NS-l194 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA PERTAINING TO THE ENFORCEMENT OF CER- TAIN PARKING REGULATIONS IN PARKING FACILITIES WITHIN THE CITY OWNED AND OPERATED BY JOINT POWERS AGENCIES OF WHICH THE CITY IS A MEMBER THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The City Council finds that Santa Ana is a member of the Orange County Civic Center Authority, a joint powers agency established under the provisions of Section 6500 and following of the Government Code; that through said Authority Santa Ana and the County of Orange jointly own and operate parking facilities within the City of Santa Ana in conjunction with the Orange County Civic Center, which in- cludes the Santa Ana City Hall and Police Facilities Building; that there is a need to enforce parking regulations within such facilities in order to maintain public safety and welfare; that the Authority has agreed and requested that certain of the parking regulations within the Santa Ana Municipal Code be applied to and enforced within said facilities by the appro- priate Santa Ana police employees and that such enforcement is authorized by the Vehicle Code. SECTION 2: The Santa Ana Municipal Code is hereby amended by adding a Section 36-147.1 which said Section reads as fol- lows: Sec. 36-147.1. Parking on property of joint powers agencies of which city is a member. Whenever the City has entered into a joint powers agree- ment with any other public entity, Section 36-147 of this code shall apply to any parking facility located within Santa Ana, ow-ned ~o~ operated jointly by the parties to said agreement in the same manner and to the same extent as if the facility were exclusively owned by the city, providing the governing body of said joint authority has first requested such application. SECTION 3: The Santa Ana Municipal Code is hereby amended by adding a Section 36-434.1 which said section reads as follows: Sec. 36-434.1. Same - application to parking facility of joint powers agency of which city is a member. Whenever the City has entered into a joint powers agree- ment with any other public entity, Sections 36-432, 36-433 and 36-434 of this code shall apply to any parking facility located within Santa Ana, owned ,~o~! operated jointly by the parties to said agreement in the same manner and to the same extent as if the facility were exclusively owned by the city, providing the governing body of said joint authority has first requested such application. NS-l194 PAGE TWO SECTION 4: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespectiYe of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 5: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 6: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
