HomeMy WebLinkAboutNS-1192ORDINANCE NS-1192 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTION 22-5 (c) (d) AND (k) OF CHAPTER 22 OF THE SANTA ANA MUNICIPAL CODE INVOLVING MASSAGE ESTABLISHMENTS. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: Section 1: That Section 22-5 (c), (d), and (k) of the Santa Ana Municipal Code, is hereby amended to read as follows: Section 22-5 (c): Written statements from at least five (5) adults listing the adults' name, address, and phone number, and stating that the appli- cant is of good moral character: Section 22-5 (d): Written proof that the applicant is over the age of eighteen (18) years: Section 22-5 (k): Applicant must furnish a diploma or certificate of graduation from a recognized school or other institution of learning wherein the method, profession, and work of massage technician is taught. The term "recognized school" shall mean and include any school and institution of learning which has for its purpose and teaching the the theory, method, profession or work of massage technicians, which school is approved by the State Superintendent of Public Instruc- tion and complies with the minimum hours of study and length of curriculum as established by the State Department of Education Bureau of School Approvals, or can show current membership in good standing in the California Massage Technician's Association or the American Massage Therapy Association. Schools offering a correspondence course not requiring actual attendance of class shall not be deemed a "recognized school". The City of Santa Ana shall have a right to confirm the fact that the applicant has actually attended classes in a recognized school for aforementioned minimum time periods. Section 2: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitu- tional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be -1- declared invalid or unconstitutional. Section 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affect- ing any of the provisions of such ordinances relating to the collection of any such license or penalty or the penal code provisions applicable to any violations hereof, nor to affect the validity of any bond or case deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance, and all rights and obligations thereunder appurtain- ing shall continue in full force and effect. Section 4: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. Section 5: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
