HomeMy WebLinkAboutNS-1111ORDINANCE NS-1111 AMENDING T}{E SANTA ANA MUNICIPAL CODE BY ADDING SECTION 9-169 REGARDING PAYMENT FOR UNUSED SICK LEAVE AND BY AMENDING SECTION 9-132 REGARDING LONGEVITY VACATION THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code is hereby amended by adding Section 9-169 to read in words and figures, as follows: Section 9-169. Payment for Unused Sick Leave Upon retirement, an employee who meets the following conditions is eligible for payment for a portion of the unused sick leave which he has accumulated: (1) the employee has been credited for retirement purposes with a minimum of ten years of cumulative service with the City of Santa Ana; and (2) retirement under the City's contract with the Public Employees' Retirement System of the State of California shall be a service retirement, as distinguished from a disability retirement. Such employee shall be entitled to payment for one-third (1/3) of the total sick leave benefit credited to his account upon his effective date of retirement and at the rate of pay effective on that date. Payment may be received in either a lump sum amount, or by request of the employee, payment may be deferred and distributed in equal pro- portions on an annual basis for a period of up to five years. A lump sum payment shall be made to the beneficiaries of any eligible employee whose death occurs while an active employee of the City in the amount of one-third (1/3) of the total sick leave benefit credited to his account at the time of his death and at the rate of pay effective on that date. SECTION 2: That Section 9-132 of the Santa Ana Municipal Code is hereby amended to read in words and figures, as follows: Section 9-132. Lonsevity Vacation Each permanent employee is granted additional working days of vacation leave with pay for each completed year of full-time, continuous City service as set forth in the following table. This additional vacation shall be designated longevity vacation. For uniformed members of the fire department assigned to the 24-hour shift schedule, the working day granted is a twelve-hour day. A period of earlier service does not apply toward longevity vacation accumulation when an employee has had a break in continuous service, unless the break in service is concluded by re-appointment, as provided in Section 9-114, or by re-employment within two years at a higher level classification in the former occupa- tional field. Leave of absence without pay, as provided in Section 9-141 or 9-164, does not constitute a break in continuous service as used in this section; however, the leave of absence period shall not be applied toward the accumulation of longevity vacation. Absence on military leave followed by reinstatement, as provided in Section 9-116, does not constitute a break in service, and the period of absence on such military leave shall be applied toward the accumulation of longevity vacation. SECTION 3: The new longevity vacation schedule estab- lished by the amendment to Section 9-132 shall apply to anniversary in-service dates that occur between January 1, 1972, and the effective date of this Ordinance only if the individuals affected remain as city employees on such effective date. SECTION 4: That the Clerk of the Council shall certify to the passage of this Ordinance and cause the same to be published in some daily newspaper printed and published in the city of Santa Ana. SECTION 5: That this Ordinance shall take effect thirty days from and after the date of its adoption and shall not apply prior to such date except as herein specifically provided.
