ORDINANCE NO. NS-1568
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA ADDING DIVISION 10 TO
ARTICLE IV OF CHAPTER 2 OF THE SANTA ANA
MUNICIPAL CODE TO ESTABLISH AN ARCHITECTURAL
REVIEW BOARD OF THE CITY OF SANTA ANA
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That the Santa Ana Municipal Code,
is hereby amended by adding a division to be numbered 10, to
Article IV of Chapter 2, which said division shall consist
of sections to be numbered 2-641 through 2-653 inclusive and
which reads as follows:

ARCHITECTURAL REVIEW BOARD
Sec. 2-641.
Establishment of Architectural
Review Board
There is hereby established the Architectural
Review Board of the City of Santa Ana, having such powers as
set forth in this Chapter. The said board shall consist of
seven members each of whom must either reside or have his or
her principal place of business in the City of Santa Ana.
Members shall be subject to appointment and removal and
shall serve terms in accordance with Section 901 of the
Charter of the City of Santa Ana.
Sec. 2-642. Scope of Authority
The Architectural Review Board shall exercise its
powers of review and report with respect to any and all
development projects located within the City of Santa Ana
Community Redevelopment Project Area as established by the
Redevelopment Plan of the City of Santa Ana, as amended by
Ordinance No. NS-1258, adopted June 2, 1975.
In addition, any power of architectural control
over any development project in the City which may be
exercised by the City Council pursuant to its control over
public works construction or by any contract with a
developer, or by the City Council or the Planning Commission
in connection with any application for a zoning variance,
conditional use permit, or similar discretionary entitlement
for a development project, may be delegated in whole or in
part to the Architectural Review Board.
The administrative staff of the City of
shall furnish necessary support services to the
Architectural Review Board.

Sec. 2-643. Definitions
As used herein, the following terms shall be
construed as hereinafter set forth:
(a) "Architecture" and "Architectural" refer
to the exterior design features of buildings and
accessory structures and on-site improvements,
including landscaping. The architectural review
undertaken pursuant to this Chapter shall not
extend to considerations of building safety or
zoning regulations except insofar as such

considerations affect the scope of the
alternatives available for improvement in the
design of the development.
(b) "Developer" means the person, association
firm, partnership or corporation having the ability
to control the design of any development project,
other than public works construction.
(c) "Development project" means (1) any activity
requiring a building permit under the Building Code
of the City of Santa Ana except interior alterations
and repairs undertaken for maintenance purposes
which do not change the architecture of a building;
and (2) public works construction.
(d) "Project area" means the area in which
the Architectural Review Board has authority to
exercise its powers pursuant to Section 2-642.
(e) "Public Works Construction" means new
construction undertaken by the City of Santa Ana
by or through its department of public works, but
does not include maintenance.
Sec. 2-644. Purpose
The Architectural Review Board shall review and
report upon development projects in the project area for the
following purposes:
(1) To assist in review and revision of the
general plan of the City of Santa Ana as appropriate
to improve the quality of architectural design in
the project area.
(2) To advise developers of ways and means
by which architectural features of the development
may be improved.
(3) To inform the City of Santa Ana and the
Community Redevelopment Agency of the City of Santa
Ana of proposed developments which do not satisfy
standards of architectural quality.
(4) To assist the City Council, the Planning
Commission, and the Planning Department of the
City of Santa Ana in the exercise of their control
over developments which are subject to discretionary
approval under the zoning laws of the City.
(5) To assist the Community Redevelopment
Agency of the City of Santa Ana in the exercise
of design control over any development carried out
pursuant to contract with the developer.
(6) To assist the director of public works
in the design of new public works construction in
the project area.
(7) To assist in sign control. Such powers
of review and report shall include proposed signs
accessory to buildings proposed for new construction,
but shall not extend to the change in copy of
existing signs, nor to any proposed additional or
relocated signs accessory to existing buildings

except insofar as the recommendations of said
Board may be requested pursuant to the zoning
laws of the City of Santa Ana.
Sec. 2-645. Standards
Developments and public works in the project area
shall be evaluated to determine whether buildings, accessory
structures and grounds will show a high level of
architectural quality such as will:
(a) enhance the image of the project area as
an increasingly attractive area for the investment
of private funds both in new development and the
renovation of existing buildings.
(b) promote harmonious aesthetic relationship
between the architectural style of new development
and the restoration of older buildings to the best
possible representation of their original archi-
tectural style.
(c) discourage adverse aesthetic impacts
which are reasonably avoidable.
(d) promote attractive landscaping.
(e) promote attractive public works construction.
The Architectural Review Board may adopt more
specific guidelines of architectural quality in accordance
with the standards set forth herein.
Sec. 2-646. Meetings and by-laws
The time, place and procedures of the
Architectural Review Board shall be set forth in the by-laws
to be adopted by said Board. Unless and until otherwise
provided in such by-laws, the regular meetings of said Board
shall be held on the third Wednesday of each month at 6:00
p.m. in Room 831 of the Santa Ana City Hall.
Sec. 2-647. Secretary
The Executive Director of the Community
Redevelopment Agency shall serve, ex officio, as the
Secretary of the Architectural Review Board, and shall,
either directly or through an authorized representative,
maintain the minutes and prepare the reports of the said
Board and discharge the duties set forth in this Chapter.
Sec. 2-648. Public works construction.
The Director of Public Works shall assure that new
public works construction in the project area is submitted
to the Architectural Review Board for review and report
prior to making any commitment to the design of such
construction.

Sec. 2-649. Private development projects.
No application for a building permit, nor any
development plans submitted to the City administrative
staff for plan checking, for a development project in the
project area shall be accepted as complete unless and until
the developer has submitted architectural plans to the
Architectural Review Board and obtained the report of such
Board in accordance with this Chapter, or until the time
limits for the Board's preparation of such report has
expired.
Sec. 2-650.
Submission of architectural
plans.
The developer of any development project in the
project area shall file with the Secretary of the Board
conceptual architectural plans describing the development as
proposed to exist upon completion, consisting of all of the
following:
(1) A site plan showing the location of all
buildings, landscaped areas, off-street parking
areas, vehicular and pedestrian access ways, and
accessory structures, such as monument or pole signs;
(2) Architectural renderings (conceptual
design drawings) of the elevations of all buildings
from all ground level perspectives together with
landscaping and accessory structures, showing the
colors thereof;
(3) A written description of the surface
materials of the buildings and accessory structures,
and a written description of any landscaping, insofar
as the visual image of the development will be
affected thereby.
The Board may adopt additional requirements for
the content of the architectural plans for development
projects.
The Secretary shall determine whether plans filed
pursuant to this Section are reasonably complete and shall
notify the developer of any documentation necessary to
complete such plans. Upon the approval of such plan~ as
completed, the Secretary shall so notify the developer,
specifying the date on which such completed plans were
received as the date of filing for purposes of the period of
review by the Architectural Review Board. The Director of
Building Safety and the Planning Director shall likewise be
notified.
Sec. 2-651. Review by the Board
The ~ecretary shall schedule reviews of
architectural plan~ by the Board. The Secretary shall give
advance written notification of the time and place of such
review to the developer. The developer shall be entitled to

address the Board at the time of such review if he so
desires. The Board may adopt procedures in its by-laws for
the receipt of oral or written communications from the
developer or any other interested persons.
Sec. 2-652. Review Period.
The Architectural Review Board shall complete its
final review and report on any development project in the
project area within forty (40) days of the date of the
filing of conceptual architectural plans with the Secretary
of the Board, in accordance with Section 2-650. Failure of
the Board to prepare a report within the said period shall
constitute absence of any objection to the plans as
submitted. The Board may, at any time prior to the
expiration of such period, determine that a development
project as proposed does not present any significant concern
with respect to architectural quality standards and direct
the Secretary to issue a summary report so stating. The
abovesaid forty (40) day period may be extended to any
specified date provided the developer consents to such
extension in writing, and may be extended for an additional
twenty (20) days without the consent of the developer if at
any meeting of the Board such extension is approved by two-
thirds (2/3) vote of the members present and voting.
Sec. 2-653. Limitation on development.
No developer who has been required, or whose
predecessor in interest has been required, to submit
architectural plans for review by the Architectural Review
Board pursuant to this Chapter shall thereafter cause or
allow such development to be completed in a manner which
results in a significantly different appearance from that
represented in the said architectural plans, except for
differences resulting from the developer's compliance with
the recommendations of the said Board, or with requirements
imposed by the City of Santa Ana in the exercise of any
contractural obligations to the Community Redevelopment
Agency of the City of Santa Ana.
Sec. 2-654. Time limit on effectiveness
of this division.
This division shall cease to be effective on May
6, 1983, and shall not be enforced thereafter.
SECTION 2: This Ordinance shall not apply to
any development project for which application has been made
for building permits or for any required discretionary
approval under the zoning or subdivision regulations of the
City of Santa Ana prior to a date thirty (30) days prior to
the effective date of this Ordinance. Furthermore, this
Ordinance shall not apply to any development to be
constructed or rehabilitated pursuant to an agreement
between the developer and the Community Redevelopment Agency
of the City of Santa Ana executed prior to the effective
date of this Ordinance, except to the extent review and
approval by the Architectural Review Board may be expressly
required by the terms of such agreement.

SECTION 3: Those persons presently serving as
members of the Architectural Review Committee are hereby
appointed as the initial members of the Architectural Review
Board established by this Ordinance.
