NS-1307 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 9-5.1 TO THE SANTA ANA MUNICIPAL CODE, RELATING TO INELIGIBI- LITY FOR EMPLOYMENT FOR CRIMINAL CON- DUCT THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: The Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 9,5.1, which said section reads as follows: Section 9-5.1. Criminal Conduct - Ineligibility for Employment. Except as otherwise hereinafter provided, no person convicted of a felony or misdemeanor involving moral turpitude shall be eligible for employment in the excepted or competitive service of the City; provided, however, that the appointing authority may disregard such conviction if he finds and determines that mitigating circumstances exist, such as, but not limited to, evidence of rehabilitation, length of time elapsed since such conviction, the age of such person at the time of conviction, or the fact that the position applied for or occupied by such person is unrelated to such conviction. The City Manager, Assistant City Manger, Deputy City Manager for Administrative and Support Services, Personnel Director, Chief of Police, City Attorney, and each appointing authority of the City, are hereby authorized to have access to the "State Summary Criminal History Information" as provided for in Section 11105 of the Penal Code of the State of California. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the valid- ity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adop- ted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsection, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
