PROPERTY IN TP~ OF THE 'POLICE DEPART~ENT
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWB:
SECTION 1. That Section 2612 of Part l, Chapter 6, Article II
of the Santa Ana Municipal Code is hereby amended to read as follows:
"SECTION 2612. Disposal of u.nclaimed Property.
Whenever unclaimed property found, necovered or held by the
Police Department shall accumulate to the point where the Chief of
Police desires to dispose of same, it may be sold after complying
with the provisions of Section 1873 of the Civil Code of the State
of california, as follows: Such property must be held by the
Police Department for at least 6 months, must be sold at public
auction to the highest bidder, notice cf such sale shal i be given
by the Chief of Police at ]east 5 days before the time fixed for
sale by publication once in the newspaper publishing City legal
notices, and complimuce shall be had with any .amendment of said
Section 1873. Property held for an individual finder, other than
a City employee who found same while performing his regular duty,
shall be returned to finder on demand if he has complied with the
requirements of the Civil Code governing the duties, and obligations
of a fir~ler, and no such p~operty shall be sold~Athout giving 5
day's notice by mail to the person turning it in, if such person
gave an address. After said notices are given the sale shall be
conducted by the Purchasing Agent. Property for which no bid is
made at such sale may be given to a nonprofit charitable corpora-
~ton or destroyed as the Chief of Police may direct."
SECTION 2. The Clerk of the Council shall certify to the passage
of this Ordinance and shall cause the same to be published once within
15 days after its adoption. This Ordinance shall take effect 30 days
from and after the date of its adoption.
