Summary (714) 492-9779 The City of Santa Ana Planning Commission, and the City of Santa Ana City Council, have done an outstanding job in researching and establishing regulations for the development of Accessory Dwelling Unit construction in this municipality. Careful thought and preparation ---complying with State of California laws on Accessory Dwelling Units (A.D.U.) and Junior Accessory Dwelling Units ---have, so far, been beneficial for both private homeowners, and the City at large. Minor -but Serious -Errors Accessory Dwelling Units ---that are detached from the primary residence ---may be of two-story, if the primary residence is two -stories in height. The maximum height, of a two-story residence, is 35 feet. That is the maximum height whether it is a brand-new residence to be built, or, a two- story room addition, where the new addition is the second story. No problem here, so far. However, City of Santa Ana Municipal Code Table 41-194.3 "Maximum Height" states that the "detached" A.D.U. cannot be higher than sixteen feet. That is the serious error, and is unfair --- even harmful ---to the homeowner who has a two-story single-family residence, no higher than thirty -five -feet; has a detached two -vehicle garage of which an A.D.U. can be built on top of the structure; and ---has limited back yard space that should not be taken up with a "wide" A.D.U. Sixteen feet high, maximum. So: eight -feet -high (existing) for the garage; approximately twelve -inches depth (high) for floor joists, floor sheathing, and ceiling drywall; plus eight more feet, in height, for second story. That's 17 feet, right there. What about the roof? What if the roof is pitched, gabled, or a hip roof? No account was taken of roof height. Recommended Change I'm asking that the City of Santa Ana revise their Section 41-194.3 Development Standards and change "Maximum Height," for "Detached" second -story A.D.U. to match height of existing two-story single-family residence, and not exceed that height. (F) An ADU shall only be sold or otherwise conveyed separately from the primary building on the site if the primary building and the ADU were built or developed by a qualified non-profit corporation in accordance with Government Code Section 65852.26, as amended from time to time, and an affordable housing agreement is entered into by the applicant and the city. Sec. 41-194.3. Development Standards. The development standards in Table 41-194.3 shall be applicable to all accessory dwelling units and junior accessory dwelling units. Additional provisions related to accessory dwelling units and junior accessory dwelling units are referenced in the "Additional Provisions" column of the table. Such provisions may include references to other applicable code sections or limitations.
