ORDINANCE AMENDinG SECTIONS 3213 and 3309 OF THE SANTA ANA
MUNICIPAL CODE AND ADDING SECTION 3234 THERETO PROVIDING
PENALTIES AND FOR BAIL AND C0~I~VJING VIOLATIONS
THE COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION l: That Section 3213 of Chapter 2, Article III of
the Santa Aha Municipal Code be and the same is hereby amended to
read as follows:
"SECTION 3213. Parking at Curb Painted Red Prohibited.
"No person shall stop, stand or park any motor vehicle,
whether attended or unattended, immediately adjacent to or
opposite, any curb which has
a bus may stop in such a red
bus loading zone; and except
been painted red; except that
zone marked or signposted as a
that a vehicle may stop, for the
purpose of depositing mail in such a red zone marked or sign-
posted for the purpose of permitting such deposit in a mail
box so placed that an occupant of a vehicle is able to depos-
it mail therein without leaving the vehicle."
SECTION 2: That Section 3309 of Chapter 3, Article III of
the Santa Aha Municipal Code be and the same is hereby amended to
read as follows:
"SECTION 3309. Enforcement. Penalty.
"(a) It shall be the duty of each police officer to take
the nUmber of any meter at which any vehicle or thing is
parked, placed, ranked, stored or left in violation of any of
the provisions of this Chapter, the State vehicle license of
such vehicle; the time and date of such over-parking, and the
make of such vehicle, and to issue, in writing, a citation for
said violation in the same form and subject to the same pro-
cedure provided for by the Ordinances of the City and the laws
of the State applicable to the traffic violation within the City.
"(b) Any operator or owner of a vehicle to whom a citation
has been issued for any violation of any of the provisions of
Chapters 2 or 3 of Article III of this Code, excepting Sec-
tions 3211, 3213, 3217 and 321S thereof, involving parking
of such vehicle in a place where parking is lawfully permit-
ted for a period of time longer than the lawful maximum period
for such place or for a period of time longer than the time
for which coins have been deposited in a parking meter placed
to regulate parking where such vehicle is parked or for fail-
ure to deposit any coin in such a mete~may, on or before the
appearance date set out on such citation, pay to the Court as
bail, as a penalty for, and in full satisfaction of such vio-
lation, the sum of One Dollar. Said psyment may be made in
person or by mailing the same to the Clerk of the Municipal
Court, Santa ~na Orange Judicial District within said period.
Any such owner or operator failing to make such payment within
said period and any person violating any other provision of
said Chapters 2 and 3, shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punished by a fine of
not less than Two Dollars nor more than Fifty Dollars or by
imprisonment in the county jail for not more than five days or
by both such fine and imprisonment."
"(c) Any operator or owner of a vehicle to whom a citation
has been issued for any violation of any of the provisions of
Chapteri 2 or 3 of Article III of this Code for which no pro-
vision for the posting of bail in full satisfaction of such
violation has been made in Subdivision (b) of this Section, may,
prior to the appearance date set out on such citation, deposit
with the Magistrate of said Municipal Court, such bail as the
Magistrate shall fix as reasonably sufficient. Thereafter, at
the time when the case is called for arraignment before the
Magistrate, if the defendant shall not appear, either in person
or by Counsel, the Magistrate may declare the bail forfeited

and in his discretion, order that no further proceedings
shall be had in such case. All proceedings and things not
expressly provided for in this Sub-section (c) shall be done
in accordance with the provisions of Section 739 of the Ve-
hicle Code as the same now exists or may hereafter be amended."
SECTION 3: That Chapter 2 of Article III be and the same is
hereby amended by adding thereto a new Section immediately follow-
ing Seetion 3233 which new Section shall be numbered 323~ and shall
read as follows:
"Section 323~. Continuing Violations Additional offenses.
"(a) Every person violating the provisions of Section
3215, 3217, or 321S, is guilty of a further and separate
violation for each period of time that the wehicle is left
so parked equal to the maximum legal parking time for the
particular t~affic zone or parking space as designated in
said Sections or by Resolutions adopted fixing such maximum
legal parking time.
"(b) Every person violating the provisions of Section
3213 or 3216 is guilty of a further and separate violation
for each period of thirty minutes t~at said vehicle is left
continuously so parked beyond the first period of thirty
minutes of such parking.
SECTION ~: The City Cler~ shall certify to the passage of this
Ordinance and shall cause the same to be published in tkree issues
of the Santa Ann Register, a newspaper printed, published, and cir-
culated in the City of Santa Ann and hereby designated for that pur-
pose. This Ordinance shall take effect 30 days from and after the
day on which it is passed and adopted.
PASSED AND ADOPTED by the Council of the City of Santa Ann at
its regular meeting held on the 16th day of
February , 1953.
