ORDINANCE NO. NS-1398
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION NO. 776
TO REZONE PROPERTY LOCATED AT 309 NORTH
MOUNTAIN VIEW STREET FROM THE A1 (GENERAL
AGRICULTURE) DISTRICT TO THE R2-PRD
(MULTIPLE FAMILY RESIDENCE - PLANNED
RESIDENTIAL DEVELOPMENT) DISTRICT AND
AMENDING SECTIONAL DISTRICT MAP NO.
9-5-10.
WHEREAS, the real property located at 309 North Mountain
View Street in the City of Santa Ana and more particularly
described infra, is located within the A1 (General Agriculture)
District, and
WHEREAS, an application has been filed to amend Sectional
District Map No. 9-5-10 to rezone such real property to the
R2-PRD (Multiple Family Residence - Planned Residential Develop-
ment) District, and
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No. 776
to rezone such real property from the A1 District to the R2-
PRD District and has recommended approval of said application,
and
WHEREAS, the City Council regularly held a public hearing
on said reclassification on published notice required by law
and does now find that the public necessity, convenience,
and general welfare require that said property be reclassified
from the A1 District to the R2-PRD District, and that the
new classification will not be detrimental to the surrounding
property, and
WHEREAS, prior to taking this action, the City Council
has reviewed and considered the information contained in
Negative Declaration No. 77-235, and, on the basis thereof,
finds that the project will not have a significant effect
upon the environment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
Section 1: That the real property situated in the
City of Santa Ana, County of Orange, State of California, generally
located at 309 North Mountain View Street, and more particularly
described on Exhibit A, attached hereto and incorporated by
reference herein, is hereby reclassified from the A1 (General
Agriculture) District to the R2-PRD (Multiple Family Residence -
Planned Residential Development) District, and that Sectional
District Map No. 9-5-10 is hereby amended to show said reclas-
sification in accordance with Exhibit AA 776-A.
Section 2: If any section, subsection, sentence, clause,
phrase ~r portion of this ordinance is for any reason held to

be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance.
The City Council of the City of Santa Ana hereby declares
that it would have adopted this ordinance and each section,
subsection, sentence, clause, phrase or portion thereof ir-
respective of the fact that any one or more sections, subsections,
clauses or portions be declared invalid or unconstitutional.

PARCEL 1: The south half of Lots B and 20, all of Lots 6, 7, 18 and
19, and the north half of Lots 8 and 17, all in Block "A" of Tract
No. 617, Anahurst Square, as shown on a map recorded in Book 22, page
30 of Miscellaneous Map, records of Orange County, California.
PARCEL 2: That portion of the west half of Allen Street {abandoned)
adjoining the south half of Lot 5, all of Lots 6 and 7, and the north
half of Lot 8 in Block "A" of Tract No. 617, Anahurst Square, as shown
on a map recorded in Book 22, page 30 of Miscellaneous Raps, records of
Orange County, California, as abandoned by order of the Board of
Supervisors of Orange County, California, on September 19, 1934, a
certified copy of which order was recorded September 19, 1934, in
Book 703, page 81 of Official Records.
PARCEL 3: Lot 2 of Tract No. 978 as shown on a map recorded in Book 32,
page 48 of Miscellaneous Map, records of Orange County, California.
