HomeMy WebLinkAboutNS-321ORDIHA2~CE NO. NS-321 REGULATING AMBULANCES AND AMBULANCE PEP~ONNEL CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN A~ FOLLOWS: SECTION 1. That Amticle V1, Chapter 3, Par~ 9 of the Santa Ana Municipal Code is hereby amended by adding new sections at the end thereof in words and figures as follows: "Section 6394. Ambulances and Ambulance Personnel. Definitions. "Ambulance" is defined as any privately-owned vehicle equipped and used for transporting injured or sick human beings, and shall include, but is not r~stricted to, emer- gency vehicles used for such purposes. Section 6394.1. Same. Ambulance Permit. No person shall operate any ambulate business in the City without first applying for and obtaining a permit so to do. The application for such permit shall be filed with the Chief of Police sa d shall contain the informa- tion required by Section 63§1.1 (a) and (b) of this Code. Applicant shall furnish proof of insurance on each vehicle proposed to be so operated to cover public liability in assents of not less than $50,000 for injury or death to one person, $100,000 for inJu.ry or death of more than one person in any one accident, $40,000 malpractice in any one incident, and property damage of not 1~ ss than $10,000 for any one accident, before the permit is ismed. Before issuing an ambulance pex~ait the Chief of Police shall refer the question of public convenience and neeess~ ty to the City Council for their determination. Prior ~o the Council,s clorox'ruination, the Chief of Police shall make an investigation and recommendation to the Cit-y~ Oouncil aa to the applioant,s complimce or non-complimoe wi~h the con- ditions set forth in Section 6381.4, Subsections (a) and (b), and as to the number of ambulances then operated in ~he City under permit. In determining the question of pub- lic convenience ~d necessity, the City Council shall be guided by the following: (1) Approximately one ambulmce shall be permitted for each 20,000 residents of the City of Sm ta Ana, or major portion thereof. (2) The number of residents of the City of Sm ta Aha shall be determined by the last preceding official United States Goverument Census. Such permit shall not be granted until each ambulance to be operated, and all equipment thereon, has been submitted to and examined by the Chief of Police, or his designated agent, to determine that the same is in all respects mechan- ically safe and free of defects; that said ambulance is properly equipped with a cot, stretchers, blankets, restraints, first aid supplies, splints, resuscitator, towels, and pillows; and no person shall operate any ambulance while the same or any of the equipment thereon or therein is defective, unsafe, or unclean. The Chief of Police may, for good cause or on reasonable belief that my of the previsions herein have been violated, call for a reinspection at any reason- able time. A permit may be revoked or suspended for the existence of any state of facts which would have been a good reason for denying such permit when applied for, or for a violation cf this part. Such permit shall expire on December 31st of the year of its issuance, and all renewals shall expire on December 31st of the year in which granted, unless revoked or suspended sooner by the Chief of Police. No certificate of public convenience and necessity shall be sold, transferred, assigned, mortgaged or otherwise con- veyed without the consent of the City Council, and the sale, transfer, assignment, mortgaging or otherwise conveying of any such certificate without the consent and approval of the City Council shall operate as a revocation of such cert- ificate. Any person who, om the date of adoption of this Ordinance, is engaged in the operation of an ambulance business within this City, shall be issued a CERTIFICATE OF PUBLIC CONVEN- IENCE AND NECESSITY authorizing such person to operate the number of ambulances such person has in operation on said date, after making an application for an ~mbulance permit, providing his equipment conforms with the provisions of this Ordinance. Section 6394.2. Same. Driver's Permit. No person shall drive any ambulance in the City without first applying for mad obtaining a special ambulance driv- er's permit, nor shall such person drive any ambulance after such permit has expired or been revoked. Any person desiring an ambulance driver's permit shall apply to th~ Chief of Police for the same, and the provis- ions of Section 6382, 6382.1, 6382.2, and 6389 shall apply to the issuance of such permits except that wherever there- in reference is made to "taxicabs" or "motor bus" the same shall read as though the word "ambulance" were substituted therefor, and wherever ~erein reference is made to the "Boar~" the same shall be read as though the phrase "Chief of Police" were substituted therefor. The appeal provisions of Section 6389 shall be available to any person desiring to appeal from any decision made by the Chief of Police. Ail such permits shall expire on December 31st next succeeding the date of issuance or renewal. A renewal of such a permit may be had only by a finding of the Chief of Police that the applicant still is in compliance with the conditions required for the issuance of such a permit. Such permit may be revoked or suspended by the Chief of Police for the existence of any state of facts which would have been a good reason for denying such permit when applied for, or for a violation of this Part. The Chief of Police shall have the authority, for good cause or on reasonable belief that any of the provisions herein have been violated, to reexamine the information contained in the application to see if a revocation should be imposed. No person under the age of 21 years shall be granted an ambulance driver's permit, and no ambulance, while on call, shall be operated within the City unless accompanied by a person, other than the driver, who has successfully completed the American Red Cross First Aid Training Course and has reached the age of 18 years. -2- Section 6394.3. Same. Special Regulations and Prohibitions. Any person operating an ambulance shall submit his ambulance to the Chief of Police, or his designated agent, at the Police Station, for a complete in- spection or reexamination of said physical equipment, within 48 hours after requested to do so, and the Chief of Police shall have the authority to ~equest such an inspection either for good cause, or on a reasonable belief that any of the provisions of the Code have been violated or that a revocation of the permit should be imposed. (b) Ambulance service shall be available at all times by radio or telephone call. It shall be unlawful for any ambulance co~pany, operator, driver, or assist- ant to fail to render service, insofar as he is able, immediately upon request, or at an appointed time, when such service is required and concerns the safety or health of the person or persons requiring service. (c) Every ambulance operator and driver, upon receipt of a call, shall state to the persc~ calling whether or not a~ ambulance is immediately available m~d unoccup- ied; if none be so immediately available, such fact shall be reported to the person calling. (d) No ambulance operator or driver shall go to the scene of any accident unless ~ ecifically requested so to do by some person, or by the Police Department. Each such ambulance operator receiving a telephone call from some source other than the Police Depart- me~t shall immediately notify the Police Department, giving details as to time of call a~d place nature of accident, and shall not proceed to said accident scene unless dispatched thereto by the Police Department. (e) Every person operating or driving m ambulmace in the City shall keep an accurate record of every call responded to, the time the call was received, the place of pickup and destination, and the time of arrival at each. (f) Every person holding an ambulance permit shall sub- mit to the City Council his rate schedule, and the same shall be readily available for inspection by any person, and such ambulance operator shall make all of his charges in accordance with his rate sched- ule until a new and different rate schedule has been filed with the City Council. SECTION 2. This Ordinance shall tmke effect thirty days after the date of its adoption.
