applicability of the Sunshine Ordinance to specific development amendments Application:Ordinance Amendment No.2023-05 •Action: Adopt an ordinance amending Chapter 14 (Fire Protection and Prevention and Emergency Services) addressing eligibility for permits for the sale of safe and sane fireworks Application:Zoning Ordinance Amendment No.2023-04 •Action: Adopt an ordinance amending various sections of Chapter 41 of the Santa Ana Municipal Code related to wireless communication facilities, billboards, hotels, general restrictions, and definitions Slide 3 Annual Code Updates Item#27 Planning and Building Agency January 16, 2024 Sunshine Ordinance Current Code Proposed Amendment •Applies requirements to a zone change, specific plan amendment, or a general plan amendment •Adds text to include specific development amendments to the list of development projects to which the ordinance applies Amendment will make the ordinance consistent with existing staff implementation practices Slide 4 Annual Code Updates Item#27 Planning and Building Agency January 16, 2024 Safe & Sane Fireworks Current Code Proposed Amendment •Limits permits for the sale of safe and sane fireworks to nonprofit organizations with their principal meeting place within the city •Incorporates text to clarify that: 1.Schools with affiliated organizations and nonprofit organizations may obtain permits to sell fireworks (must be located within city limits). 2.Permits are limited to those benefitting the Santa Ana community and having 75% of their members residing within city limits Amendment minimizes Communication Facilities Current Code Proposed Amendment •CUPs expire after 10 years •Staff verify that original conditions are met (Development Project Review application) •Renewal requires a Public Hearing before the Planning Commission •Renewal expires after 10 years •Staff verify that original conditions are met •Administrative approval by the Executive Director of Planning and Building •Administrative permit expires after 10 years Amendment is consistent with Planning Commission feedback provided on October 9, 2023 to create an administrative renewal process Slide 6 Annual Code Updates Item#27 Planning and Building Agency January 16, 2024 Hotels Current Code Proposed Amendment •Hotels/Motels permitted in some locations (commercial zones and one office zone) with a CUP •Permits Hotels/Motels in the Professional Zone with Conditional Use Permit •Defines Full Service Hotels -Full service restaurant, fitness center, assembly area, swimming pool, and regular shuttle service •Permits Full Service Hotels by-right in Commercial,Professional, and Mixed Use Zones •Lacks standards for hotels/motels and full service hotels •Establishes objective standards General Hotel/Motel Standards •Landscaping, Drop-off zones, Building materials, Pedestrian and Noise protections, Crime prevention, and Management Additional Full Service Standards •Architectural/design elements, Housekeeping, and Lobby requirements Amendment will foster economic development and expansion of quality lodging opportunities while protecting any nearby sensitive land uses Slide 7 Annual which is permitted in the district •Clarifies permissive nature of the zoning code, stating that uses defined are prohibited unless expressly permitted Amendment will ensure compatibility of land uses •Includes duplicate definitions for two different terms •Removes the duplicative definitions •Long-term stay business hotel •Transient/residential hotel Amendment will clean up the definitions section of the code •Minimum 1,000’ separation between billboards •Minimum 1,000’ separation between billboards on the same side of the freeway Amendment will minimize confusion by clarifying separation •Achieves land use compatibility –Goal LU-1, Policy LU-1.1 Slide 9 Annual Code Updates Item#27 Planning and Building Agency January 16, 2024 CEQA and Fiscal Impact Analysis •In accordance with the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the ordinance is exempt from further review pursuant to Section 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines. •A Notice of Exemption for Environmental Review Nos. 2023- 115, 2023-125, and 2023-126 will be filed for this project. •Fiscal impact: A new permit type for extension of wireless communication facility CUPs will result in additional costs. Staff recommends a new Miscellaneous Fee to recover costs and will bring a resolution forward at a future meeting.
