NS-12~3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SECTION 10-42 OF THE SANTA ANA MUNICIPAL CODE PERTAINING TO FEES FOR FINGER PRINTING SECTION 1: Section 10-42 of the Santa Ana Municipal Code is amended to read as follows: Sec. 10-42. Fingerprint fees. Every person requesting that his fingerprints be processed by the City of Santa Ana shall accompany such request with pay- ment of the appropriate fee as established from time to time by resolution adopted by the City Council. This fee shall not be required of the following persons: (1) Applicants for employment with the City of Santa Ana. (2) Applicants who are amnesia victims and are attempt- ing to establish their identity. (3) Applicants who are complying with any of the follow- ing statutes: California Penal Code Section 290, 1026, 1203.1, 1203.45, 1370, 11113 and California Health and Safety Code Section 11850. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the deci- sion of any court of competent iurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 3: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana. SECTION 4: This Ordinance shall take effect thirty (30) days from and after the date of its adoption.
