CWA provides employment opportunities for local residents to gain access to skilled jobs that pay prevailing wages. When a local resident is employed in their community, they are able to reinvest in their local economy and decrease traffic congestion on highways, thus, leading to an improved quality of life. For these reasons above, I encourage the support of the Building Trades renewed recommended Agreement. A genuine partnership with local labor organizations is fundamental to building a more robust economy and training the next generation of skilled Santa Ana workers. Employment opportunities in the construction trades are a vital pathway to middle-class stability for residents. This Agreement will provide access to work opportunities for students from Santa Ana's College Continuing Adult Education Apprenticeship Readiness Program at the Remington Center and Century High School with City projects as they enter the Joint Labor Management Training Programs operated by the Building Trades. CA state law already requires the payment of prevailing wages for public works projects. However, the systemic violation of these labor policies gives unscrupulous contractors an advantage in bidding for contracts. This CWA will help to ensure that existing labor laws, standards, and practices are implemented by all city contractors on a level playing field. Thank you for your consideration. We are requesting that you reject their proposed draft and amend with our proposed language in the chart below. Attached are both draft agreements (City Staff and Building Trades)for your comparison. I am also attaching the letter that City Manager Ridge sent whereas she is unilaterally submitting the City's draft Community Workforce Agreement(CWA)dated 4/21. This letter was the response we received after we replied to the City's proposal. In the many years of our experience, it has been usual and customary for City staff to present a mutually agreed upon document instead of unilateral imposing it. As you can see it is standard to have thresholds for Prime Multi Trade threshold amounts. They vary anywhere between $125,000.00 to $750,000.00 The chart below reflects that this is within the general range that we propose in all of our Agreements. The City's staff's outrageous. ro osal of$2.5 million and $1 million shall limit significantly the number of hours that can be worked by local residents and veterans. For your reference,the dollar thresholds in the expired City of Santa Ana Agreement were: Prime Multi Trade -$250K Prime Specialty Trade - $100K The current Union proposal dollar thresholds for the City of Santa Ana are: Multi Trade=$750K Prime Specialty Trade= $100K We also reject the language that annually adjusts for inflation by the California Construction Cost Index(CCCI). None of our Agreements have that and it isn't necessary. We are respectfully requesting that the City Council replace the City Staff language paragraph that is in the right column below with the Union Proposal on the left.The red font text is the language that we are requesting to be replaced. Our Affiliated Trade Local Unions have informed us that that they cannot sign the City's proposed Agreement. Since then, the City Staff and LA/OC BCTC have engaged in multiple rounds of proposal exchanges and productive meetings. On April 21, 2023, City Staff transmitted to LA/OC BCTC a final Community Workforce Agreement. At the June 6, 2023 City Council Meeting, the Public Works Agency will be presenting the agreement that was transmitted to you on April 21, 2023, for consideration and approval. You are more than welcome to obtain the required document signatures prior to the Council meeting. If you are able, please transmit the countersigned agreement to the City prior to the agenda publishing date, and we will replace the agreement with the countersigned version in the staff report to Council.
