HomeMy WebLinkAboutNS-0986ORDINANCE NS-986 AMENDING THE SANTA ANA MUNICIPAL CODE BY AMENDING SECTIONS 6382.2 AND 6384.1 THEREOF CONCERNING STANDARDS FOR DRIVER PERMITS AND APPEAL THEREFROM THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The Santa Ana Municipal Code is hereby amended by amending Sections 6382.2 and 6384.1 of Part 8, Chapter 3, Article VIII thereof to read in words and figures as follows: Section 6382.2. Consideration of Application and Standards for Determination. On filing an application~ applicant shall be finger- printed, and a check shall be made to determine whether or not applicant has a prior criminal record. Before issuing any temporary permit the Police Department shall check local records, require applicant to pass an examina- tion as to his knowledge of city streets, and determine that applicant possesses a valid and proper driver's license from the State of california. No driver's permit shall be issued by the Police Depart- ment to any person (a) who is under the age of 21; (b) subject to apoplexy, fainting, or loss of conscious- ness by reason of chronic medical conditions; (c) who is addicted to the use of narcotics; (d) who is known to have been a user of hypnotic drugs or alcohol to an excessive degree; (e) whose driving record indicates five (5) violations of traffic laws involving moving vehicles within two years preceding the date of application; (f) who has wilfully furnished false information on his application or omitted to furnish all information requested on said application form; (g) who has been convicted for driving while under the influence of intoxicating liquor or narcotic drugs, or both, within five (5) years of the date of application; or (h) who has been convicted of a felony within five (5) years preceding the date of application. The foregoing disqualifications are subject to appeal to the City Council as provided in Section 6384.1 of this part. Section 6384.1. Appeal. Any applicant who is refused a permit, or any driver whose permit is suspended or revoked, may appeal such action to the city Council by filing within thirty (30) days after such suspension, revocation, or denial a written statement of his reasons why the City Council should reverse the action from which the appeal is taken. The Notice of Appeal shall be filed with the Clerk of the Council and one copy thereof shall be served on the Chief of Police. Said -1- appeal shall show applicant's current address. The Clerk of the Council shall set such appeal for hearing on the first Council meeting date occurring more than three (3) days following the date of filing the same and shall send notice thereof to the Chief of Police and to the applicant at the address shown on his appeal statement, both notices to be mailed at least three (3) days before said hearing. If the reason given for denial of the permit was con- viction of driving under the influence of intoxicating liquor or narcotic drugs within five (5) years of the application, the City Council, at its discretion, may ~ reverse the decision of the Chief of Police if the said conviction was three or more years prior to the hearing on appeal before the Council and if good cause is shown for the granting of the permit. SECTION 2: That this ordinance shall take effect thirty days from and after the date of its adoption.
