NS-1542 AN EMERGENCY ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 10-177 TO THE SANTA ANA MUNICIPAL CODE PROHIBITING THE SALE OF PRESSURIZED CANS CONTAINING PAINT TO MINORS AND PROHIBITING POSSESSION OF SUCH CANS IN DESIGNATED PUBLIC PLACES AND STATING THE REASONS FOR ITS URGENCY THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code, is hereby amended by adding a section, to be numbered 10-177, which said section reads as follows: Sec. 10-177 Sale and Possession of Pressurized Paint Cans (a) No person shall sell any pressurized can containing any substance commonly known as paint or dye to anyone under the age of eighteen (18) years and no person under the age of eighteen (18) years shall purchase any pressurized can con- taining paint or dye. (b) No person shall have in his or her possession any pres- surized can containing any substance commonly known as paint or dye while in any public park, playground, swimming pool, recreational facility, or zoo in the City of Santa Ana. This section shall not apply to authorized employees of the City of Santa Ana or an individual or authorized employee of an individual, agency or company under contract with the City of Santa Ana. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordi- nance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sec- tions, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 3: This Council finds that this ordinance is urgently required as an emergency ordinance for the imme- diate preservation of the public peace, health and safety for the following reason: Graffiti is an extremely serious problem within the City and measures must be undertaken immediately to prevent and remove graffiti. ORDINANCE NO. NS-1542 PAGE TWO THEREFORE, City Council declares that this ordinance shall take effect, and be adopted, as an emergency measure and is to be effective from the date of adoption as set forth in the Charter of the City of Santa Ana.
