NS-1214 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING ARTICLE II OF CHAPTER 8 OF THE SANTA ANA MUNICIPAL CODE PERTAINING TO THE ADOPTION OF THE UNIFORM BUILDING CODE, 1973 EDITION THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 8-43 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 8-43. Adoption by Reference. There is adopted by the City that certain code known as the Uniform Building Code, 1973 Edition, and the whole thereof, together with the appendices therein and the 1973 Edition of the Uniform Building Code Standards save and except such portions as are deleted by the amendments set forth in this Article, of which said code not less than three (3) copies have been and are on file in the office of ~he Clerk of the Council of the City. The said code is adopted and incorporated as fully as if set forth at length herein as provided for in Section 419 of the Charter of the City, and, subject to all amendments set forth in this Article, shall be in effect within the City of Santa Ana from the effective date of this ordinance. Any provision of this Article amending the "Building Code" or "Uniform Building Code" shall be construed as amending the said adopted code, 1973 Edition, including such provisions enacted prior to the enactment of this ordinance and not thereafter repealed. The said adopted code, 1973 Edi- tion, as thus amended, together with all other provisions of ~his Article, shall be known as the Building Code of the City of Santa Aha. SECTION 2: That the Santa Ana Municipal Code is hereby amended by adding a section to be numbered 8-99, which said section is to read as follows: Sec. 8-99. Building Permit Fees (Section 303 (a)). Section 303(a) of the Building Code is amended by adding a sentence to the end of the first paragraph thereof, to read as follows: EXCEPTION: Effective August 22, 1974, for all applica- tions for building permits made subsequent thereto for new hotels, motels, apartment houses, and dwellings other than detached single-family dwellings, the building permit fee shall be one hundred twenty percent (120%) of the fee set forth in Table No. 3-A. SECTION 3: That Section 8-100 of the Santa An~ Municipal Code is amended to read as follows: Sec. 8-100. Application Processing and Plan Checking Fees. Section 303(b) of the Building Code is amended to read as follows: ORDINANCE NO. NS-1214 PAGE TWO 303(b). ADplication Processing and Plan Checking Fees. An application processing and plan checking fee shall be paid ~o the Building Official at the time of submitting plans and specifications for checking. Said fees for buildings of Groups I and J Occupancies shall be one half (1/2) of the building permit fees. Fees for all other buildings shall be sixty-five percent (65%) of the building permit fees. EXCEPTION: When repetitious models for Group I Occu- pancies in a residential housing tract are submitted at one time, such fee shall be paid only for each different model, and one half (1/2) of such fee for each repetition of the model plan. Where plans are incomplete or changed, so as to require additional plan checking, an additional fee shall be paid to the Building Official based upon the value of construction of the proposed change or redesign. In establishing said fee, no allowance for a decreased valuation shall be permitted due to the replacement, omission and or lessening of any mem- ber or portion of the building shown in the original plans. Said fee may be waived when in the opinion of the Building Official the additional fee is not warranted. No additional fees shall be charged for checking corrections required by the Building Official. SECTION 4: That Section 8-101 of the Santa Ana Municipal Code is hereby repealed. SECTION 5: That Section 8-102 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 8-102. Reinspection fee (Section 303(d)). Section 303(d) of the Building Code is amended to read as follows: (d) Reinspection Fee. When any reinspection is required due to the negligence of the permit holder, his agent, or other responsible person, or due to the failure of said par- ties to comply with previous correction instructions, a fee of ten dollars ($10.00) may be charged by the Building Offi- cial prior to each such reinspection. SECTION 6: That sections 8-158, 8-200, and 8-260 of the Santa Ana Municipal Code are hereby repealed. SECTION 7: That the Santa Ana Municipal Code is hereby amended by adding two sections, to be numbered 8-180 and 8-190, which said sections read as follows: Sec. 8-180. Sound Transmission Control (Appendix Chapter 35). The Uniform Building Code is amended by deleting the provisions pertaining to Chapter 35 in the Appendix thereof. Sec. 8-190. Elevators, Dumbwaiters, Escalators and Moving Walks ( Appendix Chapter 51) The Uniform Building Code is emended by deleting the pro- visions pertaining to Chapter 51 in the Appendix thereof. MALONE, do hereby certify that I am the Clerk of the Council of the City of Santa Ana; that the fore- going Ordinance was introduced to said Council at its regular meeting held on the 17th day of June , 1974, and was again considered by said Council at its meeting held nn the 1st day of July , 1974, and was at said meeting passed and adopted by the following vote, to wit: AYES, NOES, COUNCILMEN: Griset, Ward, Markel, Garthe, Yamamoto, Evans COUNCILMEN: None ABSENT, COUNCILMEN: Patterson CLERK OF THE COUNCIL APPROVED AS TO FORM: ORDINANCE NO. NS-1214 PAGE THREE SECTION 8: If any section, subsection, sentence, clause, phrase or portion of this nrdinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 9: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordi- nances relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case de- posit in lieu thereof, required to be posted, filed or depo- sited pursuant to any ordinance, and all rights and obliga- tions thereunder appertaining shall continue in full force and effect. SECTION 10: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 11: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
