TOPIC: Amend Water Quality Sampling and Testing Services Agreement
AGENDA TITLE
Approve an Amendment to the Agreement with Clinical Laboratory of San Bernardino,
Inc. to Increase the Services Amount by $53,000 for a new Annual Amount $130,000 for
the Remaining Term of the Agreement (Non-General Fund)
RECOMMENDED ACTION
Authorize the City Manager to execute an amendment to the agreement with Clinical
Laboratory of San Bernardino, Inc. for water quality sampling and testing services, to
increase the annual amount by $53,000, for a total agreement amount not to exceed
$597,000, for the remaining term of the agreement expiring July 20, 2023, subject to non-
substantive changes approved by the City Manager and the City Attorney.
DISCUSSION
The Public Works Agency’s Water Resources Division administers and maintains the
City’s public water system, which provides high quality drinking water to the residents and
businesses of Santa Ana. On May 18, 2020, the City advertised Request for Proposal
(RFP) No. 20-014 on the City’s online bid management and publication system, Planet
Bids, to solicit proposals from qualified, state-approved laboratories to perform required
water quality testing. On July 21, 2020, the City awarded a three-year agreement, with
the provision for one, two-year renewal option, to Clinical Laboratory of San Bernardino,
Inc. to provide water quality sampling and testing services.
The agreement with Clinical Laboratory of San Bernardino has allowed the Water
Resources Division to meet California State Water Resources Control Board’s (SWRCB)
drinking water testing requirements. The SWRCB, in accordance with Title 22 of the
California Code of Regulations, enforces the primary and secondary drinking water
standards for public water systems. Clinical Laboratory of San Bernardino is accredited
through the California Environmental Laboratory Accreditation Program, and meets all
requirements for water quality sampling and testing.
In order to remain compliant with SWRCB water quality sampling and testing
requirements, Water Resources staff is requesting to amend the existing agreement by
increasing the annual amount by $53,000 to allow for additional water testing and
sampling services that would not be possible under the existing agreement terms.

FIRST AMENDMENT TO AGREEMENT WITH THE CLINICAL LABORATORY OF SAN
BERNARDINO, INC., TO PROVIDE WATER QUALITY SAMPLING AND TESTING. SERVICES
THIS FIRST AMENDMENT to the above-referenced agreement is entered into June 21, 2022, by and
between Clinical Laboratory of San Bernardino, Inc. ("Consultant"), and the City of Santa Ana, a charter
city and municipal corporation organized and existing under the Constitution and laws of the State of
California ("City").
RECITALS
A.The parties entered into Agreement No. A-2020-154 ("Agreement") dated July 21, 2020, to retain
Consultant to provide water quality sampling and testing services for the Water Resources Division
of the Public Works Agency.
B.The Agreement is current and in-effect through July 20, 2023.
C.The parties now wish to amend the Agreement to increase the compensation to fund additional
testing under the Agreement.
The Parties therefore agree:
1. Section 2(a), Compensation, is amended to increase the total annual sum to be expended under the
term of the Agreement, including any extension periods, by $53,000 for a total annual amount of
$130,000.
2. Except as modified by this First Amendment, all terms and conditions of the Agreement, shall remain
in full force and effect.
