NS- 1647 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 41-616.6 TO THE SANTA ANA MUNICIPAL CODE, TO PROVIDE FOR INSTALLATION OF OFF-STREET PARKING SPACES FOR PHYSICALLY HANDICAPPED PERSONS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-616.6, which said section reads as follows: Sec. 41-616.6. Handicapped parking (a) Number A portion of the required off-street parking spaces required for any nonresidential use by this chapter, shall be designed for physically handicapped persons in accordance with the following standards: Total Number of Parking Spaces Number of Spaces for Handicapped Persons 1 - 40 1 41 - 80 2 81 - 120 3 121 - 160 4 161 - 300 5 301 - 400 6 401 - 500 7 Over 500 1 for each 200 additional spaces provided (b) Design Handicapped persons' parking spaces shall be at least 14 feet wide and 18 feet long, except that, any such stalls arranged in pairs with a 5~foot wide loading/unloading area between them clearly marked on the ground need be only 9-feet wide. N$-82-1647 PAGE TWO (c) Designation (1) Where less than 5~ total off-street parking spaces are provided, the one space designed for use by handicapped persons shall be lined to provide a 9-foot wide parking area and a 5-foot wide loading/unloading area, but need not be designated for use by handicapped persons exclusively. (2) Where 5 or more total off-street parking spaces are provided, each space designed for use by handicapped persons shall be designated for exclusive use by such persons by signs and surface markings conforming to the standards set forth in section 22507.8 of the California Vehicle Code and in the State Building Code. A sign giving notice that unauthorized vehicles parking in spaces designated for handicapped persons may be towed away at the owner's expense, conforming to the standards set forth in the State Building Code, shall be posted in a conspicuous place, at each entrance to the off-street parking area. (4) If such spaces are located in a parking structure or ramp, such spaces and all pedestrian aisles to be used by handicapped persons shall have a minimum overhead clearance of 8 feet, 2 inches, and such spaces shall be located on the street level of the structure or within easy access to an elevator. NS-82-1647 PAGE THREE SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposit pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
