EDWARD R. DANOFF'S OPPOSITION TO ANY ABATEMENT ASSESSMENT &
REQUEST FOR AN ACCOUNTING OF ITEMS REMOVED FROM THE ABOVE
REFERENCED PROPERTY AND AN ITEMIZATION OF THE ALLEGED
$17,116.27 INCURRED IN COSTS
Dear Mayor and City Council Members,
I, Edward R. Danoff, oppose the imposition of an assessment for any uncollected costs
allegedly incurred by the City of Santa Ana for the alleged "Abatement of Dangerous and
Abandoned Building Program" at AP# 398-523-07, 1323 North Broadway.
Please be advised that no one ever removed any property and/or abated any alleged
nuisance at AP# 398-523-07, 1323 North Broadway. I am hereby requesting an inventory and
accounting of any and all items allegedly removed from 1323 North Broadway along with any and
all photos of the items removed on the day(s) in question.
I am further requesting an itemized accounting of the $17,116.27 assessment the City of
Santa Ana is claiming they allegedly incurred in costs for the removal or abatement of an alleged
nuisance at AP# 398-523-07, 1323 North Broadway.
Not finding any violations at AP# 398-523-07, 1323 North Broadway, the City personnel
then drove around the corner to another property I own identified as AP# 398-523-16, 1322
North Sycamore and proceeded to remove personal property of mine at this different address and
without a warrant for the same. On August 2, 2022, Santa Ana Code Enforcement Officer
Alejandro Rodriquez, along with other Santa Ana City employees and contractors, without any
lawfully executed Inspection and Abatement Warrant, trespassed by entering the real property
owned by Edward R. Danoff , the Claimant herein, located at 1322 North Sycamore, Santa Ana,
California, Assessor's Parcel Number 398-523-16, and unlawfully removed and dismantled
personal property of the Mr. Danoff s, and converted the same when removing said personal
property from said property address without any lawfully executed Inspection and Abatement
Warrant.
Based upon the above facts, I, Edward R. Danoff, have submitted a government claim to
the City of Santa Ana for negligence, trespass, conversion, deprivation of civil rights, 42 U.S.C.
Section 1983, conspiracy to deprive one of their civil rights, 42 U.S.C. Section 1985, violation of
due process, and elder abuse.
Since no property was ever removed from AP# 398-523-07, 1323 North Broadway, no
assessment for costs should be imposed. The City of Santa Ana's request for the assessment of
costs in the amount of $17,116.27 should be denied. The City should not be rewarded for
removing personal property at 1322 North Sycamore, (Assessor's Parcel Number 398-523-16)
without having a lawfully executed Inspection and Abatement Warrant.
