NS-1222 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA PROVIDING FOR A SANITATION CHARGE UPON THE USE OF SANITATION FACILITIES AND SERVICES AND AMENDING CHAPTER 35 OF THE SANTA ANA MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code, is hereby amended by adding an article to Chapter 35, Article VII, consisting of Sections 35-200 through 35-249, which said article reads as follows: Sec. 35-200. Purpose The purpose of this article is to provide a revenue for the general operation of the City and is not intended for regulation. Sec. 35-201. Establishment of a Service Charge The City shall make a monthly service charge to each residen- tial, commercial, industrial, manufacturing or other unit which is located within any sewer district or district serviced by a public sewer for the maintenance, construction or reconstruction of the sewage collection system, street cleaning or any other general opera- tion of the City. Such service charge shall be an amount equal to the following schedule: 1. For each structure containing one through four dwelling units, the sum of $.50 per month per dwelling unit. 2. For each structure containing five or more dwelling units, the sum of ~.00 per month. 3. For each commercial, industrial and manufacturing unit, the sum of $4.00 per month. 4. Those units located within the City of Santa Ana and pur- chasing water from sources other than the City, shall be billed by the City at the same rate as designated in paragraphs 1 through 3 of this Section. Sec. 35-202. Persons Obligated The customer of record or occupant of each place or premise shall be liable for payment of all charges as set forth in this article. Should the customer of record or occupant of any place or premise fail to pay all such charges before the sum becomes delinquent, as provided in Section 39-23 of the Santa Ana Municipal Code, then in either of such events the property owner of record of such place or premise shall be liable for the payment of all such charges. Sec. 35-203. Payment of Sanitation Bills and Penalties (a) Date Payment Due: Sanitation bills, charges and penalties are due and payable at the Department of Finance in the City Hall on the date of billing and become delinquent fifteen (15) days after the date of such billing. (b) Penalties: A penalty of ten percent (10%) shall be assessed on all unpaid sanitation bills thirty (30) days after the billing date. No penalty, however, will accrue until thirty (30) days after the date that the statement has been deposited with the United States Postal Service, properly addressed and prepaid postage affixed thereto. -1- SECTION 2: The sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional, invalid, illegal or unenforceable for any reason, by the valid judgment or decree of a court of competent jurisdiction, such unconstitutionality, invalidity, illegality or unenforceability shall not affect any of the remain- ing phrases, clauses, sentences, paragraphs and sections of this ordinance. The City Council of the City of Santa Ana hereby de- clares that it would have adopted this ordinance and each section, paragraph, sentence, clause, phrase or portion thereof irrespec- tive of the fact that any one or more sections, paragraphs, sen- tences, clauses or phrases be declared invalid or unconstitutional. SECTION 3: The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published within fifteen (15) days after its adoption in one issue of the Santa Ana Register. SECTION 4: This ordinance shall take effect October 1, 1974. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its adjourned regular meeting held on the 22nd day of July, 1974.
