ORDINANCE NS-986 AMENDING THE SANTA ANA <br />MUNICIPAL CODE BY AMENDING SECTIONS 6382.2 <br />AND 6384.1 THEREOF CONCERNING STANDARDS FOR <br />DRIVER PERMITS AND APPEAL THEREFROM <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: The Santa Ana Municipal Code is hereby amended <br />by amending Sections 6382.2 and 6384.1 of Part 8, Chapter 3, <br />Article VIII thereof to read in words and figures as follows: <br /> <br />Section 6382.2. Consideration of Application and Standards <br /> for Determination. <br /> <br /> On filing an application~ applicant shall be finger- <br />printed, and a check shall be made to determine whether <br />or not applicant has a prior criminal record. Before <br />issuing any temporary permit the Police Department shall <br />check local records, require applicant to pass an examina- <br />tion as to his knowledge of city streets, and determine <br />that applicant possesses a valid and proper driver's license <br />from the State of california. <br /> <br /> No driver's permit shall be issued by the Police Depart- <br />ment to any person <br /> <br />(a) who is under the age of 21; <br /> <br /> (b) subject to apoplexy, fainting, or loss of conscious- <br />ness by reason of chronic medical conditions; <br /> <br />(c) who is addicted to the use of narcotics; <br /> <br /> (d) who is known to have been a user of hypnotic drugs <br />or alcohol to an excessive degree; <br /> <br /> (e) whose driving record indicates five (5) violations <br />of traffic laws involving moving vehicles within two years <br />preceding the date of application; <br /> <br /> (f) who has wilfully furnished false information on his <br />application or omitted to furnish all information requested <br />on said application form; <br /> <br /> (g) who has been convicted for driving while under the <br />influence of intoxicating liquor or narcotic drugs, or both, <br />within five (5) years of the date of application; or <br /> <br /> (h) who has been convicted of a felony within five (5) <br />years preceding the date of application. <br /> <br />The foregoing disqualifications are subject to appeal to the <br />City Council as provided in Section 6384.1 of this part. <br /> <br />Section 6384.1. Appeal. <br /> <br /> Any applicant who is refused a permit, or any driver <br />whose permit is suspended or revoked, may appeal such action <br />to the city Council by filing within thirty (30) days after <br />such suspension, revocation, or denial a written statement <br />of his reasons why the City Council should reverse the <br />action from which the appeal is taken. The Notice of Appeal <br />shall be filed with the Clerk of the Council and one copy <br />thereof shall be served on the Chief of Police. Said <br /> <br />-1- <br /> <br /> <br />
