Dear Mayor, Mayor Pro-Tem and Councilmembers (BCC),
The following is in response to Agenda related questions. I have to complete one more agenda
review. If that review warrants any questions, I will update the Team.
Agenda Item No. 17 is about the purchase of new Water Meter Boxes and Lids.
A Councilmember had asked if the automated metering was completed. Per Nabil Saba,
the City has completed about 10% of the automation upgrades. It is moving along, but
moving slow due to supply chain issues.
2. Agenda Item No. 21 is the Working Wardrobe contract to provide training and vocational
training to probationers or others formerly justice involved,
A Councilmember asked if there are any information on success stores for such individuals.
I have attached a success story to this email. Their past performance is below.
Working Wardrobes Past Performance
0 Subcontractor for P2E between 9/2020-3/2022
• 86 Participants enrolled
• 54% employment rate (during the height of the pandemic)
• When you compare employment rates for justice involved people without a program the
difference is striking
• Employment rates for justice involved people according to a Bureau of Justice report
range between 34.9% and 37.9%
• The WW program achieved 54% during COVID. We are aiming a minimum 60% this
time around. This population along with homeless people and people on welfare are
considered the hardest to serve
3. Agenda Item No. 22 - Agreement to design the public realm plan.
There was a question of the length of the S. Main portion of the design. On Main Street,
the Public Realm Plan goes from 1st Street to Goetz Avenue (near railroad).
4. Agenda Item No. 35 - City Council Aide Agreements
Staff received a concern that one councilmember had three Aide agreements that
appear to exceed the maximum amounts. Daniel has provided the following. At the Feb.
20, 2024 meeting, the City Council will be presented with amendments to three
agreements for City Council Aide consultancy services: one for Claudia Perez (the
Mayor's contracted aide), one for Valerie Magdaleno (Councilmember Lopez's
contracted aide), and one for Andrew Linares (Councilmember Bacerra's contracted
aide). To be transparent, in the staff report a table was included with an overview of all
agreements for contracted aides. A councilmember reviewed the staff report and noted
that there are three contracted aides for Councilmember Vazquez, totaling an amount
not to exceed $85,000. Three things: (1) the not -to -exceed amount of $85,000 does not
mean that we expect to expend $85,000; rather, the $85,000 allows flexibility in seeking
services using any of the three agreements (i.e., we may expend more from one
agreement than from another); (2) so far, we have only expended $1,567.50 in city
council aide consultancy services for Councilmember Vazquez; and (3) regardless of
the not -to -exceed amounts for these agreements, the City Council approved a budget of
$60,000 to be used for city council aide consultancy services per councilmember—the
City Manager's Office oversees this budget, tracks these agreements, and makes sure
that no councilmember exceeds the $60,000 allocation for their contracted aides.
5. Agenda Item No. 38 - Food and Beverage Services at Santa Ana Zoo
Staff received concern that the percentage share appeared low. Hawk and his team
have provided the following back up. Outreach/Solicitation Efforts: During the recent
concessions RFP process zoo staff reached out to the downtown businesses and did
extensive research on vendors that provide concessions at zoo and museum
facilities. Those vendors included groups like SSA (services at numerous zoos like LA
Zoo), Patina Group (Bowers Museum), Aramark, Delaware North, the food vendor for
Chapman University, and others. Despite direct emails and outreach to as many
relatable businesses as we could find, we only received one proposal from the current
concessionaire, Bean Sprouts. At the job walk the owners of the McFadden Public
Market were interested in bidding but ultimately said it wasn't profitable enough. Bean
Sprouts: Bean Sprouts is currently at the zoo and Discovery Cube and has a number of
other installations (both owned and franchised) at other zoos and museums. Bean
Sprouts has no prior experience with alcohol sales at their other facilities and this
venture will be a learning experience for them as well as the city. Bean Sprouts did
request the City keep their revenue share numbers confidential because they stated
they are more generous than some of their other facilities. City staff advised it is public
record. Because Bean Sprouts was the only proposer we didn't really have leverage to
negotiate aggressive revenue share and their numbers were consistent with our past
agreement. Previous Alcohol Sales Agreement: The City did pursue a RFP solely for
alcohol sales a couple years ago and received a small number of bids at the time. The
most competitive proposal, and the one we selected, provided a 20% revenue share for
alcohol sales. This vendor was never able to successfully receive an ABC license
despite assertions they could. Working closer with the ABC office city staff learned they
couldn't receive the license because they didn't operate the on -site kitchen and the ABC
wouldn't accept a situation with a separate contracted food operator. Revenue Share:
Based on information we could find, restaurant profits are not very high and according

profit-margin We have learned a lot over the past few years and any original assertions
don't appear correct. Golf Course Comparison: As this was not used in negotiation of
this contract. We get 2% of all beer sales. Attached is the latest one I have but could get
the most recent one.
6. Agenda Item No. 44 — Increase of Sanitation Fee
Staff received feedback that the staff report referenced the fee increase in a monthly
format. But the City ratepayers do not pay monthly, they pay ever two months. Nabil
has provided the following response. Proposition 218 dictates that we maintain
transparency with residents and businesses, and requires that justification of the fee
adjustment is supported by a study. In the same manner as the water rates, the
financial study focuses on fees for service and the impact of the fee on the customer per
household on a monthly basis, which is the government standard for such studies. The
City's fee presentation in the notice must be presented as such, per month. Other
entities like the County Sanitation Districts bill their sewer assessment through the
property tax bill, and is based on annual cost, although their bill is paid twice per
year. *We will adjust our PowerPoint presentation to reflect the monthly charge to be
billed every two months, thereby doubling the amount to be billed at six times per year.
7. Non Agenda Items
a. Staff had an inquiry as to the future of the mural at Memorial Park. The Memorial
Park Mural will be incorporated into the design or moved to another location within
the park. It will have a place at Memorial Park.
b. There was an inquiry about entryway monuments at Wilshire Square. Nabil
provided an update on monument refurbishment project:
Pacific Park
• Monument Refurbishments have been completed
• Landscaping will be updated prior to unveiling ceremony
o Tentative dates for ceremony are March 9t" or March 16t" (recently requested by the
neighborhood)
• The four monuments will remain covered until the unveiling
Wilshire Square
• Construction of the missing monument on Ross & McFadden started this week.
• No set completion date due to contractor having to order the sign/neighborhood name;
have to match with existing monuments.
• Other monuments in the neighborhood will be touched up as needed
o primarily replacing damaged or missing sign letters
