HomeMy WebLinkAboutNS-203ORDINANCE NOo NS-203 AN ORDINANCE OF THE CITY OF SANTA ANA, CALIFORNIA, ORDERING, CALLING, PROVID- ING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SANTA ANA ON THE 6TH DAY OF NOVEMBER, 1956, FOR THE PURPOSE ~F SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT AND CONSOLIDATING SAID ELECTION WITH THE GENERAL ELECTION TO BE HELD ON SAID DATE. WHEREAS, the City Council of the City of Santa Aha, California, did on the 22nd day of August, 1956, by a vote of more than two-thirds of the members of said City Council, adopt Resolution No. 56-234 ~ entitled "Resolution of the City Council of the City of Santa Aha, California, determining that the public interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relat- ing thereto", which said resolution was duly signed and approved by the Mayor of the city and attested and certified by the Clerk of the Council of said city; The City Council of the City of Santa Aha DOES ORDAIN as follows: Section 1. That a special municipal election be held, and the same is hereby called to be held, in the City of Santa Ana, California, on the 6th day of November, 1956, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinafter set forth, and for the object and purpose set forth in said resolution and hereinafter stated. Section 2. That the object and purpose for which said indebtedness is to be incurred and bonds issued therefor is as follows: The acquisition and construction by the City of Santa Ana of a certain municipal improvement, to wit:. a public library build- ing with vehicle parking therefor and the planting and landscaping of the library grounds, including the acquisition of furnishings, fixtures, equipment and other property necessary therefor. Section 3. That the estimated cost of the m~nici- pal improvement described in Section 2 hereof is the sum of $700,000, and that the amount of the principal of the indebtedness to be incurred therefor is the sum of $700,000. Section 4. That the maximum rate of interest to be paid on the indebtedness incurred for the purpose stated in this ordinance shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually for the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale thereof. Section 5. That if the proposition for the 'incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city in not exceeding the principal amount stated in said proposition shall be issued and sold for the object and purpose set forth in said proposition. Section 6. That the polls for said election shall be opened at seven o~clock, A.M., of the day of said elec- tion and shall remain open continuously from said time until seven o~cloc~P.M., of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 7o This election being consolidated with the statewide general election and the Board of Supervisors being authorized to canvass the returns and only one form of ballot being authorized, the method of voting upon said bond proposition shall be as provided in the Elections Code of the State of California, and on the ballots to be used at said special municipal election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word 'YES" or after the word "NO". Ail marks, except the cross (+) are forbidden. Ail dis- tingmishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of elec- tion and obtain another. On absent voter ballots mark a cross (+) with pen or pen¢ilo : CITY OF SANTA ANA LIBRARY BONDS: : Shall the City of Santa Ana incur a : bonded indebtedness in the principal : sum of $700,000 for the acquisition : and construction by said city of a : certain municipal improvement, to wit: : a public library building with vehicle : parking therefor and the planting and : landscaping of the library grounds, : including the acquisition of furnish- : ings, fixtures, equipment and other : property necessary therefor? Section 8. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposi- tion. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 9. Said proposition shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as pro- vided in Section B831 of the Elections Code of the State of California. Section 10. That said special municipal elec- tion hereby called to be held in the City of Santa Aha on the 6th day of November, 1956, shall be and is hereby ordered consolidated with the statewide general election to be held on said date, and within the City of Santa Ana the precincts, polling places and officers of election for the special municipal election hereby called shall be the same as those provided for said general election. The Board of Supervisors of the County of Orange is hereby requested to order the consolidation of the special municipal election hereby called with said state- wide general election, and said Board of Supervisors is authorized hereby to canvass the returns of the special municipal election hereby called and the absentee ballots cast by voters residing within the City of Santa Aha, and the elections shall be held in all respects as if there were only one election, and only one form of ballot shall be used. Said Board of Supervisors shall certify the result of the canvass of the returns of such special municipal election to the City Council of the City of Santa Aha which shall thereupon declare the result thereof. Section 11. That only qualified voters of the City of Santa Ana shall be permitted to vote at the special election hereby called. Section 12. That the Clerk of the Council shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the City Council of said city, and shall cause said ordinance to be published once a week for two successive weeks in the SANTA AMA INDEPENDENT, a weekly newspaper of general circula- tion in said city. No other notice of such election need be given. Said Clerk of the Council shall also file a certified copy of this ordinance with the Board of Super- visors cf the County of Orange and a certified copy thereof with the County Clerk of said county. Section 13.
