TOPIC: Amend Agreement for MWDOC Support Services and Educational Programs
AGENDA TITLE:
Amend agreement with the Municipal Water District of Orange County to increase the
agreement amount by $220,000, for a new total amount not to exceed $553,000 for the
remaining term of the agreement, for mutual aid support services and middle and high
school educational outreach programs (Non-General Fund)
RECOMMENDED ACTION
Authorize the City Manager to execute an amendment to the agreement with the
Municipal Water District of Orange County, increasing the agreement amount by
$220,000, for a total agreement amount not to exceed $553,000, for the remaining term
of the agreement ending June 30, 2022, for mutual aid support services and middle and
high school educational outreach programs, subject to non-substantive changes
approved by the City Manager and City Attorney.
DISCUSSION
On August 2, 2016, City Council approved an agreement with the Municipal Water District
of Orange County (MWDOC) to collaborate on water resources activities, including
planning analyses and reports, water use efficiency programs, school education
programs, emergency preparedness programs, and other joint efforts. Most recently,
staff has utilized the agreement with MWDOC to coordinate and develop the updated
Urban Water Master Plan and to successfully complete the annual state-mandated water
loss reports. Additionally, over 14,000 Santa Ana elementary and high school students
participated in water conservation education programs and more than 1,150 water
rebates were processed over the past year through programs coordinated by MWDOC.
The original agreement was set to expire on June 30, 2019 and an option to extend the
term to June 30, 2022 was exercised on May 6, 2019. Additional funds were not allocated
for the extension at that time. Staff recommends amending the agreement to increase
the agreement amount of $333,000 by $220,000, for a total amount not to exceed
$553,000, in order for MWDOC to continue to provide services to the City of Santa Ana
for the remaining term of the agreement. Contracting with MWDOC for these services is
an efficient and cost-effective service delivery method due to MWDOC’s regional focus
and experience in service delivery.

FISCAL IMPACT
Funds for the amendment to the agreement of $220,000 are budgeted and available in
the Fiscal Year 2020-21 Water Quality & Measurement Account (No. 06017644-62300),
and will be budgeted in future years as indicated below:

FIRST AMENDMENT TO MASTER AGREEMENT FOR
PROGRAMS AND SERVICES BETWEEN MUNICIPAL WATER
DISTRICT OF ORANGE COUNTY AND THE CITY OF SANTA ANA
THIS FIRST AMENDMENT to the above-referenced agreement is entered into on February 2,
2021, by and between the Municipal Water District of Orange County (“MWDOC”), and the City
of Santa Ana, a charter city and municipal corporation organized and existing under the
Constitution and laws of the State of California (“City”).
RECITALS
A. The parties entered into Agreement No. A-2016-210, dated August 2, 2016, by which
MWDOC and the City agreed to jointly participate in water resources activities, including
planning analysis and reports, water use efficiency programs, school education programs,
emergency preparedness programs, and other similar efforts (“Agreement”).
B. The original expiration date of the Agreement was June 30, 2019, and the Agreement was
extended through June 30, 2022 by mutual consent of the parties.
C. The parties now wish to increase the amount to be expended by City under the Agreement.
The Parties therefore agree:
1. Sections 10(b), Term, and 11(a), Limitation of Financial Commitment by City, are
amended to increase the Agreement Limit, as that term is defined therein, from $333,000 to
$553,000.
2. Except as modified by this First Amendment, all terms and conditions of the Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to the
Agreement on the date and year first written above.
