ORDINANCE NO. NS-1367
AN ORDINANCE OF THE CITY OF SANTA ANA APPROV-
ING AMENDMENT APPLICATION 765 FILED BY HOWARD
G. JACOBS REZONING PROPERTY FROM THE C1
(COMMUNITY COMMERCIAL) DISTRICT TO THE R3
(MEDIUM DENSITY MULTIPLE FAMILY RESIDENTIAL)
DISTRICT AND AMENDING SECTIONAL DISTRICT
MAP 4-5-9.
WHEREAS, the Planning Commission has given notice
of and duly held a public hearing on Amendment Application
No. 765, filed by Howard G. Jacobs to rezone property, gen-
erally located on Catalina Avenue east of Tustin Avenue from
the C 1 (Community Commercial) District to the R 3 (Medium
Density Multiple Family Residential) District, and said Com-
mission has recommended approval of said application; and
WHEREAS, the City Council regularly held a public
hearing on said reclassification on published notice required
by law, and does now find that the public necessity, conven-
ience, and general welfare require that said property be re-
classified from the C 1 (Community Commercial) to the R 3
(Medium Density Multiple Family Residential) District, and
that such new classification will not be detrimental to the
surrounding property; and
?~EREAS, prior to taking this action, the City Council
has reviewed and considered the information contained in Neg-
ative Declaration No. 77-17, and on the basis thereof, finds
that the project will not have a significant adverse effect
upon the environment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property in the City of
Santa Ana, County of Orange, California, described as the
Easterly 105.00 feet of the most northwesterly parcel of land
as shown on a map recorded in Book 57, page 45 of Record of
Surveys, County of Orange, State of California is hereby re-
classified from the C1 (Community Commercial) District to
the R3 (Medium Density Multiple Family Residential) District,
and that Sectional District Map 4-5-9 is hereby amended to
show said reclassification, in accordance with Exhibit A.A.
765-A.
SECTION 2: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any reason
held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this ordin-
ance. The City Council of the City of Santa Ana hereby de-
clares that it would have adopted this ordinance and each
section, subsection, sentence, clause, phrase or portion there-
of irrespective of the fact that any one or more sections,
subsections, clauses or portions be declared invalid or
