ORDINANCE NO. NS-1359
AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING
AMENDMENT APPLICATION NO. 748 FILED BY LEVITT-
WEST AND WILLIAM LYON COMPANY REZONING PROPERTY FROM
THE C4 (PLANNED SHOPPING CENTER) DISTRICT TO THE
R2-PRD (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT,
AND AMENDING SECTIONAL DISTRICT MAP 27-5-10
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No. 748,
filed by Levitt-West and William Lyon Co. to rezone property,
generally located on the south side of Warner Avenue between
Fairview and Greenville streets from the C4 (Planned Shopping
Center) District to the R2-PRD (Planned Residential Development)
District, and said Commission has recommended approval of said
application; and
WHEREAS, the City Council regularly held a public hear-
ing on said reclassification on published notice required by law,
and does now find that the public necessity, convenience, and
general welfare require that the said property be reclassified
from the C4 (Planned Shopping Center) District to the R2-PRD
(Planned Residential Development) District, and that such new
classification will not be detrimental to the surrounding property;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
SECTION l: That the real property in the City of Santa
Ana, County of Orange, California, des:cribed as:
That certain land in the City of Santa Ana, County
of Orange, State of California, shown as Parcels 1
and 2 on a map filed in book 36, page 46 of Parcel
Maps in the Office of the County Recorder of said
County; except therefrom that portion thereof lying
westerly of the following described line: beginning
at a point on the south line of said Parcel 1,
N88o 59~'45"E 170.00 feet from the southwest corner
of said Parcel l; thence parallel with the west
line of said Parcel I NI°OO'15"W 527.77 feet; thence
N88°59'45"E 175.00 feet; thence Nl°OO'lS"W 180.00
feet to the north line of said Parcel 1,
is hereby reclassified from the C4 (P!anned Shopping Center) Dis-
trict to the R2-PRD (Planned Residential Development) District,
and that Sectional District Map 27-5-10 is hereby amended to show
said reclassification, in accordance with Exhibit A.A. 748-A.
SECTION 2: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect
the prosecution for violation of ordinances, which violations
were committed prior to the effective date hereof, nor be con-
strued as affecting any of the provisions of such ordinance re-
lating to the collection of any such license or penalty or the
penal provisions applicable to any violation thereof, nor to
affect the validity of any bond or cash deposit in lieu thereof,
required to be posted, filed or deposited pursuant to any ordi-
nance and all rights and obligations thereunder appertaining
shall continue in full force and effect.
