AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA PROVIDING FOR THE
APPOINTMENT OF A MAYOR PRO TEM; DECLARING
THE NECESSITY THEREFOR; AND ESTABLISHING
POWERS IN CONNECTION THEREWITH
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: The City Council of the City of Santa Ana
hereby finds and declares that because of the great demands
upon the Mayor and the Vice Mayor for appearances before
public groups, State, County and local governmental agencies,
and other appearances required of the Mayor in his official
capacity, it becomes necessary that the Mayor have the power
to appoint a Mayor Pro Tem to act in his stead.
The City Council further finds and declares that it is
necessary that the powers of the Mayor Pro Tem to act on behalf
of the City be designated and the appropriate limitations placed
thereon.
Accordingly, the following sections are added to Chapter
2, entitled Administration, Article II, entitled "City Council":
SECTION 2:
Section 2-101.1 Appointment of Mayor Pro Tem
The ~ayor shall have the right to appoint a Mayor Pro
Tem when, in his judgment, neither he nor the Vice mayor are
able to attend to any public function requiring the Mayor's
presence, either in his official or unofficial capacity.
Section 2-101.2 Eligibility
Only duly elected and acting City Councilmen of the
City of Santa Ana shall be eligible to be appointed as Mayor
Pro Tem. Appointments shall be made in a successive rota-
tional order from a list composed for such purpose at the
first meeting of the City Council following the adoption of
this ordinance. The list shall be composed of the names of
all the duly elected and acting members of the City Council
drawn in random order. The list shall be revised following
each election of the City Council to reflect such changes ~n
the composition of the City Council. This shall be accomplished
by deleting from said list the names of those persons not
re-elected to office, and adding to the end thereof the names
of such newly elected councilmen.
Section 2-101.3 Powers and Duties
The Mayor Pro Tem shall be the agent of the duly elected
and acting Mayor of the City of Santa Ana, and shall be his
representative for the purpose for which he was appointed, and
his duties and obligations shall be those assigned by the Mayor
with such limitations as the Mayor or City Council shall reason-
ably impose, including limitations on purpose and length of
appointment.

Section 2-101.4 Compensation
The Mayor Pro Tem shall not be entitled to any additional
compensation over and abovethat which is his normal and usual
compensation as a Councilman for the City of Santa Ana. The
Mayor Pro Tem may be reimbursed for reasonable expenses incurred
in the performance of his duties as Mayor Pro Tem.
Section 2-101.5 Designation
once appointed by the Mayor, the Mayor Pro Tem may be
introduced at all public gatherings as the Mayor Pro Tem of the
City of Santa Ana, and shall be afforded all of the rights and
privileges usually afforded the Mayor in similar circumstances.
The Mayor Pro Tem shall be provided with credentials, letters of
introduction, or written authority wherever the same is required,
in order for him to effectively act on behalf of the City of
Santa Ana.
Section 2-101.6 Limitations
The appointment of the Mayor Pro Tem by the duly elected
Mayor of the City of Santa Ana shall in no manner be deemed a
permanent appointment of Mayor Pro Tem, nor shall said appointment
in any manner create any priority for future similar appointments.
The Mayor Pro Tem appointment shall be at the pleasure of the
Mayor and subject to recall by the City Council. The appointment
of a Mayor Pro Tem shall be limited by the Mayor in time and purpose,
and in no circumstance shall extend beyond that time reasonably re-
quired to perform the designated appearance.
SECTION 3: ~If any section, subsection, sentence, clause
phrase or portion of this ordinance is for any reason held to
be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the valid-
ity of the remaining portions of this ordinance. The City Council
of the City of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one
or more sections, subsections, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION 4: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect
the prosecution for violation of ordinances, which violations
were committed prior to the effective date hereof, nor be con-
strued as affecting any of the provisions of such ordinance
relating to the collection of any such license or penalty or
the penal provisions applicable to any violation thereof, nor
to affect the validity of any bond or case deposit in lieu there-
of, required to be posted, filed or deposited pursuant to any
ordinance and all rights and obligations thereunder appertaining
shall continue in full force and effect.
SECTION 5: The Clerk of the Council shall certify to
the passage and adoption of this ordinance and shall cause the
same to be published in the official newspaper of the City of
Santa Ana within fifteen (15) days after its adoption.
SECTION 6: This ordinance shall take effect thirty (30)
days from and after the date of its adoption.
