NS-213 DECLARING THE ANNEXATION OF THAT CERTAI~ TERRI~0RY DESIGNATED "B~RNSTEIN FIFTH STREET ANNEX" WHEREAS, the City Council of the City of Santa Aha did on August 6, 1956 declare its intention to annex certain uninhabited territory by Resolution No. 56-218, which said Resolution was regularly published as required by law, and which said Resolution gave due notice of public hearing to be held on September 17, 1956; and WHEREAS, at said hearing there were no objections or protests to said proposed annexation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That after due hearing, it finds that there was no protest to the annexation of the territory herein described, that due notice of the time and place of hearing was given; that said territory was wholly uninhabited at the time the petition for annexation was filed; that said territory is contiguous to the City of Santa Aha, California; that written consent of all the owners was filed with the Clerk of the Council prior to the adoption of this Ordinance, agreeing that all property within said territory shall be taxed to pay any iD~ebtedness or liability of said City contracted prior to or existing at the time of annexation and that said property shall be so taxed. SECTION 2. That all of the territory situated in the County of Orange, State of California, described as: ~at portion of the South half of the Southeast quarter of Section 10, Township 5 South, Range l0 West, S.B.B. described as follows: Beginning at a point in the centerline of West Fifth Street as conveyed to the County of Orange by deed recorded in Book 23~ Page 327, Deeds, Records of Orange County, California, said point being located 77.17 feet South 89° 35' 00" West from a bolt marking the Westerly end of the first course described in said deed to the County of Orange, said point of beginning also being an angle point in the Westerly boundary cf the City of Santa Ana, sai~ point also being the Northwest corner of "Fifth at King AnnexS, adopted by Ordinance NS-92, April 4, 1955; ru~ning thence South 23° 23' 10" West 741.01 feet along the Wes- terly boundary of the City of Santa Ana to a point in that certain boundary line established by agreement between J. H. Stewart and wife and L. L. Merchant and wife recorded February 28, 1925 in Book 565, Page 159, Deeds, Records of 0range~ County, California; ~ence North 89° 42' 00" West 324.56 feet along said boundary line and along the North- erly boundary of the City of Santa Aha; thence North 23© 23' 49" East 736.54 feet to a point in the centerline of West Fifth Street as conveyed to the County of Orange; thence North 89© 35' 00" East 326.41 feet to the point of beginning. Bearings and distances shown on Record of Survey filed in Book 33, Page 8 be and the ~ame is hereby annexed to and shall become a part of the City of Santa Aha, the Santa Aha Elementary School District, Santa Aha High School District and Santa Aha Junior College District, and said annexation is by this Ordinance effected, approved and declared. SECTION 3. The Clerk of the Council shall certify to the passage of this Ordinance and shall cause the same to be published within 15 days after its adoption, in one issue of the Santa Ana Independent. This Ordinance shall take effect 30 days from and after the date of its final adoption.
