MUNICIPAL CODE BY REPEALING SUBSECTION 134
OF SECTION 21-72 THEP~EOF AND ADDING ARTICLE IV
TO CHAPTER 35 THEREOF TO PROVIDE FOR THE
PAYMENT OF FEES IN CONNECTION WITH THE
CONSTRUCTION OF RESIDENTIAL UNITS, THE DEPOSIT
OF SUCH FEES IN THE RECREATION AND PARKS FUND,
AND THE~.USE OF SUCH FEES FOR PUBLIC PARK AND
RECREATIONAL PURPOSES IN ACCORDANCE WITH THE
GENERAL PLAN
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That Subsection 134 of Section 21-72 of the
Santa Ana Municipal Code is hereby repealed.
SECTION 2: That Chapter 35 of the Santa Ana Municipal Code
is hereby amended by adding Article IV to Chapter 35 thereof to
read in words and figures, as follows:
ARTICLE IV. RESIDENTIAL DEVELOPMENT FEE
Sec. 35-108. Purpose.
(a) The City of Santa Ana is divided into eleven (11) Local
Park Acquisition and Development Areas. Development of local
parks within said Local Park Acquisition and Development Areas
will require the construction of local park and recreation
facilities ~fficient~to pro¥ide two ~(2) acres of such facilities
Within each area per one thousand (1000) population in said area.
(b) Fees paid under the requirements of Section 35.110 shall be
placed in a special fund to be known as the "Park Acquisition
and Development Fund", which fund shall carry area designations.
A separate fund is established and shall be maintained for each
Local Park Acquisition and Development Area and shall be
established as an accounting fund upon the receipt of the first
fees paid for each of said local areas. Moneys in each such
fund shall be expended for the construction of local park and
recreation facilities within the area to which the fund relates.
In the event the area to which the fund relates meets the
standard of two (2) acres of such facilities per one thousand
(1,000) population, and will meet such criterion following all
developments for which fees have been collected, any moneys
remaining in such fund may be diverted by the City Manager, with
the consent of the City Council, either to the development of
city-wide park and recreation facilities or to the development
of local park and recreation facilities in other local areas
in which the two (2) acre per one thousand (1000) population
standard has not been met.
(c) The Local Park Acquisition and Development Areas shall
contain all territory as shown, and said areas are bounded as
shown on the eleven (11) separate maps which are on file in the
office of the Clerk of the Council and which are by reference
made a part hereof, each of which said maps bears the name of
one of said areas and clearly describes the exterior boundaries
of said area, and each of said areas is fixed as shown on the
map bearing the name and number of said Local Park Acquisition
and Development area.
(d) When an existing Local Park Acquisition and Development Area
is amended to add territory thereto or a new area is created and
such amendment has been in effect for a period of thirty (30)
days, all provisions of Sections 35.110, 35.111, and 35.112
shall apply to the territory so added as though said territory
had been in a local park acquisition and development area on
the effective date hereof.

Sec. 35-109. Definitions.
For the purpose of this Article, the words defined in this
Section shall have the meanings assigned to them:
RESIDENTIAL UNIT: A single family dwelling, a dwelling
unit in a complex, apartment house or dwelling group, and any
other place designed for human occupancy which contains a
kitchen, and any space in a mobile home park designed or
intended for a house trailer, mobile home, camper, or similar
vehicle. The term "residential unit" specifically excludes any
building or structure designed or intended to be occupied or
used for business or commercial purposes, such as sleeping
rooms in hotels and motels without kitchens or kitchen facilities.
MOBILE HOME PARK: Any area where one or more lots or spaces
are rented or held out for rent to be occupied by a house
trailer, mobile home, camper or similar vehicle.
NET NEW RESIDENTIAL I/NIT(S): Any increase in the number of
residential units constructed on any given piece of real
property.
Sec. 35-110. Fees.
Any person adding net residential units, as before defined,
in the City of Santa Ana shall pay to the City the following
fees:

$150.00 for each single family residential unit.
$75.00 for each apartment unit containing not more
than one bedroom, and $35.00 for each additional
bedroom.
$100.00 for each new mobile home park pad.
Sec. 35-111. Payment of Fees.
The fees prescribed in Section 35.110 shall be due and
payable upon application to the City for a building permit
for any construction which adds net residential units, as
hereinbefore defined, or mobile home park pad. No building
permit shall be issued until such fees are paid.
Sec. 35-112. Refunds.
Any tax paid to the City under this Chapter for any
residential unit or any space in a mobile home park which is
not constructed shall be refunded upon application of the
tax payer and a showing to the satisfaction of the Director of
Finance that the residential unit or space in a mobile home
park has not been constructed.
SECTION 3: That this Ordinance shall take effect sixty (60)
days from and after the date of its adoption.
PASSED AND ADOPTED by the City Council of the City of Santa
Ana at its regular meeting held on the 18th day of May, 1970.

boundary t'o the junction with the Santa Ana River, then south-

south along the centerline of Standard to the intersection

Beginning at the intersection of Warner Avenue and the Newport
Freeway, then southeast along the centerline of Warner Avenue
to the intersection with Redhill Avenue,then southwest along
the centerline of Redhill to the intersection with Alton
Avenue, then northwest along the centerline of Alton to the
intersection with the Newport Freeway, then northeast along
the Newport Freeway to the intersection with Warner Avenue.
