ORDINANCE NO. NS- 1392
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION NO. 775
TO REZONE PROPERTY LOCATED AT 5321 WEST
MC FADDEN AVENUE FROM THE Ri (SINGLE
FAMILY RESIDENCE) DISTRICT TO THE R1-PRD
(SINGLE FAMILY RESIDENCE-PLANNED RESI-
DENTIAL DEVELOPMENT) DISTRICT AND
AMENDING SECTIONAL DISTRICT MAP N0.17-5-10.
WHEREAS, the real property located at 5321 West McFadden
Avenue in the City of Santa Ana and more particularly described
infra, is located within the R1 (Single Family Residence) Dis-
trict, and
WHEREAS, an application has been filed to amend Sectional
District Map. No. 17-5-10 to rezone such real property to the
R1-PRD (Single Family Residence-Planned Residential Development)
District, and
WHEREAS, the Planning Commission has given notice of and
duly held a public hearing on Amendment Application No. 775 to
rezone such real property from the R1 District to the R1-PRD
District and has recommended approval of said application, and
WHEREAS, the City Council regularly held a public hearing
on said reclassification on published notice required by law and
does now find that the public necessity, convenience, and general
welfare require that said property be reclassified from the R1
District to the R1-PRD District, and that the new classification
will not be detrimental to the surrounding property, and
WHEREAS, prior to taking this action, the City Council has
reviewed and considered the information contained in Negative
Declaration No. 77-221, and, on the basis thereof, finds that
the project will not have a significant effect upon the environ-
ment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA
DOES ORDAIN AS FOLLOWS:
Section 1: That the real property situated in the City of
Santa Ana, County of Orange, State of California, generally
located at 5321 West McFadden Avenue, and more particularly de-
scribed on Exhibit A, attached hereto and incorporated by re-
ference herein, is hereby reclassified from the R1 (Single Family
Residence) District to the R1-PDR (Single Family Residence-Planned
Residential Development) District, and that the Sectional District
Map No. 17-5-10 is hereby amended to show said reclassification
in accordance with Exhibit AA 775-A.
Section 2: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity

of the remaining portions of this ordinance. The City Council
of the City of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or
more sections, subsections, clauses or portions be declared in-
valid or unconstitutional.

CO~t4ENCING at the southeast corner of the northeast quarter of Section 17,
Township 5 South, Range l0 West, in the Rancho Las Bolsas, in the City of
Santa Ana, Orange County, California, as shown on map recorded in book 51,
page 12 of Miscellaneous Maps, in the office of the County Recorder of said
county; thence westerly along the south line of said northeast quarter;
south 88o ll' 30" west, 264.17' to the True Point of Beginning.
Thence, continuing along the south line of said northeast quarter, south
88o ll' 30" west, 151.31'; thence, north 0° 40' 06" west, 32g.87'; thence,
north 88o ll' 30" east, 151.31'; thence, south 0° 40' 06" east, 329.87'
to the True Point of Beginning.
