidelines, a Recirculated Draft EIR is subject to the consultation requirements of Section 15086. PlaceWorks will coordinate with City staff to determine the consultation procedure preferred. This task assumes that PlaceWorks will draft correspondence to notify responsible agencies that the City is preparing a Recirculated Draft PEIR that includes information on the contents proposed (list of chapters). Per Section 15086, the lead agency may also consult with any member of the public that has filed a request for notice and any person that may be concerned with the environmental effects of the project. At this time, It is anticipated that the expanded community outreach process will achieve this objective. TASK 2. PREPARE SCREENCHECK DRAFT RECIRCULATED PEIR As described under recommended approach, the Recirculated PEIR will consist only of those chapters that need to be updated and recirculated. Following is a brief description of the content anticipated for the chapters that will be recirculated; Executive Summary. this section will be updated to reflect the changes in the other recirculated chapters as well as the revisions to the Draft PEIR (mostly updated policies and Implementation actions) that are included in the Final EIR already prepared. The. Executive Summary table will reflect updates to Impacts, mitigation measures and significance concluslons. Project Description, this section will be updated to integrate the changes and refinements to the GPU slnce the original project description. Land use changes are not anticipated at this time. Changes will Includes updates policies and implementation actions, as well as corrections to existing and proposed land use statistics as Included In the Final EIR. This section will also Include the Mobility Element changes as Included in the Final EIR. Air Quality. this section will be supplemented to provide Information on environmental justice and health risk. It will also include updated policies and Implementation actions. It will not include an update to the technical study or modeling for the proposed GPU. Hazards and Hazardous Materials, slm ilar to the air q ua Ilty section, the updated hazards section will provide additional context for environmental justice -related Issues, and information regarding potential lead hazards as identified In comments received on the Draft PEIR. It will also provided updated GPU policies and implementation actions. Recreation. the updated Recreation section will provide a more detailed geographic description of open space/recreation facilities for both existing and proposed conditions under Implementation of the GPU and comparison of these conditions with applicable standards (e.g. park space acres/capita). It will include GPU policies and Implementation actions added subsequent to the Draft PEIR and Included in the Final EIR as well as any refinements that may evolve as part of extended community outreach and participation. It is anticipated that -_-- - — — — - Recreation will be determined to be a significant impact. Alternatives. this section will be supplemented to include at 1-2 additional project alternatives. It is expected that one alternative will be defined in consultation with the City to address the significant recreation impact. A lower density alternative may also be considered If desired by the City. January 28, 20211 Page 4 Other Draft PEIR Chapters. It Is assumed that the City will want a complete, updated copy of the Draft PEIR. Remaining chapters (those not detailed above for recirculation) will be updated to reflect the changes documented In Chapter 3, Revisions to the PraftEIR of the Final PEIR. The Screencheck Draft Recirculated PEIR will be submitted to the City for review. It is anticipated that only electronic copies will be required. TASK 3. PREPARE DRAFT RECIRCULATED PEIR PlaceWorks will review the Recirculated PER upon receipt of City review comments. Ourscope of work assumes that only one Iteration of revlew/revislons will be required. Upon approval PlaceWorks will prepare the public draft for distribution and for posting on the City's website TASK 4. NOTICE OF AVAILABILITY/PUBLIC REVIEW The Recirculated Draft PEIR Is subject to the same noticing and public review requirements as the original Draft PEIR. PlaceWorks will prepare the Notice of Availability and Notice of Completion and distribute the Recirculated PEIR to the same mailing list (as supplemented by commenters on the Draft PEIR) as the original EIR. The Draft Recirculated PEIR will be circulated for 45-days. We will coordinate with the City to electronically file the EIR with OFF. TASK S. FINAL EIR— RESPONSE TO COMMENTS The Final EIR will consist of the updated Draft PEIR (combined original Draft EIR and Draft Recirculated PEIR), the Response to Comments (updated as needed) from the original Draft PEIR, the Response to Comments to new comments received on recirculated chapters, and any revisions to the Draft Recirculated PEIR required to respond to the new set of comments. our cost estimate Is based on a moderate level of comment. If a greater level of comment than anticipated is received, a budget augment may be required. TASK 6 MMRP, FACTS AND FINDINGS & STATEMENT OF OVERRIDING CONSIDERATIONS PlaceWorks will update the MMRP, Facts and Findings and Statement of Overriding Considerations to reflect the Final El R. TASK 7. PUBLIC HEARINGS Our scope of work assumes our attendance at up to three public hearings, At this time, it is assumed these meetings will be held virtually. TASK 8. PROJECT MANAGEMENT & COORDINATION This task includes ongoing project managements and coordination with the City. For cost estimating purposes we have assumed the schedule as summarized In the next section, and participation in up to 12 conference call/Zoom -- -- --- meetings (8 conference calls were assumed in our previous submittal). Our cost estimate, as in the previous submittal, is based on an estimated 2 hours/week of our Project Manager's time for project management/coordination, January 28, 20211 page 5 SUBCQNSULTANT - IBI We have Included hours for IBI to assist with the followingtasks as needed: Project Description. Provide assistance with updates to Mobility Element, If required beyond those reflected in the Final EIR prepared for Planning Commission (including MPAH). Project Alternatives. Provide estimated trafficvolumes if alternative is selected that modifies land uses. This would be required to evaluate potential change In significance of traffic noise Impacts. Public Hearing Attendance. Attendance at up to 3 public hearings (or workshops). SCHEDULE PlaceWorks will initlate preparation of the Recirculated Draft PEIR upon notice to proceed from the City. This updated submittal reflects the General Plan Draft Timeline excel schedule forwarded to us by the City on January 27, 2021. Based on this schedule, public outreach will extend through May 2021, and a Draft Revised General Plan will be available Forpubllcrevlewattheend ofJune 2021, TheScreencheck Recirculated EIR will be Initiated by March 2021, and the Draft Recirculated EIR is projected to be released for public review byJuiy 2021. Public Hearings, preceded by Study Sessions in October/November 2021, are projected in December 2021/January 2022. (a) With respect to any claim made or "suit" brought outside the United States of America, the territories and possessions of the United States of America, Puerto Rico and Canada: (1) You must arrange to defend the "in- sured" against, and investigate or set- tle any such claim or "suit" and keep us advised of all proceedings and ac- tions. (h) Neither you nor any other involved "insured" will make any settlement without our consent. (iii) We may, at our discretion, participate in defending the "insured" against, or in the settlement of, any Bairn or "suit". (iv) We will reimburse the "insured" for sums that the "insured" legally must pay as damages because of "bodily injury" or "property damage" to which this insurance applies, that the "in- sured" pays with our consent, but only up to the limit described in Para- graph C., Limits Of Insurance, of SECTION II - COVERED AUTOS LIABILITY COVERAGE. Our duty to make such payments ends when we have used up the applicable limit of insurance in payments for damages, settlements or defense expenses. (b) This insurance is excess over any valid and collectible other insurance available to the "insured" whether primary, excess, contingent or on any other basis. (c) This insurance is not a substitute for re- quired or compulsory insurance in any country outside the United States, its ter- ritories and possessions, Puerto Rico and Canada. WAIVER OF DEDUCTIBLE - GLASS The following is added to Paragraph D., Deducti- ble, of SECTION III - PHYSICAL DAMAGE COVERAGE: No deductible for a covered "auto" will apply to glass damage if the glass is repaired rather than replaced. This coverage applies only in the event of a total theft of your covered "auto". No deductibles apply to this Personal Property coverage. K. AIRBAGS The following is added to Paragraph 8.3., Exclu- sions, of SECTION Ill - PHYSICAL DAMAGE COVERAGE: Exclusion 3.a. does not apply to "loss" to one or more airbags in a covered "auto" you own that in- flate due to a cause other than a cause of "loss" set forth in Paragraphs A.1.b. and A.1.c., but only: a. If that "auto" is a covered "auto" for Compre- hensive Coverage under this policy; b. The airbags are not covered under any war- ranty; and c. The airbags were not intentionally inflated. We will pay up to a maximum of $1,000 for any one "loss". L NOTICE AND KNOWLEDGE OF ACCIDENT OR LOSS The following is added to Paragraph A.2.a., of SECTION IV- BUSINESS AUTO CONDITIONS: Your duty to give us or our authorized representa- tive prompt notice of the "accident" or "loss" ap- plies only when the "accident" or "loss" is known to: (a) You (if you are an individual); (b) A partner (if you are a partnership): (c) A member (if you are a limited liability com- pany); (d) An executive officer, director or insurance manager (if you are a corporation or other or- ganization); or (e) Any "employee" authorized by you to give no- tice of the "accident" or "loss".
