HomeMy WebLinkAboutNS-028ORDINANCE NO. NS-28 AMENDING THE SANTA AMA MUNICIPAL CODE BY AMENDING CHAPTE~ 2 OF ARTICLE VII PROVIDING FOR STREETS AND STREET IMPROVEMENTS. THE 0ITY COUNCIL OF THE CITY OF SANTA AMA DOES ORDAIN AS FOLLOWS: SECTION 1. Tha~ the Santa Aha Municipal Code be and it ia ~ereby amended by amending all of Chapter 2 of Article VII thereof to read as follows: "Chapter 2. Streets and Street Improvements. "Section 7200. Purpose. "The purpose of this Chapter is to establish regulations and procedures for the construction, repair and re-construction of street and alley sub-grade, base and surfacing; curbs; gutters and cross-gutters; sidewalks; sanitary sewers and water lines; drainage structures; or other improvements made in, on or over streets or ways in the City of Santa Ans. "Section 7201. Official Grades and Standards. "All street improvements designated in Section 7200 herein shall be done in conformance with lines and grades furnished by the City Engineer or approved by him and in accordance with the standards and specifications adopted by resolution of the City Council, copies of which are on file in the offices of the City Engineer, Planning Director and Clerk of the Council. "Section 7202. Effect of Master Plan. "All street improvements as defined or listed in Section 7200 herein shall be done in accordance with the standards for width and type established by the master plan of streets and high- ways of the City. If no master plan of streets and highways has been adopted by the City Council, the provisions of this Section shall apply to any map showing proposed street develop- ment as adopted by the City Council or to any proceedings affecting said streets and alleys initiated by the City Council. "Section 7203. Notice to be Given. "No person shall begin any of the work designated in Section 7200 herein without first notifying the Superintendent of Streets of the time when such work will begin. "Section 7204. Permit Required. "No person shall begin or do, or cause or direct the doing of any of the work designated in Section 7200 herein unless and until a permit for such work has been issued by the Superintendent of Streets. "Section 7205. Permit Fees. "The fee for a permit to perform the work shall be estab- lished by the following fee schedule: A. CURB OR GUTTER (or both if combination curb and gutter) (a) For first 50 linear feet or less $ 5.00 (b) Additional linear feet - 25 per lin. ft. (c) Each curb return at intersecting streets 3.00 No charge to fill in drive way B. CURB AND SIDEWALKS (if constructed at the same time) (a) For first 50 linear feet or less 5.00 (b) Additional linear feet - 45 per linear foo~ (c) Each return a~ intersecting streets 3.00 0. SIDEWATx (where no curb exists) (a) For first 50 linear feet or less 5.00 (b) Additional linear feet - 2~ per linear foot (c) For 15 linear feet 2.50 Fill in between curb and walk - no charge D. SIDEWALK (when curb exists) (a) For first 50 linear feet or lees 2.50 (b) Additional linear feet - 2~ per linear foot NOTE: The above charges will include plain driveways when desired, but do not include paved driveways. No extra charge for driveway when taking out curb permit. - 2- E. DRIVEWAYS (Plain Dirt Street) Cutting curb and constructing curb returns only $ 1.00 F. MAIN SEWER $2.50 first 50 feet. 0~l cents per foot thereafter. J. SE~ER LATERA~ $1.00 (No charge for permits covered by Franchise) #Section 7206. Charge for Work by City Employees. "A charge shall be made for work performed by City Employees, including but not limited to engineering and draft- of ing, setting and checking/line and grade stakes and engineering inspection, at cost plus 20 percent and shall be in addition to any permit fees. "Section 7207. Plans. "Plans for street improvements other than in subdivisions of five or more lots shall be d~awn in the office of the City Engineer, unless other arrangements are made satisfactory to the City Engineer. All street improvement work must be done in strict conformance to the plans approved by the Oity Engineer. -3- 'Section 7208. Protection of Works, ,Any person or persons perfo~ing or causing to be per- formed any street improvement work under a permit issued by the Superintendent of Streets as provided in this Chapter shall place or construct sufficient safeguards and protective devices at all times about the work area to warn and protect the public from injury. 'Section 7209. Requirements for Permit. ,The Superintendent of Streets shall not issue a permit for any street improvement work until the following actions have been taken by the person or persons applying for said permit: (a) plans for the work have been submitted to and approved by the City Engineer~ (b) an adequate certificate of insurance has been filed with the City Engineer indemnifying the City from any damages directly or indirectly that may be had against the City by reason of the work to be performed under the permits; (c) any bond as required under the provisions of this Code has been filed with the Clerk of the Council; (d) all permit fees have been paid or provided for in accordance with the provisions of this Chapter; (e) an agreement has been filed with the City that the work will be completed within a specified time. 'Section 7210. Furnishing Lines and Grades. 'The City Engineer may furnish lines and grades for any street improvement work other than for a subdivision of five or more lots, for which a permit has been issued. -4- "Section 7211. Removal of Illegal Work. "It shall be the duty of the Buperintenden~of Streets to remove from any public street or alley any work as designated in Section 7200 herein which has not or is not being performed in strict conformance to the provisions of this Chapter. #Bection 7212. Completion of Work. ~The City Engineer shall certify to the Comncil as to the completion of any street improvement project wherein a bond has been filed. ~Bection 7213. Acceptance of Street Improvements. #The City Council shall not accept any streets or alleys or improvements thereto until the Superintendent of Streets shall certify that all requirements of this Chapter have been fulfilled; nor shall the aouncil release any bond until the City Engineer shall certify that all work has been satisfactorily completed and payments made as required by this Chapter. mBection 7214. Costs of Street Improvements. "The costs of all original street improvements, other than those costs which the City Council may determine as pay- able under the State Gas Tax NaJor Street .Development Program or other street improvement project authorized by the City Council, shall be paid by private persons having an interest therein; except that the City will pay the difference in cost for the installation of sewer lines and water lines of sizes larger than those required to serve the immediate local service area, and will pay the difference in construction costs on primary or secondary streets between the estimated cost of the street improved to the standard of a local street and the cost of improvement to the standard of a primary or secondary street, aa the case may be. UThe City Engineer shall establish the procedures for determining this differential in cost to be paid by the City -5- and shall file his estimate of such cost with the City Council, whi&shall approve such determination of cost to the City for each such project. #Section 7215. Nethod and Time of Payment. "1~henever the City Council has establishe~ the portion of total cost on any project payable from City moneys as pro- vided for in Section 7215 herein, the Director of Finance shall pay the determined amount directly to the person or persons to whom the permit has been issued; but such payment shall be made only after the work has been certified as com- pleted by the City Engineer and any bond applying to the project has been released.# SEOTION 2. The Clerk of the Council shall certify to the passage of this Ordinance and shall cause the same to be published within 15 days after its adoption, in one issue of the Santa A~a Independent, the official newspaper of the City. This Ordinance shall take effect 30 days from and after the date of its final adoption.
