NS-1438 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTION 41-377 OF THE SANTA ANA MUNICIPAL CODE TO PERMIT ARENAS AND OUTDOOR THEATERS AS CONDITIONALLY PERMITTED USES IN THE C2 DISTRICT. The City Council of the City of Santa Ana does ordain as follows: Section .1: That Section 41-377 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-377. Uses permitted. Permitted uses are: (a) All uses permitted in the C1 district, but subject to the conditions, restrictions and limitations of this district. (b) Advertising signs and structures, including billboards. (c) Carnivals and circuses; provided, however, that no such use shall locate or operate longer than ten (10) days within any six-month period on the same parcel. (d) Automotive garages, including body and fender repair, painting, and engine replacement. (e) Blueprinting, phOtoengraving, including all types of reproduction processes. (f) Enclosed storage, except mini-warehouses. (g) Nightclubs, bowling alleys, dance halls, skating rinks, and sports stadiums; provided, that no such establishment selling liquor or beer for consumption on the premises may locate or operate within three hundred (300) feet of any property zoned or used for residential or agricultural purposes without first obtaining a minor exception permit. No minor exception permit shall be required when property within three hundred (300) feet of an existing nightclub, bowling alley, dance hall, skating rink, sports stadium, selling liquor or beer for consumption on the premises, subsequently is zoned or used for residential or agricultural purposes. (h) Equipment rental yards for light machinery. (i) Mental shops. (j) Tire recapping. (k) Wholesale establishments as follows: (1) Automotive equipment, including parts and supplies for machinery. (2) Drugs, chemicals and allied products, but ex- cluding explosives and industrial chemicals. (3) Dry goods and apparel. (4) Food products. (5) Farm products. (6) Electrical and plumbing supplies. (7) Office equipment and supplies. Truck, trailer, tractor and boat sales, both new (1) and used. (m) (n) approved permitted subject to a conditional use permit. (2) Mini-warehouses. (3) Missions. (4) Arenas and outdoor theaters. Research institutions and laboratories. The following uses subject to the issuance of an conditional use permit: (1) All uses permitted in the C1 district that are ORDINANCE NO. NS-1438 PAGE TWO Section 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisidiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses or portions be declared invalid or unconstitutional.
