ORDINANCE NO. NS-S~9 ORDERING AND PROVIDING FOR A SPECIAL MUNICIPAL E---~ECTION TO BE HELD IN THAT CERTAIN TERRITORY DESIGNATED "SULLIVAN AND EDTNGER AiiNEX" ON NARCH 10, 1959 FOR THE PURPOSE OF SUBMITTING TO THE VOTERS IN SA~D TERRITORY THE ©UESTION OF ANNEXATION TO THE CITY 0F SANTA ANA WHEREAS, heretofore all of the 'steps necessary for the initia- tion of annexation procedures under the Annexation Act of 1913 have been completed, as required by law, to and including the adoption of Resolution No. 59-15, detailing said procedures and calling a special election for ~arch 10t.w, 1959 for the submission to electors in the territory hereinbelow described of the question of annexation of said territory to the city of Santa Ana. NOW, THEREFORE, Tk'E CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That a special election is hereby called and ordered to be held on the 10th day of March, 1959, in that certain territory heretofore designated "Sullivan and Edinger Annex", lying in the County of Orange, State of California, and described as: Beginning at the southwest corner of Tract No. 506 as shown on a map thereof recorded in Book 17, pages 26 and 27, Mis- cellaneous Maps, Records of Or~uge County, California, said southwest corner being an angle point in the City boundary of the City of Sauta Ana, California, and running thence along said City boundary on the following courses: Easterly along the southerly line of said Tract No. 506 to the westerly line of Old Newport Road (50.00 feet wide); thence northeasterly along the westerly line of said Old Newport Road to its intersection with the westerly exten- sion of the south line of Tract No. 737, as shown on a map thereof recorded in Book 22, Page 42, Miscellaneous Naps, Records of Orange County, California; thence North 89° 29' 40" East al o~ said south~line and its extension of said Tract No. 737, 295.60 feet; thence North 0° 30' 20" West 31.13 feet; thence North 89° 29' 40" East 660.00 feet; thence South 0° 30' 20" East 31.13 feet; thence North 89° 29' 40"~Ea'st 62.0~ feet; ~ thence North 2° 45' 36" West 60.05 feet~ t~en~e South 8~° 29' 40"~West 59.67 feet; thence North 00 30' 20" West 1,036.13 feet along the East line of Center Street (60.00 feet wide) to the north line of Edinger Street said north line being 25.00 feet north of center line; thence South 89° 20' 40" West 658.00 feet along said ncr th li~ of Edinger Street; thenca North 0° 16' 20" West 410.60 feet; thence North 89~ 29'~ 40" East 628.00 feet ~ the east line of Tract No. 1347 as shown on a map thereof recorded in Book 42, Page 13, Miscellaneous ~O ~aps. Records of said Orange ~ unty, California; thence North 0° l~' 20" West ~ ong the east line of said Tract No. 1347 and along the east line of Tract No. 1346 as shov~ on a map thereof recorded in Book 41, Page 3, Miscellaneous Maps, Re- cords of 0range County, California, to the northeast corner of said Tract No. 1346; thence westerly along the north line of said Tract Mo. 1346 to the southeast corner of Tract No. 604 as shown on a map thereof recorded in Book 24, Page 19, Ntscellsneous Maps, Records of Orange County, California; thence northerly along the East line of said Tract ~o. 8o4 to the south line of Fairview Avenue (60.00 feet wide); thence westerly~along said south line to the west line of Sullivan Street (b0.O0 feet wide); thence southerly along said west llne of Sullivan Street, said west line being the east line of Sulliv~ and Fairvtew Northwest Annex, to the south line of the north 800.00 feet of Section 22, Township ~ South, Range l0 West, San Bernardino Base ~ d ~eridian; thence west- erly along said south line, said line being the south line of said Sullivan and Fairview Northwest Annex, to the southwest corner of said Sulliva~ mud Fairvtew Northwest Annex; thence northerly along the westerly line of said Sullivan and Fairview Northwest Annex to the northwest corner thereof; thence easterly along the northerly line of said ~ nex 86.10 feet to an angle point in said City boundary; t hence ~ ong the following t~ courses, (bearing based on Sul~ivau Street bearing due North): North 414.66 feet; thence North 89° 48' 30" East 1,263.90 feet to the center line of said Sullivan Street; thence North aiong said center line of Sullivan Street and ~ong said City bound- ary ~0.26 feet; thence West sblong said City boundary to the westerly boundar~ of the R~cho S~tiago de S~ ta Aha; thence northeasterly along said westerly boundary of said Rancho Santiago de Santa Ana and aiong said City boundary to the center line of First Street; thence westerly along said center line of First Street to the easterly right of w~y line of the former Newbert Protection District right of way for the channel of the Santa Ana River and to an angle point in said City boundary; thence departing from said City boundary southwest- erly along said easterly right of way line of the former Newbert Protection Diet, ct rlght of way for the channel of the Santa Ana River to.the northwest corner of Croddyland Annex No. 1 annexed to C~ty of Santa Ana by Ordinance NS-184 filed with the County Recorder on June 28, 19~6, as instrument number 88686; thence easterly along the north line of Croddyland Annex No. l, 2,703.86 feet; thence along the following courses; (Bearing based on Old Newport Road bearing South l~° 0~' 40" West): North 0° 30' 10" West 178.0~ feet; thence North l~° East 2,~l~.10 feet to a point on the arc of a curve concave southwesterly having a radius of 9~0.00 feet, the radial line through said point bearing North ll° ll' l~" East said curve being on the southerly property line of Edinger Street as described in Book 211~, page 392 of Official Records of Orange County, C&lifornia; thence southeasterly along said curve to its point of intersection with the southerly line of Edinger Street as shown on a map of Tract No. 1024 recorded in Book 3~, Page 33, Niscellaneous ~aps, Records of Orao~e County, California; thence southeasterly and easterly along said south line of Edinger Street as shown on said map of Tract No. 1024 to a point on the arc of a curve concave north- easterly having a radius of 1,030.00 feet, said curve being on the southerly property line of Edinger Street as described in Book 211~, Page 392 of Official Records; thence southeast- erly along said curve to a tangent line which bears North 89° 30 O0 East;/~l ~ ~a~ ~n~nt ~n~ wh~ is parallel with and 30.00 feet southerly, measured at right angles, from the center line of Edtnger Street, ~64.99 feet to the West line of ~aid Tract No. ~06; thence South l~° 16, ~0" West 1,299.?~ feet along said west line of Tract No. ~06 t~ the Southwest corner thereof and to the point of beginning, for the purpose of submitting to said electors a proposition propos- ing to annex said territory to the City of Santa Ana, California. SECTION 2. The proposition to be presented to the electors and to be printed upon the ballots used in said election shall be in the following words: Shall the territory designated (- ''Sullivan and Edinger Annex" be ( YES annexed to the City of Santa Ana?( NO SECTION 3. That there shall be one voting precinct, consist- ing 'of those portions of Diamond l, Diamond 2 and Diamond 3 precints lying within the territory hereinbefore described, and that the place at which polls will be open for this election in this consoli- dated precinct will be at Diamond School-Hallway, located at 24o5 West Edinger Street, Santa Ana, California, a place commonly used for voting within said territory. SECTION 4- The Precinct Board of said precinct shall consist of two Judges and one inspector. The election ~f~cers in said precinct shall be those named on the document headed "NOTICE OF ELECTION OFFICERS AND P0~!NG PLACES" to be adopted by the City Council by Resolution. 'l~ne Clerk of theCouncil is hereby authorized to find ~nd appoint substitutes for any election officer thereby appointed who is unable or unwilling to act. Precinct ~fficers shall receive the following compensation: The inspector, $21.00, aud each of the Judges, $18.00, for their work as such officers; owners of privately owned polling places shall receive the sum of ~9.00 for the use of each polling place. SECTION 5. Said election shall be held and conducted in accordance with the laws regulating municipal elections, the election code of the State of California insofar as the same are applicable to this election, polls shall be open at ? shall be kept open until ? polls shall be closed. and the Annexation Act of 1913. The A.M. on the day of said election, and P.M. of said day, at which time the SECTION 6. The Clerk of the Council shall cause to be pub- lished a NOTICE OF ELECTION at least once a week for four week prior to March 10, 1959, inanewspaper of gener~ circulation -3- printed and published outside of the City of Santa Ana, but in the County of Orange, and a NOTICE OF ELECTION OFFICERS AND POLLING PLACES shall be publishedf~m~'~m%s, at least a week apart, the IU%'~ publication to be completed prior to March ~9, 19~9, in a newspaper meeting the requirements set out above. SECTION 7. This 0Pdinance shall take effect upon the date of publication. PASSED AND ADOPTED by the City Council of the City of Sauta its regular meeting held on the 19th day of January, 19~9.
