Re: Extension of Agreement #A-2018-113 for Food Service Concessionaire Services at
the Santa Ana Zoo.
On May 1, 2018, the City entered into the above referenced Agreement with Bean Sprout, LLC, dba
Bean Sprouts to provide food concessionaire services (A-2018-113), which was amended on
December 10, 2020 (A-2018-113-01). As provided in Section 4 ("Term"), the term of the
Agreement, as amended, commenced on May 1, 2018, and would continue until the date which is
five (5) year after the Go Live Date, as noted in Section Lb. ("Definitions"). Section 4 also
allowed for an option to extend the Term of the Agreement, as amended.
Pursuant to Section Lb., the Go Live Date would be the date upon which Bean Sprouts opened for
business to the public. City records confirm the Go Live Date as September 17, 2018. The parties
since this date have operated under the terms and conditions of the Agreement, as amended. As defined
above, the term of the Agreement, as amended, runs through September 17, 2023, and is current and
in -effect.
Pursuant to Section 4 ("Term"), the time period of the Agreement, as amended, is here by extended for
an additional six (6) month period from September 18, 2023 through March 17, 2024. All other terms
and conditions of said Agreement, as amended, remain unchanged and in full force and effect.
