I ask that you please vote yes on the land use petition at the January 16th council meeting. My family and I have been with Vista
for seven years now. As a devoted parent involved in many decisions that impact the school, I can assure you that this plan
would benefit all the students who attend this school (including my last and youngest children). Full disclosure: I work for Vista
Condor Global Ademy as the community coordinator, but I am also a parent of three children here. The oldest is getting ready to
transfer to Mater Dei. If you say yes, this will provide the students with an outdoor environment, a community garden, and, most
importantly for me, a security fence around the backfield. I appreciate your support to all Santa Ana residents and your
dedication to making our city the best in Orange County. I look forward to seeing you this January 16th and hope you Vote yes.

Mayor and Members of the City Council:
We are writing to express our support for the Vista/Condor/Heritage (Vista) project to expand their
back parking lot and transform it into a fenced outdoor field, black top area and community garden for
the students and community.
Pearl and I have been actively involved in the Santa Ana and particularly the Artesia Pilar
neighborhood for over 40 years. This will be a great asset to this neighborhood. Vista has been a
community partner with the RAYA Foundation for the last three years. They have graciously allowed
us to use their gymnasium facility for RAYA Foundation programs including sports clinics, leagues,
family events and parent education gatherings. Our Foundation has participated with Vista in
community fairs and this project would allow those opportunities to expand.
This project not only will enhance their school but will be a community asset.

Subject: Opposition to the Construction of Fences in Common Areas and Misuse of Assigned
Maintenance Area by Vista Charter School
Dear Council Members,
I am writing to you as a concerned member/business owner of the Civic Center Business Park,
regarding the recent proposals by Vista Charter School. I wish to express my strong opposition
to the plans for erecting fences in our common areas and converting an area assigned for
parking since the conception of the association into a playground.
The Civic Center Business Park was designed with specific purposes and allocations in mind,
including areas for parking and maintenance that serve all occupants and visitors. The proposed
changes by Vista Charter School, which involve repurposing a parking area for a fenced
playground, are not only inappropriate but also detrimental to the collective interests of the
business community here. I would like to point out Page 4 of the Agreements of Reciprocal
Easements filed on July, 2 1986 (Document# 86-284222) that notes that no fences or barriers
shall be erected that impedes our pedestrian's access.

While we acknowledge and respect the presence of the school in our industrial area, it is
imperative to maintain the balance and respect the original planning intentions. The school is
welcome to construct there playground with fences where they plan to build a garden in Parcel
4, since that is land that belongs to them, but it is not OK for them to decide over an area that
they do not own and where there is a common legal agreement in place. This move not only
infringes upon the rights of other property owners but also disregards the original intent of the
space allocation.
Moreover, the proposed construction of fences around common areas is a direct violation of the
shared and open nature of our business park. Such actions create unnecessary divisions and
disrupt the cohesive environment that we have all invested in and grown accustomed to.
I also want to continue to draw attention to the existing egress and ingress agreement
established by our association. Any modification in the use of shared spaces or alterations to
the physical layout of the business park must respect this agreement.
My hope is that the city council will advise Vista Heritage Charter School to construct their
playground in Parcel 4 and to refrain from building fences in Parcel 3 and 4 which are part of the
Civic Center Business Park and there is a common interest in this area which requires 75% of
the First Mortgages of Units in the Project to agree to these alterations, as noted on Page 9 of
our CC&R's on April 19, 1985 (Document#85-140398).

in the Common Area. The common interest appurtenant to each Unit
is declared to be permanent in character and cannot be altered

BUSINESS PARK OWNERS ASSOCIATION, a California non-profit mutual

A. CCBP is owner of the real property located in the
City of Santa Ana, County of Orange, State of California, more
particularly described as Parcels 3 and 4 as shown on a Parcel
Map recorded in Book 198, pages 19 and 20, of PARCEL MAPS,
records of Orange County (hereinafter "Parcels 3 and 411).
B. Association manages and operates the common area
known as Parcels 1 and 2 as shown on a Parcel Map recorded in

1. BASEMENTS
1.1. CCBP hereby declares as a burden upon Parcels 3 and 4
and for the benefit of Parcels 1 and 2 the following reciprocal
easements:
1.1.1. Non-exclusive easements for the purpose of
Ingress to, and egress from, public streets or highways over that
portion of Parcels 3 and 4 designated for parking and driveway
purposes. Such rights shall extend to normal pedestrian and
vehicular access but shall exclude any vehicle having a weight,
load distribution or wheel type that would not be permitted by
applicable laws or regulations upon the adjoining public streets.
1.1.2. Non-exclusive easements for vehicular parking
on those portions of Parcels 3 and 4 designated for parking,
subject to reasonable regulations and all vehicle code
regulations of any appropriate governmental authorities.

in question. For purposes of this Agreement, CCHP and
Association shall each have the obligation to keep their
respective portions of the Parcels in a good and clean condition,
including, without limitation, the regular carrying out of
customary maintenance and repair of the paved surface thereon,
cleaning and removal of refuse and trash and maintenance of
appropriate striping or other designation of parking spaces.
Notwithstanding the foregoing, any damage to a portion of the
parking area of either owner's property resulting From violation
of the use limitation set forth herein, or any other willful or
negligent act or failure to act by party required to do so, shall
