HomeMy WebLinkAboutNS-1003ORDINANCE NS-1003 AMENDING THE SANTA ANA MUNICIPAL CODE BY AMENDING SECTIONS 9-136 AND 9-163 OF DIVISION 1, ARTICLE VI THEREOF RELATING TO FIRE DEPARTMENT THREE-PLATOON SYSTEM WHEREAS, the Fire Department of the City of Santa Ana has adopted a three-platoon system and certain amendments are necessary to Sections 9-136 and 9-163 of the Santa Ana Municipal Code to provide for this change; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code is hereby amended by amending Section 9-136 thereof to read in words and figures, as follows: Sec. 9-136. Same--Shift personnel. Full-time employees whose regularly scheduled days off are other than Saturday and Sunday shall be entitled to holiday benefits as provided in section 9-135 to be scheduled by the department head. Fire department employees who are regularly at their place of work more than forty (40) hours during a week shall be entitled to five (5) work shifts off during the year in lieu of holidays, to be scheduled by the fire chief. Fire department uniformed personnel working a forty (40) hour week and sworn police personnel who do not take holidays as they occur shall be entitled to twelve (12) working days off during the year in lieu of holidays, to be scheduled by the department head. In the case of sworn police personnel, five (5) of these days shall be taken in conjunction with vacation, to be scheduled by the department head. All other employees of city departments who do not take holidays as they occur shall be entitled to eight (8) working days off during the year in lieu of holidays, to be scheduled by the department head. An employee entitled to time off in lieu of holidays shall receive that time off in proportion to his service at full pay in such capacity during the year. SECTION 2: That the Santa Ana Municipal Code is hereby amended by amending Section 9-163 thereof to read in words and figures, as follows: Sec. 9-163. Limit. Sick leave with pay may be accumulated to a total of one hundred sixty (160) working days, except as otherwise provided by state law; provided, fire department employees who are regularly at their place of work more than forty (40) hours during a week may accumulate a total of one hundred seventy-four (174) working days in order that the maximum amount of sick leave to be accumulated by them shall be equivalent to that of other employees. In the case of the fire department employees, sick leave shall be charged at the rate of one day for each twelve (12) hours of a regularly scheduled shift. Absence of less than two (2) hours, or less than three (3) hours in the case of such firemen, shall be charged as one-quarter (1/4) day. SECTION 3: That this Ordinance shall take effect thirty days from and after the date of its adoption.
