ORDINANCE NO. NS-1730
AN ORDINANCE OF THE CITY OF SANTA ANA
ADDING SECTION 2-107 TO THE SANTA ANA
MUNICIPAL CODE TO ESTABLISH THE DOWN-
TOWN DEVELOPMENT COMMISSION
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: That the Santa Ana Municipal Code is hereby amended
by adding a section, to be numbered 2-107, which said section reads
as follows:
Sec. 2-107. Downtown Development Commission
(a) The city council may, from time to time, convene
as the Downtown Development Commission to do any of the following:
(1) Prepare an analysis of economic changes
taking place in the downtown/Civic Center area.
(2) Study and analyze the impact of metropolitan
growth upon the downtown area.
(3) Plan and propose the construction, the
renovation, repair, remodeling, rehabilitation,
restoration, preservation or reconstruction of
public facilities, existing buildings, or residential
dwelling units which may be necessary or appropriate
for the execution of plans which, in the opinion of
the Commission, aid in the economic growth of the
downtown district.
(4) Develop long-range plans, in cooperation
with the affected governmental corporations and
agencies which are chiefly responsible for planning
in the downtown, designed to halt the deterioration
of property values and to promote the economic growth
and take such steps as may be necessary to persuade
property owners to implement the plans to the fullest
extent possible.

(5) Implement development plans in the
downtown district necessary to achieve the
purposes of the City.
(6) Make and enter into contracts necessary
or incidental to the matters described herein.
(7) Recommend and/or direct the acquisition,
lease or conveyance of land and other property
which is reasonably necessary to achieve quality
growth and development in the downtown area.
(8) Recommend and/or direct the improvement
of land and the construction, reconstruction, re-
habilitation, restoration or preservation of
commercial buldings, including multiple-family
dwellings, and any necessary or desirable appur-
tenances thereto, within the downtown area for
the use, in whole or in part, of any public or
private person or corporation for public purposes.
(9) Recommend and/or direct the lease of
buildings and property in the downtown area.
(10) Accept grants and donations of property,
labor, or other items of value from public and
private sources.
(11) Recommend and/or direct the acquisition
or construction of public facilities in the down-
town area.
Nothing herein shall preclude the city council from
considering or taking action on any of the aforesaid matters
without convening as the Downtown Development Commission.
(b) In addition to the members of the city council,
the member of the Orange County Board of Supervisors represent-
ing the First Supervisorial District shall be an ex officio
member of the Downtown Development Commission. At all times
when the city council is convened as the Downtown Development
Commission, the said Supervisor shall be entitled to a place

with the members of the city council and to participate in all
discussion and debate as fully as any member of the city council,
provided, however, the said Supervisor shall not be entitled to
make, second, or vote on any motion. Except as otherwise provided
herein, all provisions of the charter and this code governing the
meetings of the city council shall apply with full force and
effect whenever the city council is convened as the Downtown
Development Commission.
(c) This section shall cease to be effective on
June 1, 1985.
SECTION 2: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The
City Council of the City of Santa Ana hereby declares that it
would have adopted this ordinance and each section, subsection,
sentence, clause, phrase or portion thereof, irrespective of
the fact that any one or more sections, subsections, sentences,
clauses, phrases, or portions be declared invalid or unconsti-
tutional.
