ORDINANCE NO. NS-1418
AN ORDINANCE OF THE CITY OF SANTA ANA AMEND-
ING SECTIONS 8-1226, 8-1250, 8-1260, 8-1265,
8-1270, 8-1280, 8-1290, AND 8-1300 OF THE
SANTA ANA MUNICIPAL CODE TO ADOPT THE UNIFORM
SIGN CODE, 1976 EDITION.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That section 8-1226 of the Santa Ana Municipal
Code, is hereby amended to read as follows:
Sec. 8-1226. Adoption by reference.
There is adopted by the City that certain Code known as
the Uniform Sign Code, 1976 Edition, and the whole
thereof, save and except such portions as are deleted
by the amendments set forth in this article, of which
said Code not less than three (3) copies have been and
are on file in the Office of the Clerk of the Council
of the City. The said Code is adopted and incorporated
as fully as if set forth at length herein as provided
for in Section 419 of the Charter of the City, and,
subject to all amendments set forth in this article,
shall be in effect within the City of Santa Aha from
the effective date of this ordinance. Any provision of
this article amending the "Sign Code" or "Uniform Sign
Code" shall be construed as amending the said adopted
Code, 1976 Edition, including such provisions enacted
prior to the enactment of this ordinance and not there-
after repealed. The said adopted Code, 1976 Edition,
as thus amended, together with all other provisions of
this article, shall be known as the Sign Code of the
City of Santa Ana.
SECTION 2: That section 8-1250 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Sec. 8-1250. Prohibiting immoral or unlawful advertising
(Section 102).
Section 102 of the Uniform Sign Code is hereby amended
by adding another paragraph, to read as follows:
No person shall post or display upon any advertising
structure, sky sign, or electric sign, any words or
signs of an obscene, indecent, or immoral nature or any
picture, illustration or delineation of any human
figure in such detail as to offend public morality or
decency; or of any lewd or lascivious act, or any other
matter or thing of any obscene, indecent or i~oral
nature, or offensive to the moral sense; or any murder,
suicide, robbery, holdup, shooting, stabbing, clubbing,
or beating of any human being, wherein any such act is
shown in gruesome detail, or in a revolting manner, or
in any manner objectionable to the moral sense.
SECTION 3: That section 8-1260 of the Santa Ana Municipal
Code, is hereby amended to read as follows:
Sec. 8-1260. Existing Signs (Section 102).
Section 102 of the Uniform Sign Code is hereby amended
by adding another paragraph, to read as follows:
Existing signs authorized and constructed in accordance
with a previous ordinance are exempt from the pro-

visions of chapters 4 through 13, inclusive, provided
that no such sign shall be altered, enlarged, recon-
structed, or repaired (except for normal maintenance)
unless it is made to conform to all requirements of
this article for a new sign.
SECTION 4: That section 8-1265 of the Santa Aha Municipal
Code, is hereby amended to read as follows:
Sec. 8-1265.
Prohibiting advertising on public property
(Section 102).
Section 102 of the Uniform Sign Code is hereby amended
by adding another paragraph, to read as follows:
No person except a public officer or employee in
performance of a public duty shall paint, paste,
print, nail, tack, or otherwise fasten any card,
banner, handbill, sign, poster, advertisement, or
notice of any kind on any curbstone, lamp post, pole,
hydrant, bridge, wall, or tree upon any public street,
or other public place, except as may be required or
permitted by law.
SECTION 5: That section 8-1270 of the Santa Ana Municipal
Code, is hereby amended to read as follows:
Sec. 8-1270. Authority (Section 103(a)).
Section 103(a) of the Uniform Sign Code is hereby
amended to read as follows:
Authority. The director of building safety is hereby
authorized and directed to enforce all the provisions
of this code.
SECTION 6: That section 8-1280 of the Santa Ana Municipal
Code, is hereby a~ended to read as follows:
Sec. 8-1280. Fees (Section 304)
Section 304 of the Uniform Sign Code is hereby amended
to read as follows:
Fees and charges for sign permits and plan checks shall
be established and regulated by resolution of the city
council.
SECTION 7: That section 8-1290 of the Santa Ana Municipal
Code, is hereby amended to read as follows:
Sec. 8-1290. Wall signs (Section 903).
Section 903 of the Uniform Sign Code is hereby amended
to read as follows:
No wall sign shall project more than twelve inches
(12") over public property. If projecting, the bottom
of such sign shall be not less than eight feet (8')
above the level of the sidewalk or grade in%mediately
below.
SECTION 8: That section 8-1300 of the Santa Aha Municipal
Code, is hereby amended to read as follows:
Sec. 8-1300. Projecting signs (Section 1003(a)).
Section 1003(a) of the Uniform Sign Code is amended to
read as follows:

Projection. Signs on Main Street may project over
public property or a legal setback line in accordance
with section 8-1554 of the Santa Ana Municipal Code.
Signs at other locations may project over public
property to a point two feet (2') from the curb line.
If projecting, the bottom of such sign shall be not
less than eight feet (8') above the level of the side-
walk or grade in~nediately below.
SECTION 9: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the de-
cision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of
this ordinance. The City Council of the City of Santa Ana
hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases or
portions be declared invalid or unconstitutional.
SECTION 10: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner
affect the prosecution for violation of ordinances, which
violations were committed prior to the effective date hereof,
nor be construed as affecting any of the provisions of such
ordinance relating to the collection of any such license or
penalty or the penal provision applicable to any violation
thereof, nor to affect the validity of any bond or cash
deposit in lieu thereof, required to be posted, filed or
deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full
force and effect.
