NS-1223 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADDING SECTION 10-40 TO THE SANTA ANA MUNICIPAL CODE PERTAINING TO THE MAKING OF FALSE STATEMENTS OR REPORTS TO CITY OFFICIALS REGARDING CITY OFFICERS OR EMPLOYEES THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code is hereby amended by adding a section to be numbered 10-40 which said section reads as follows: Sec. 10-40. Filing False Statements Regarding City Officers of Employees Prohibited Every person who, having been advised of the provisions of this section, signs a w~ten statement declaring the con- tents thereof to be true, and causes the same to be filed with any department of the City of Santa Ana, for the purpose of causing an ~nvestigation to be made into the activities or conduct of any City officer or employee, knowing such state- ment to be false or without a reasonable belief in the truth thereof when such statement is in fact false, is guilty of a misdemeanor. SECTION 2: It is the intent of the City Council of the City of Santa Ana that this ordinance not be construed as to apply to those situations regulated by Penal Code ~148.5 and 148.3 SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordi- nances relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case de- posit in lieu thereof, required to be posted, filed or depo- sited pursuant to any ordinance, and all rights and obliga- tions thereunder appertaining shall continue in full force and effect. SECTION 5: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana.
