NS- 1565 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 846 TO REZONE PROPERTY LOCATED ON THE SOUTH SIDE OF FIFTH STREET BETWEEN NEWHOPE STREET AND HARBOR BOULEVARD FROM THE A1 (GENERAL AGRICULTURAL) DISTRICT TO THE R2-PRD (MULTIPLE FAMILY-PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT AND AMENDING SECTIONAL MAP NO. 9-5-10 WHEREAS, the real property located on the south side of Fifth Street between Newhope Street and Harbor Boulevard and more particularly described infra, is located within the A1 (General Agricultural) District, and WHEREAS, Amendment Application No. 846 has been filed to amend Sectional District Map No. 9-5-10 to rezone such real property to the R2-PRD (Multiple Family-Planned Residential Development) District, and WHEREAS, the Planning Commission has given notice of and duly held a public hearing on said Amendment Application and has recommended approval thereof, and WHEREAS, the City Council regularly held a public hearing on the said Amendment Application on published notice required by law and does now find that the public necessity, convenience, and general welfare require that the said property be reclassified as requested in the said Amendment Application, and that the new classification will not be detrimental to the surrounding property, and WHEREAS, prior to taking this action the City Council has reviewed and considered the information contained in Negative Decalration (I.S. No. 80-216), and, on the basis thereof, finds that the project will not have a significant effect on the environment; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN that the real property situated in the City of Santa Ana, County of Orange, State of California, generally located on the south side of Fifth Street between Newhope Street and Harbor Boulevard, and more particularly described in Exhibit A, attached hereto and incorporated herein as though fully set forth, is hereby reclassified from the A1 (General Agricultural) District, and that Sectional District Map No. 9-5-10 is hereby amended to show said reclassification in accordance with Exhibit A.A. 846-A. ADOPTED this 17th day of February , 1981, by the following vote: AYE S: NOES: AB$ENT: ATTEST: COUNCILMEN: COUNCILMEN: COUNCILMEN: Bricken, Griset, Luxembourger, Markel, Serrato, Ward, Yamamoto None None AYOR CITY ATTORNEY LEGAL DESCRIPTION AMENDMENT APPLICATION #846 That portion of the southeast quarter of the southeast quarter of Section 9, Township 5 South, Range l0 West, S.B.B.M. per map recorded in Book 51, Page 12 of Miscellaneous Maps, records of Orange County, California, more particularly described as follows: Beginning at the northeast corner of the southeast quarter of the southeast quarter of said Section 9, said point also being the center line intersection of Harbor Boulevard and Fifth Street as shown on a map recorded in Book 60, Page 33 of Parcel Maps, records of said Orange County; thence, along the north line of said southeast quarter of the southeast quarter and said Fifth Street South 89°23'01" West, 594.29 feet; thence, South 00°30'43" East, 679.21 feet; thence, South 89°28'12" West, 330.29 feet; thence, North 00°30'10" West, 678.72 feet to a point on said North line and said center line; thence along said north line and said center line North 89°23'01" East, 330.18 feet to the True Point of Beginning; excepting therefrom the northerly 281.5 feet of the easterly 131.84 feet thereof.
