AN EMERGENCY ORDINANCE OF THE CITY OF
SANTA ANA AMENDING VARIOUS SECTIONS OF
THE SANTA ANA MUNICIPAL CODE REGULATING
BINGO GAMES TO MAKE SAID SECTIONS COMPLY
WITH STATE LAW, AND STATING THE REASON
FOR ITS URGENCY
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: That Section 10-59 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Section 10-59. Bingo License Required.
No person or organization shall organize, conduct or
operate a bingo game without having first procured and maintained a
license issued by the City of Santa Ana pursuant to the provisions
of this Code.
SECTION 2: That Section 10-59.1 of the Santa Aha Muni-
cipal Code is hereby amended to read as follows:
Section 10-59.1. Organizations Eligible for City License
to Conduct Bingo Games.
(a)
Organizations exempted from the payment of the bank
and corporation tax by Sections 23701 a, 23701 b,
23701 d, 23701 e, 23701 f, 23701 g, and 23701 1 of
the Revenue and Taxation Code and mobile home park
associations and senior citizens organizations are
eligible to apply to the city for a license to con-
duct bingo games in the City of Santa Ana under
the provisions of Section 326.5 of the Penal Code
as amended and the provisions of the Santa Ana Muni-
cipal Code relating to bingo, provided that the
proceeds of such ga~es are used only for charitable
purposes.
(b) Any license issued pursuant to this section shall
be valid for one year from the date of issuance.
SECTION 3: This Council finds that this ordinance is
urgently required as an emergency ordinance for the immediate
preservation of the public peace, health, and safety for the follow-
ing reasons:
In order for this ordinance to properly implement the
constitutional amendment to Section 19 of Article IV of the Califor-
nia Constitution, permitting bingo, which the people of California
approved at the June 1976 primary, and Assembly Bill No. 101, Chap-
ter 271, Statutes of 1977, approved by the Governor July 7, 1977,
filed with the Secretary of State July 8, 1977, as an urgency sta-
tute, it is necessary for this ordinance to take effect immediately.

Therefore, the City Council declares that this ordinance
shall take effect as, and is adopted as, an emergency measure and
is to be enforced from the date of its publication or posting.
