AMENDMENT NO. 1 TO LANDSCAPE MAINTENANCE AGREEMENT
WITHIN ST TE HIGHWAY RIGHT OF WAY ON 1-5 WITHIN THE CITY OF
SANTA ANA
This AMENDMENT NO. 1 to the I-5 Landscape Maintenance Agreement identified
o below as "AMENDMENT", is effective on September, 2022, and is entered into
by and between the State of California, acting by and through the Department
of Transportation, hereinafter referred to as "STATE", and the City of Santa Ana,
a municipal corporation, hereinafter referred to as "CITY", acting by and through its
Public Works Director. CITY and STATE together are hereafter referred to as "PARTIES".
RECITALS:
PARTIES, entered into an agreement on February 4, 2020, entitled "LANDSCAPE
MAINTENANCE AGREEMENT WITHIN STATE HIGHWAY RIGHT OF WAY ON
ROUTE 5 WITHIN THE CITY OF SANTA ANA" N-2020-034 hereafter
referred to as "AGREEMENT". AGREEMENT defined the terms and conditions
applicable to CITY's maintenance duties at the various areas within STATE right of
way, as shown in Exhibit "A" of AGREEMENT.
2. AGREEMENT by its terms provides that it may be modified or amended at any time upon
mutual consent of the PARTIES.
3. The purpose of this AMENDMENT is to assign and expand the maintenance of the
artwork attached to fencing and landscaping in Caltrans lot at the northeast quadrant of
First Street and Mabury Street; landscaping at the southeast quadrant of First Street and
1-5 southbound onramp; architectural veneer treatment on structure 12-10165;
abutment mural on highway structure 55-0643G; lighting system for abutment mural;
and abutment sidewall artwork on structure 55-0684K hereinafter referred to as
"Work Program Lot and Mainline Aesthetic Improvements".
4 Work Program Lot and Mainline Aesthetic Improvements have been installed or will be
installed at locations noted in item 3 above.
5. PARTIES desire to amend AGREEMENT as provided herein.
IT IS THEREFORE MUTUALLY AGREED;
6. EXHIBIT A of the AGREEMENT, is hereby amended to include EXHIBIT A-1,
EXHIBIT A-2, and EXHIBIT A-3, attached hereto and incorporated herein by this
reference;
7. All other terms and conditions of AGREEMENT shall remain in full force and effect.
8. AMENDMENT is hereby deemed to be included and made a part of AGREEMENT.
