NS-1671 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING THE SANTA ANA MUNICIPAL CODE BY ADDING DIVISION 11 TO ARTICLE IV, CHAPTER 2, CONSISTING OF SECTIONS 2-660 TO 2-661 ESTABLISHING THE COMMUNITY CABLE CITIZENS BOARD AND ITS POWERS AND DUTIES. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1. That the Santa Ana Municipal Code, is hereby amended by adding a Division to Article IV of Chapter 2, to be numbered Division 11, which said Division reads as follows: DIVISION 11. COMMUNITY CABLE CITIZENS BOARD Sec. 2-660. Establishment of Community Cable Citizens Board. There is hereby established the Community Cable Citizens Board of the City of Santa Ana, having such powers as set forth in this chapter. The said board shall consist of eleven (11) members each of whom must reside or have his or her principal place of business in the City of Santa Anao Members shall be subject to appointment and removal and shall serve terms in accordance with Section 901 of the Charter of the City of Santa Ana. Sec. 2-661. Scope of Authority. The Community Cable Citizens Board shall have the following powers and duties: (1) It shall consider all matters that may be referred to it by the city council or the city manager, and shall render its recommendations, counsel and advice in regards thereto. (2) It shall conduct public hearings on rate change requests made by any cable television franchisee and shall make a written finding which shall specify all facts relied upon in arriving at a recommendation to the city council regarding such rate change request. ORDINANCE NO. NS- 1671 PAGE TWO (3) It shall conduct state of the art reviews as required by any cable television franchise agreement and report its findings to the city council and city manager. (4) It shall conduct an annual review of the quality of services provided by any cable television franchisee and report its findings to the city council and city manager. (5) It shall hear and resolve controversies between complaining persons and any cable television franchisees which cannot be resolved between the complaining person and the franchisee. (6) It shall assist the city council and city manager in determining whether any cable television franchisee is in compliance with its franchise agreement. (7) It shall make such studies, investigations, plans and recommendations as it may deem necessary for the purpose of advising the community of the availability of cable television services. SECTION 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 3. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or ORDINANCE NO. NS- 1671 PAGE THREE cash deposit in lieu thereof, required to be posted, filed or deposit pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
