HomeMy WebLinkAboutNS-704ORDINANCE NS-704 AMENDING SECTION 2612 OF PART 1, CHAPTER 6, ARTICLE II OF THE SANTA ANA MUNICIPAL CODE REGULATING DISPOSAL OF UNCLAIMRD PROPERTY THE CITY COUNCIL O~ THE CITY OF DANTA ANA DO~ ODi)AIN Aa FOLLOWS: SECTION 1: That Section 2612 of the Santa Aha Municipal Code is hereby amended to read as follows: SECTION 2612. Disposal of Unclaimed Property. Whenever unclaimed property found, recovered or held by the Police Department shall accumulate to the point where the Chief of Police desires to dispose of the same, it may be sold after cc~plying with the provisions of Section 1873 of the Civil Code of the State of California as the same now exists or may hereafter be amended, and provisions of this Section shall not prevail insofar as they may be inconsistent with State statutes. Such property must be held by the Police Department for at least six (6) months, except unclaimed bicycles shall be held for a period of at least three (3) months. Such property must be sold at public auction to the highest bidder. Notice of such sale shall be given by the Chief of Police at least five (5) days before the time fixed for sale by publication once in the newspaper publishing City legal notices. Property shall be returned to finder on demand if he has complied with the requirements of the Civil Code governing the duties and obligations of a finder, and no such property shall be sold without giving five (5) days notice by mail to the person turning it in, if such person gave an address. After said notices are given, the sale shall be con- ducted by the Purchasing Agent or, with the approval of the City Manager, some other City employee or employed professional auctioneer. Property for which no bid is made at such sale may be given to a nonprofit charitable corporation or destroyed as the Chief of Police may direct. SECTION 2: That this Ordinance shall take effect thirty (30) days from and after the date of its adoption.
