ORDINANCE NO. NS-1304
AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING
AMENDMENT APPLICATION NO. 738 FILED BY MARY
LOUISE LILY RANNEY, REZONING PROPERTY FROM THE
C2 (GENERAL COMMERCIAL) DISTRICT TO THE R1
(SINGLE-FAMILY RESIDENCE) DISTRICT, AND AMENDING
SECTIONAL DISTRICT MAP 10-5-10
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No. 738,
filed by Mary Louise Lily Ranney to rezone property generally
located south of Seventeenth Street and west of Fairview Street
and the Santa Aha River in the City of Santa Ana, from the C2
(General Commercial) District to the R1 (Single-family Residence)
District, and said Planning Commission has recommended approval
of said application; and
WHEREAS, the City Council regularly held a public hear-
ing on said rezoning on published notice as required by law, and
does now find that the public necessity, convenience, and gene-
ral welfare require said property be reclassified from the C2
(General Commercial) District to the R1 (Single-family Residence)
District, and that such new classification will not be detrimen-
tal to the surrounding property;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property in the City of Santa
Ana, County of Orange, California, described as folloWs:
That portion of Section 10 in the Township 5 South,
Range 10 West, in the Rancho Las Bolsas, City of
Santa Ana, County of Orange, State of California,
as shown on a map recorded in Book 51, page 12 of
Miscellaneous Maps, in the office of the County
Recorder of said County, described as follows:
Beginning at a point on the north line of said
Section 10, distant West 520.00 feet from the
Northeast corner of said Section 10, thence South
436.00 feet parallel with the East line of Said
Section 10, thence West along a line parallel to
the north line of said Section 10 a distance of
144.12 feet, thence Northerly in a straight line
to a point of intersection with the north line
of said Section 10 that is distant 661.85 feet
west of the northeast corner of said Section 10,
thence easterly along said north line 141.85
feet to the point of beginning, EXCEPTING THERE-
FROM the North 210.00 feet of said parcel;
is hereby reclassified from the C2 (General Commercial) District
to the R1 (Single-family Residence) District, and that SeCtional
District Map 10-5-10 is hereby amended to show said reclassifi-
cation, in accordance with Exhibit A.A. 738-A.

SECTION 2: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any reason
held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance. The
City Council of the City of Santa Ana hereby declares that it
would have adopted this ordinance and each section, subsection,
sentence, clause, phrase or portion thereof irrespective of the
fact that any one or more sections, subsections, sentences, clauses,
phrases or portions be declared invalid or unconstitutional.
SECTION 3: Neither the adoption of this ordinance
nor the repeal hereby of any ordinance shall in any manner affect
the prosecution for violation of ordinances, which violations
were committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating
to the collection of any such license or penalty or the penal
provisions applicable to any violation thereof, nor to affect
the validity of any bond or cash deposit in lieu thereof, required
to be posted, filed or deposited pursuant to any ordinance and
all rights and obligations thereunder appertaining shall continue
in full force and effect.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its regular meeting held on the
