ORDINANCE NO. NS- 1349
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION NO. 758
FILED BY M. C. NICKEL REZONING PROPERTY FROM
THE R4 (SUBURBAN APARTMENT) DISTRICT TO THE
R1 (SINGLE-FAMILY RESIDENCE) DISTRICT, AND
AMENDING SECTIONAL DISTRICT MAP 27-5-10
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No.
758, filed by M. C. Nickle to rezone property, generally lo-
cated on the west side of Greenville Street between Warner and
Segerstrom Avenues from the R4 ¢Suburban Apartment) District
to the R1 (Single-Family Residence) District, and said Commis-
sion has recommended approval of said application; and
WHEREAS, the City Council regularly held a public hear-
ing on said reclassification on published notice required by
law, and does now find that the public necessity, convenience,
and general welfare require that the said property be reclassi-
fied from the R4 (Suburban Apartment) District to the R1 (Single-
Family Residence) District, and that such new classification
will not be detrimental to the surrounding property;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property in the City of Santa
Ana, County of Orange, California, described as Tract Number
8326, Miscellaneous Maps, Book 381, pages 41-42, Records of
Orange County, is hereby reclassified from the R4 (Suburban
Apartment) District to the R1 (Single-Fa/nily Residence) Dis-
trict, and that Sectional District Map 27-5-10 is hereby amended
to show said reclassification, in accordance with Exhibit A.A.
758-A.
SECTION 2: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.

of California, described as follows:
An alley as shown on a map of the Jenntngs and Fosters Addition to Santa Ana
filed in Book 12, page 75, records of Los Angeles County, said alley being
bounded by Lots $, 6, 13 and 14 of said Addition, said alley also being
bounded by a line parallel to and distant Southerly 30 feet, measured at
right angles, from the Northerly llne of said Lots 5 and 6, said alley
also being bounded by a line parallel to and distant Northerly 6~ feet,
measured at right angles, from the Southerly line o~ said Lots 13 and 14.

EASEMENT AND RIGHT-OF-WAY
Excepting and reserving to the City of Santa
Ana, its successors and assigns, a permanent
easement and right at any time, or from time
to time, pursuant to any existing franchises
or renewals thereof, or otherwise, to construct,
maintain, operate, replace, remove, renew and
enlarge lines of pipe, conduits, cables, wires,
poles, and other convenient structures, equipment
and fixtures for the operation of telegraphic
and telephone lines, and incidental purposes,
including access and the right to keep the property
free from inflammable materials, and wood growth,
and otherwise protect the same from all hazards
in, upon and over the alley or part thereof
proposed to be vacated.
