HomeMy WebLinkAboutNS-1119ORDINANCE NS-1119 REPEALING AND RE-ENACTING SECTION 16-7 OF ARTICLE I, CHAPTER 16 OF THE SANTA ANA MUNICIPAL CODE RELATING TO THE AUTHORITY OF PUBLIC OFFICERS OR EMPLOYEES TO ISSUE CITATIONS WHEREAS, the City Council has determined that the Department of Public Works is to have the power to issue citations in their enforcement of garbage, trash, weed ordinances. The Public Works Department has been so restricted under the existing section as to have virtually no citation power at all. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 16-7 of Article I, Chapter 16 of the Santa Ana Municipal Code is hereby repealed and re-enacted to read as follows: Sec. 16-7. Authority of public officers or employees to issue citations. The following designated public officers and employees shall have the power to make arrests or in lieu thereof issue citations as provided by Section 836.5 of the California Penal Code for violations committed in their presence hereinafter provided: (1) The director of public works, the assistant director of public works, the construction engineer and all sanitation inspectors shall have the power to issue citations for any violations of sections 16-1 through 16-4, 16-33, 16-34, and 16-48 of this chapter. SECTION 2: That the Clerk of the Council shall certify to the passage of this Ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 3: That this Ordinance shall take effect thirty days from and after the date of its adoption.
